36. İHALENİN KARARA BAĞLANMASI/ CONCLUSION OF TENDER PROCEEDINGS36.1. Yapılan değerlendirme sonucunda ihale komisyonu tarafından ihale, ihale dokümanınauygun ekonomik açıdan en avantajlı teklifi veren istekli üzerinde bırakılır.At the end of the evaluations, the contract shall be awarded by the tender commission to thetenderer that submitted the most advantageous tender in accordance with the tender document.36.2. İhale komisyonu tarafından farklı para birimi cinsinden verilen teklifler Amerikan Dolarınaçevrilerek değerlendirilecektir. İhale tarihindeki Resmi gazetede yayımlanan Türkiye CumhuriyetiMerkez Bankası çapraz kuru esas alınır. Ancak, ihale komisyon kararında ve ihale üzerine kalanistekli ile imzalanacak sözleşmede, o isteklinin teklif mektubunda (proforma fatura) belirttiği parabirimi esas alınacaktır.Tender Commission shall evaluate the tenders submitted in different currencies by the tenderersafter converting them to US Dollars Central Bank of Republic of Turkey Cross Rate published inthe official gazette in the tender date shall prevail. However, in the tender commission decision andin the contract concluded with the awarded tenderer, the currency stated by the tenderer in itstender letter (proforma invoice) shall prevail.36.3. İhale komisyonu; alternatif teklifleri de değerlendirerek gerekçeli ihale komisyon kararını ihaleyetkilisinin onayına sunar.Tender Commission shall evaluate the alternative tenders and submit its decision for tenderauthority’s approval with reasons.37. İHALE KARARININ ONAYLANMASI/ APPROVAL OF TENDER DECISION37.1. İhale yetkilisince, karar tarihini izleyen 10 (on) iş günü içinde ihale kararı onaylanır veya iptaledilir.Tender Authority shall approve the tender decision within 10 (ten) business days following thedate of decision or cancel the decision.37.2. İhale; kararın ihale yetkilisince onaylanması halinde geçerli, iptal edilmesi halinde isehükümsüz sayılacaktır.The procurement shall be deemed valid if the decision is approved, and invalid if it is cancelledby the Tender Authority.37.3. İhale sonucunun ilânı; Sözleşmenin istekli ve idare yetkililerince imzalanmasını müteakip, 15(onbeş) gün içinde www.hvlojk.tsk.tr. internet adresinde yayımlanmak suretiyle ilân edilecektir.Announcement of tender decision: Following the signing of the contract by the tenderer andContracting Entity’s authorities, it shall be announced by publishing in www.hvlojk.tsk.tr. websitewithin 15 (fifteen) days.38. KESİNLEŞEN İHALE KARARININ BİLDİRİLMESİ/NOTIFICATION OF FINAL TENDERDECISIONİhale sonucu; ihale kararlarının ihale yetkilisi tarafından onaylandığı günü izleyen 5 (beş) güniçinde, ihale üzerinde bırakılan istekli de dâhil ihaleye teklif veren bütün isteklilere imza karşılığıelden tebliğ edilir veya iadeli taahhütlü mektup ile tebligat adreslerine bildirilir. Yerli isteklilere,mektubun postaya verilmesini takip eden 7 (yedi)’nci gün, Yabancı isteklilerde ise19 (ondokuz)’uncu gün kararın isteklilere tebliğ tarihi kabul edilir. Ayrıca Elektronik ortamda veyabelgegeçer ile de tebliğ edilebilir. Bu şekilde yapılan tebliğlerde bildirim tarihi tebliğ tarihi sayılır.İhale kararlarının ihale yetkilisi tarafından iptal edilmesi durumunda da isteklilere aynı şekildebildirim yapılır.The result of the tender shall be notified to all tenderers that submit tenders for the procurementincluding the tenderer that is awarded the contract, in return for signature or sent to theirnotification addresses via registered and prepaid mail within 5 (five) days following the approval ofthe procurement award by the tender authority. For domestic tenderers, the seventh (7th) day andfor foreign tenderers, nineteenth (19th) day following the mailing date shall be assumed as thenotification date of the procurement award. Furthermore it may be notified in electronicenvironment or by fax. In this case, the announcement date shall be assumed as notification date.In the event that tender decisions are cancelled by the tender authority, the tenderers shall benotified in the same way.HK13-A7-030 38
