Order2. There were no feasible alternatives to bypass, such as the use ofauxiliary treatment facilities, retention of untreated waste, ormaintenance during normal periods of equipment downtime. Thiscondition is not satisfied if adequate back-up equipment should havebeen installed in the exercise of reasonable engineering judgment toprevent a bypass that could occur during normal periods of equipmentdowntime or preventative maintenance;3. The discharger submitted a notice at least ten days in advance of theneed for a bypass to the Regional Water Board; or4. The discharger may allow a bypass to occur that does not causeeffluent limitations to be exceeded, but only if it is for essentialmaintenance to assure efficient operation. In such a case, the abovebypass conditions are not applicable. The discharger shall submitnotice of an unanticipated bypass as required.M. Upset1. A discharger that wishes to establish the affirmative defense of anupset 10 in an action brought for noncompliance shall demonstrate,through properly signed, contemporaneous operating logs, or otherrelevant evidence that:a. An upset occurred and that the discharger can identify the cause(s)of the upsetb. The treatment facility was being properly operated by the time ofthe upsetc. The discharger submitted notice of the upset as required; andd. The discharger complied with any remedial measures required2. No determination made before an action of noncompliance occurs,such as during administrative review of claims that noncompliance wascaused by an upset, is final administrative action subject to judicialreview.3. In any enforcement proceeding, the discharger seeking to establish theoccurrence of an upset has the burden of proof10 An exceptional incident in which there is unintentional and temporary noncompliance the technologybased numeric effluent limitations because of factors beyond the reasonable control of the discharger. Anupset does not include noncompliance to the extent caused by operational error, improperly designedtreatment facilities, inadequate treatment facilities, lack of preventative maintenance, or careless or improperoperation.2009-0009-DWQ 26 September 02, 2009

Penalties for Falsification of ReportsSection 309(c)(4) of the CWA provides that any person who knowinglymakes any false material statement, representation, or certification in anyrecord or other document submitted or required to be maintained underthis General Permit, including reports of compliance or noncomplianceshall upon conviction, be punished by a fine of not more than $10,000 orby imprisonment for not more than two years or by both.O. Oil and Hazardous Substance LiabilityNothing in this General Permit shall be construed to preclude theinstitution of any legal action or relieve the discharger from anyresponsibilities, liabilities, or penalties to which the discharger is or may besubject to under Section 311 of the CWA.P. SeverabilityThe provisions of this General Permit are severable; and, if any provisionof this General Permit or the application of any provision of this GeneralPermit to any circumstance is held invalid, the application of suchprovision to other circumstances and the remainder of this General Permitshall not be affected thereby.Q. Reopener ClauseThis General Permit may be modified, revoked and reissued, orterminated for cause due to promulgation of amended regulations, receiptof U.S. EPA guidance concerning regulated activities, judicial decision, orin accordance with 40 Code of Federal Regulations (CFR) 122.62, 122.63,122.64, and 124.5.R. Penalties for Violations of Permit Conditions1. Section 309 of the CWA provides significant penalties for any personwho violates a permit condition implementing Sections 301, 302, 306,307, 308, 318, or 405 of the CWA or any permit condition or limitationimplementing any such section in a permit issued under Section 402.Any person who violates any permit condition of this General Permit issubject to a civil penalty not to exceed $37,500 11 per calendar day ofsuch violation, as well as any other appropriate sanction provided bySection 309 of the CWA.11 May be further adjusted in accordance with the Federal Civil Penalties Inflation Adjustment Act.2009-0009-DWQ 27 September 02, 2009
