Insuring AgreementIn consideration of the Insured paying the Premium to INSURANCE COMPANY OF NORTH AMERICATAIPEI BRANCH (hereinafter called "the Company") and having made a Proposal which shall be the basis ofthis contract and is deemed to be incorporated herein.THIS POLICY APPLIES ONLY IN RESPECT OF THOSE SECTIONS STATED IN THE SCHEDULE ASBEING INSUREDSection 1. Own Primary Remediation CostsThe Company will pay on behalf of the Insured subject to the Limit of Liability the Primary RemediationCosts which arise out of any Pollution Condition on, at, under or migrating from the Covered Locationslisted in the Schedule provided that such Pollution Condition is first discovered by the Insured during thePeriod of Insurance and notified to the Company during the same Period of Insurance or during anyapplicable Extended Reporting Period.Section 2. Imposed Remediation CostsThe Company will pay on behalf of the Insured subject to the Limit of Liability the Remediation Costswhich arise out of any Pollution Condition on, at, under or migrating from the Covered Locations listed inthe Schedule where such Remediation Costs result from Regulatory Action or the requirement of a thirdparty first imposed during the Period of Insurance and notified to the Company during the same Period ofInsurance or during any applicable Extended Reporting Period.Section 3. Legal LiabilityThe Company will pay on behalf of the Insured subject to the Limit of Liability all sums which the Insuredshall become legally liable to pay as damages in respect of accidentalA. Bodily InjuryB. Property DamageC. Trespass Nuisance or Obstructionarising out of any Pollution Condition on, at, under or migrating from the Covered Locations listed in theSchedule provided that the claim is first made against the Insured during the Period of Insurance andnotified to the Company during the same Period of Insurance or during any applicable Extended ReportingPeriod.The Company will also pay Costs and Expenses in respect of any claim to which this Section applies.Section 4. Transportation LiabilityThe Company will pay on behalf of the Insured subject to the Limit of Liability all sums which the Insuredshall become legally liable to pay as damages in respect of accidentalA. Bodily InjuryB. Property DamageC. Trespass Nuisance or Obstructionarising from any Pollution Condition which is caused by products or waste of the Insured duringTransportation provided that the claim is first made against the Insured during the Period of Insurance andnotified to the Company during the same Period of Insurance or during any applicable Extended ReportingPeriod.The Company will alsoa) pay Costs and Expenses in respect of any claim to which this Section applies74
