Section 108: Except for the purpose of the investigation, any person who, without theauthorization of the suspect or his counsel or of the person who signed or received the documentsseized in the course of a search, reveals the contents thereof to a person not qualified to haveknowledge of the same shall be subject to the punishment provided for in the Penal <strong>Code</strong> forbreach of professional secrecy.Section 109:(1) Where it appears necessary in the course of an investigation to establish or to check theidentity of any person, such person shall, at the request of a judicial police officer or one of thepublic servants mentioned in section 78 (1), make himself available for that purpose.(2) Any refusal to submit to the identity check shall be punishable as a simple offence of thefourth class.Section 110:(1) Notwithstanding the provisions of section 88 (1) above, the judicial police officer may, incase of felonies and misdemeanours committed flagrante delicto, and where the investigations,necessitate, go outside, either his territorial jurisdiction, or outside the territorial Il jurisdiction ofthe Legal Department where he carried out his duties, to fol1ow up r his investigations. In thiscase, he shall, under pain of nullity of the acts accomplished and disciplinary sanctions, obtainthe authorisation of the State Counsel of his area of jurisdiction.(2) The said State Counsel, shall, where necessary, inform the State Counsel of the jurisdiction towhich the judicial police officer is going.(3) The judicial police officer shall on his arrival and before carrying out his investigations,report to the competent State Counsel and in all cases, to the competent judicial police officer.Section 111: In the case of a felony committed flagrante delicto, the State Counsel shall becompetent to carry out the investigation.When the State Counsel arrives at the scene of the commission of the offence, the powers of thejudicial police officer to carry out the investigation shall cease immediately unless the said StateCounsel decides otherwise.
