of or in any way connected with:(a) any Pollutants; and/or(b) any radioactive, toxic, contaminating, explosive or other hazardous properties ofnuclear or atomic operation, installation, reactor, assembly, component, device,weapon, material, fuel or waste from the combustion of nuclear fuel.4.5 Bodily Injury / Property DamageACE will not pay for any Civil Liability Loss any way connected with any Claim for anybodily injury, sickness, disease, death, condition, emotional distress or nervous shock ofany person; or for damage to or destruction of any tangible property including any claimfor loss of use of such property.This Exclusion does not apply to:(i) any Claim for libel, slander, defamation or injurious falsehood; or(ii) Legal Representation Expenses; or(iii) Extension 2.9 “Loss of Documents”.4.6 Assumed LiabilityACE will not pay for any Civil Liability Loss directly or indirectly caused by, arising outof or in any way connected with any liability assumed by any Insured pursuant to anyguarantee, warranty, contract or agreement, which liability would not have otherwiseattached to the Insured in the absence of such guarantee, warranty, contract oragreement.4.7 Guarantee or WarrantyACE will not pay for any Civil Liability Loss resulting from any actual or allegedexpress guarantee or warranty provided by or on behalf of the Insured as to theperformance of any investment or other item of value.4.8 Proprietary RisksACE will not pay for any Civil Liability Loss resulting from any proprietary trading loss;or any Civil Liability Loss where the Insured is acting on its own behalf or as principal.4.9 Failure to Hold LicenceACE will not pay for any Civil Liability Loss directly or indirectly caused by, arising outof or in any way connected with any failure by an Insured to hold any authorisation,licence or approval required by any Applicable Regulations.4.10 Lenders LiabilityACE will not pay for any Civil Liability Loss directly or indirectly caused by, arising outof or in any way connected with:(a) the operation or control of any entity or property that the Insured acquired ascollateral security in connection with any loan, lease or extension of credit, or as aresult of foreclosure or repossession in connection with any loan or extension ofcredit; or388
