Teminat mektubu dışındaki teminatlar süreninbitiminde Hazineye gelir kaydedilir.Guarantees Not Returned: After accounting process is completed, any performance bond and ifany, supplementary performance bond which cannot been returned because it has not beenrequested within 2 (two) years after the final acceptance date or expiration date of the warrantydespite the written warning of the Contracting Entity shall be null and void and be returned to theTenderer’s bank. Guarantees other than Letter of Guarantees shall be registered as revenue to theTreasury of Republic of Turkey at the end of that period.41. SÖZLEŞME YAPILMASINDA İSTEKLİNİN GÖREV VE SORUMLULUĞUDUTY AND RESPONSIBITILY OF THE TENDERER IN CONCLUDING THE CONTRACT41.1. İhale üzerinde kalan istekli, kesin teminatı vererek sözleşmeyi imzalamak zorundadır.The tenderer that is awarded the contract shall be liable to sign the contract upon submitting theperformance bond.41.2. İhale üzerinde kalan istekli kesin teminatı vererek sözleşme imzalaması zorunluluğuna uymakoşullarını yerine getirmediği takdirde, protesto çekmeye ve hüküm almaya gerek kalmaksızınihale üzerinde kalan isteklinin geçici teminatı gelir kaydedilir.In case the tenderer does not fulfil his obligations of submitting the Performance Bond and signingthe contract the preliminary guarantee of the tenderer who has been awarded the contract shall berecorded as income without necessity for sending a protest letter and judgement by a court.41.3. Ayrıca üzerine ihale yapıldığı halde mücbir sebep halleri dışında usulüne göre sözleşmeyapmayan istekli, 6 (altı) ay 4734 sayılı Kanun kapsamında yer alan bütün kamu kurum vekuruluşlarının ihalelerine katılmaktan yasaklanır.Furthermore, the tenderer that does not conclude a contract according to the applicableprocedures apart from force majeure shall be prohibited to participate in any tenders for 6 (six)months held by all public authorities and institutions provided in Law No. 4734.41.4. İhalenin, Yerli İstekli lehine sonuçlanması halinde, 39.4.’üncü maddede belirtilen DamgaVergilerinin yatırılmaması durumunda, istekli ile sözleşme imzalanmayacaktır. İstekli tarafındanverilmiş olan Geçici Teminat irat kaydedilecektir. İstekli, 6 (altı) ay süre ile 4734 sayılı Kanunkapsamında yer alan bütün kamu kurum ve kuruluşlarının ihalelerine katılmaktan yasaklanacaktır.In case the contract is awarded to a domestic tenderer but the Stamp Taxes mentioned in Article39.4 are not paid, the contract shall not be signed with the tenderer. Bid bond submitted by thetenderer shall be registered as revenue. The tenderer shall be prohibited to participate in anytenders for 6 (six) months held by all public authorities and institutions provided in Law No. 4734.42. EKONOMİK AÇIDAN EN AVANTAJLI İKİNCİ TEKLİF SAHİBİNE BİLDİRİMNOTIFICATION TO THE TENDERER HAVING THE SECOND ECONOMICALLY MOSTADVANTAGEOUS TENDER42.1. Bu durumda ihale komisyon kararında ekonomik açıdan en avantajlı ikinci teklif sahibi istekliile sözleşme imzalanabileceği belirtilmişse, 39’uncu maddede belirtilen sürenin bitimini izleyen 7(yedi) gün içinde ekonomik açıdan en avantajlı ikinci teklif sahibi istekliye 39 uncu maddedebelirtilen şekilde tebligat yapılır. Tebligatı müteakip yabancı isteklinin 22 (yirmiiki), yerli isteklinin ise10 (on) günlük süre içinde, kesin teminatı vermek suretiyle sözleşmeyi imzalaması gerekmektedir.In this case, if it was stated in tender commission decision that the contract may be concluded withthe tenderer that submitted the second economically most advantageous tender, this tenderer shallbe notified in the way indicated in Article 39 and within 7 (seven) days following the period stated inArticle 39. Following that notification, foreign tenderer shall submit performance bond and sign thecontract within 22 (twenty-two) days and domestic tenderer within 10 (ten) days.42.2.
