OrderJuly 1, 2010. If an existing discharger’s site acreage subject to theannual fee has changed, it shall mail a revised annual fee no lessthan seven days after receiving the revised annual fee notification,or else lose permit coverage. All existing dischargers shall beexempt from the risk determination requirements in Section VIII ofthis General Permit until two years after permit adoption. Allexisting dischargers are therefore subject to Risk Level 1requirements regardless of their site’s sediment and receiving waterrisks. However, a Regional Board retains the authority to requirean existing discharger to comply with the Section VIII riskdetermination requirements.5. The discharger is only considered covered by this General Permit uponreceipt of a Waste Discharger Identification (WDID) number assignedand sent by the State Water Board Storm water Multi-Application andReport Tracking System (SMARTS). In order to demonstratecompliance with this General Permit, the discharger must obtain aWDID number and must present documentation of a valid WDID upondemand.6. During the period this permit is subject to review by the U.S. EPA, theprior permit (State Water Board Order No. 99-08-DWQ) remains ineffect. Existing dischargers under the prior permit will continue to havecoverage under State Water Board Order No. 99-08-DWQ until thisGeneral Permit takes effect on July 1, 2010. Dischargers whocomplete their projects and electronically file an NOT prior to July 1,2010, are not required to obtain coverage under this General Permit.7. Small Construction Rainfall Erosivity WaiverEPA’s Small Construction Erosivity Waiver applies to sites betweenone and five acres demonstrating that there are no adverse waterquality impacts.Dischargers eligible for a Rainfall Erosivity Waiver based on lowerosivity potential shall complete the electronic Notice of Intent (NOI)and Sediment Risk form through the State Water Board’s SMARTSsystem, certifying that the construction activity will take place during aperiod when the value of the rainfall erosivity factor is less than five.Where the LRP changes or another LRP is added during construction,the new LRP must also submit a waiver certification through theSMARTS system.If a small construction site continues beyond the projected completiondate given on the waiver certification, the LRP shall recalculate therainfall erosivity factor for the new project duration and submit this2009-0009-DWQ 16 September 02, 2009

Orderinformation through the SMARTS system. If the new R factor is belowfive (5), the discharger shall update through SMARTS all applicableinformation on the waiver certification and retain a copy of the revisedwaiver onsite. The LRP shall submit the new waiver certification 30days prior to the projected completion date listed on the original waiverform to assure exemption from permitting requirements isuninterrupted. If the new R factor is five (5) or above, the LRP shall berequired to apply for coverage under this Order.8. In the case of a public emergency that requires immediate constructionactivities, a discharger shall submit a brief description of theemergency construction activity within five days of the onset ofconstruction, and then shall submit all PRDs within thirty days.C. Revising Permit Coverage for Change of Acreage or New Ownership1. The discharger may reduce or increase the total acreage coveredunder this General Permit when a portion of the site is complete and/orconditions for termination of coverage have been met (See Section II.DConditions for Termination of Coverage); when ownership of a portionof the site is sold to a different entity; or when new acreage, subject tothis General Permit, is added to the site.2. Within 30 days of a reduction or increase in total disturbed acreage,the discharger shall electronically file revisions to the PRDs thatinclude:a. A revised NOI indicating the new project size;b. A revised site map showing the acreage of the site completed,acreage currently under construction, acreage sold/transferred oradded, and acreage currently stabilized in accordance with theConditions for Termination of Coverage in Section II.D below.c. SWPPP revisions, as appropriate; andd. Certification that any new landowners have been notified ofapplicable requirements to obtain General Permit coverage. Thecertification shall include the name, address, telephone number,and e-mail address of the new landowner.e. If the project acreage has increased, dischargers shall mailpayment of revised annual fees within 14 days of receiving therevised annual fee notification.2009-0009-DWQ 17 September 02, 2009
