40. KESİN TEMİNAT VE EK KESİN TEMİNAT/PERFORMANCE BOND AND THE ADDITIONAL PERFORMANCE BOND40.1. İhale üzerinde kalan istekliden sözleşme imzalanmadan önce, ihale bedeli üzerindenhesaplanmak suretiyle % 6 (yüzde altı) oranında kesin teminat alınır. Kesin Teminat Mektubuörneği LAHİKA-8’dadır.The tenderer that is awarded the contract shall be liable to provide performance bond at an amountcorresponding to 6% (six percent) of the procurement price before concluding the contract. Sampleof Performance Bond has been provided in APPENDIX-8.40.1.1. Ek kesin teminat; Ek sözleşme ile fiyat artırımları yapıldığı durumlarda ve ek sözleşmedüzenlenmeksizin sözleşme kapsamında yapılacak iş artışlarında artan bedelin % 6 (yüzdealtı)’sıoranında teminat olarak kabul edilen değerler üzerinden ek kesin teminat alınacaktır. Bu ek kesinteminatın verilmesinde, kesin teminatın alınmasına ilişkin usul ve esaslar geçerlidir.Additional performance bond; In the event that increases in price are made by supplementarycontract and in the increases of work under the contract without drawing up supplementarycontract, an additional performance bond shall be received over values accepted as guarantee atthe rate of 6 % (six percent) of this increased price. The procedures and principles regarding thereceiving of performance bond shall be valid in submitting such additional performance bond.40.2. Bu sürenin yeterli olmaması durumunda, garanti süresinin 1 (bir) ay ötesini kapsayacakşekilde İdarenin ikazına lüzum kalmaksızın belirli devreler halinde otomatik olarak uzatılacaktır.Kesin teminat mektubu yukarıdaki hükümlerden birini kapsayacak şekilde düzenlenecektir.In case of having time limit; it shall cover 1 (one) month beyond the warranty period. In case thisperiod becomes insufficient, it shall automatically be extended for intervals in order to cover 1 (one)month beyond the warranty period without necessity for any protest of the Contracting Entity. ThePerformance Bond shall be prepared in order to cover one of the provisions above.40.5.
