Mücbir sebepler dışında, ihale dokümanı ve sözleşme hükümlerine uygun olaraktaahhüdünü yerine getirmemek,Failing, except force majeure conditions, to perform its obligations in accordance with tenderdocument and provisions of the contract,10.2.7. İmzalanacak sözleşmenin, sözleşme tasarısında yer alan hükmüne aykırı olarakdevredilmesi veya devir alınması.Assigning or taking over the contract contrary to the provision specified in the draft contract,10.3. Bu yasak fiil veya davranışlarda bulunanlar hakkında ihalelere katılmaktan yasaklamaile ilgili aşağıdaki maddeler uygulanır:Tenderers that enter into the said prohibited acts or conducts shall be subject to thefollowing provisions regarding prohibition to participation in tenders:10.3.1. İş bu şartnamenin 10.1’inci maddesinde belirtilen fiil veya davranışlarda bulundukları tespitedilenler hakkında fiil veya davranışlarının özelliğine göre, Millî Savunma Bakanlığınca;Those who are determined to have been involved in acts or conducts specified in Article 10.1 ofthis Specification, depending on the nature of the said acts or conducts, shall be prohibited fromparticipating in tenders by Ministry of National Defense of the Republic of Turkey.10.3.2. Hile, vaat, tehdit, nüfuz kullanma, çıkar sağlama, anlaşma, irtikâp, rüşvet suretiyle veyabaşka yollarla ihaleye ilişkin işlemlere fesat karıştıranlar veya buna teşebbüs edenler 2 (iki) yıl,2 (two) years for those who conduct or attempt to conduct fraud in procedures related to thecontract through trick, promise, threat, use of influence, undue interest, agreement, corruption,bribe or other means,10.3.3. İsteklileri tereddüde düşürmek, katılımı engellemek, isteklilere anlaşma teklifinde bulunanveya teşvik edenler, rekabeti veya ihale kararını etkileyecek davranışlarda bulunanlar 1(bir) yıl6(altı) ay,1 (one) year 6 (six) months for those who cause hesitation among tenderers, to hinderparticipation, to offer agreement to tenderers or encourage tenderers to accept such offers, toenter into actions which may affect competition or decision of the tender commission.10.3.4. Sahte belge veya sahte teminat düzenleyen, kullanan veya bunlara teşebbüs edenler2 (iki) yıl,2 (two) years for those who issue, use counterfeit documents or guarantees, and attempt to suchactions.10.3.5. Alternatif teklif verebilme halleri dışında, ihalelerde bir istekli tarafından kendisi veyabaşkaları adına doğrudan veya dolaylı olarak, asaleten ya da vekâleten birden fazla teklif verenler1 (bir) yıl,1 (one) year for those who submit more than one tender by a tenderer on his own account or onbehalf of others directly or indirectly, personally or by proxy except for the cases of submittingalternative tenders.10.3.6. Bu şartnamenin 8’inci maddesine göre ihaleye katılamayacağı belirtildiği halde ihaleyekatılanlar 1(bir) yıl.1 (one) year for those who participate in the tender even though the tenderer is prohibited toparticipate per Article 8 of this Specification.HK13-A7-030 20
