31.3.3. Bahsedilen aritmetik hatanın düzeltilmesi sonucunda, Proforma Fatura ve isteklinin sunmuşolduğu Geciçi Teminat Tutarı, Yeni Teklif Bedelinin % 3 (yüzdeüç)’ünün altında kalmış ise; GeçiciTeminat düzeltilerek/tamamlatılarak İdare’ye teslim edilecektir. Düzeltilmiş Geçici Teminat idare’yeteslim edilmeden, eski geçici teminat İstekliye iade edilmeyecektir.After such arithmetic error is corrected, in the event that Proforma Invoice and Bid Bond amountsubmitted by the tenderer is less than 3% (three percent) of the New Tender Price; Bid Bond shallbe corrected/completed and delivered to the Contracting Entity. Unless the corrected Bid Bonddelivered to the Contracting Entity, previous bid bond shall not be returned to the tenderer.31.3.4. İstekli’nin düzeltilen teklif bedelini kabul etmemesi veya süresi içerisinde herhangi bir cevapvermemesi veya Geçici Teminatı düzeltmemesi/tamamlamaması halinde, teklifi değerlendirme dışıbırakılır ve geçici teminatı gelir kaydedilir.In the event that the tenderer does not accept the corrected tender price or does not reply withinthis duration or does not correct/complete Bid Bond, the tender shall be disqualified fromevaluation and the bid bond furnished shall be registered as revenue.31.4. Yapılan değerlendirme sonucundaihale komisyonu tarafından ihale, ekonomik açıdan en avantajlı teklifi veren istekli/isteklilerüzerinde bırakılır. Fiyat üzerinde herhangi bir görüşme yapılmayacaktır.The tenderers that meet the requirements of the Administrative Specification shall be determined.Following the evaluations, the contract shall be awarded to the tenderer/s who has submittedeconomically the most advantageous tender. İhale komisyonunun talebi üzerine idare, tekliflerin incelenmesi, karşılaştırılması vedeğerlendirilmesinde yararlanmak üzere net olmayan hususlarla ilgili isteklilerden teklifleriniaçıklamalarını isteyebilir.The Contracting Entity may request the tenderers to explain their tenders with regard to unclearpoints in order to review, compare and evaluate the tenders upon the demand of the TenderCommission.32.2. Bu açıklama, hiçbir şekilde teklif fiyatında değişiklik yapılması veya ihale dokümanında yeralan şartlara uygun olmayan tekliflerin uygun hale getirilmesi amacıyla istenilemez ve bu sonucudoğuracak şekilde kullanılamaz.This clarification shall not be requested to change the tender price or to correct tenders that do notcomply with the requirements indicated in the tender document, and shall not be used to reach sucha result.32.3. İdarenin açıklama talebi ve isteklinin bu talebe vereceği cevaplar yazılı olacaktır.The request for clarification of the Contracting Entity and the replies of the tenderer to this requestshall be in writing.33. AŞIRI DÜŞÜK TEKLİFLER/ ABNORMALLY LOW TENDERSİhale komisyonu, teklifleri değerlendirdikten sonra, diğer tekliflere veya idarenin tespit ettiği yaklaşıkmaliyete göre teklif fiyatı aşırı düşük olanları tespit eder ve imalat sürecinin, verilen hizmetinekonomik olması, seçilen teknik çözümler ve teklif sahibinin mal/hizmetlerin temini veya yerinegetirilmesinde kullanacağı avantajlı koşullar, teklif edilen mal ve hizmet işinin özgünlüğü hususlarıgibi vb. durumları, belgelendirilmek suretiyle yapılan yazılı açıklamaları dikkate alarak, aşırı düşükteklifleri değerlendirir. Bu değerlendirme sonucunda, açıklamaları yeterli görülmeyen veya yazılıaçıklamada bulunmayan isteklilerin teklifleri reddedilir.After the tender commission evaluates the tenders, it shall determine the abnormally low tendersaccording to the other tenders or the approximate cost determined by the Contracting Entity. Thetender commission shall evaluate the abnormally low tenders with regard to the written clarificationsby documenting and the cost-effectiveness of manufacturing process and the service rendered,technical solutions selected and the advantageous conditions that shall be used by the tenderer insupplying or performance of the good/services and originality of the product and service offered. Asa result of this evaluation, the tenders of the tenderers whose clarifications are not deemedsatisfactory or that do not make any written clarification shall be rejected.HK13-A7-030 36
