Section 1Guide to <strong>making</strong> further <strong>submissions</strong>1. Further SubmissionsAll the <strong>submissions</strong> received to date have been summarised and entered into adatabase. This database allows the Council to prepare a <strong>summary</strong>.The Summary <strong>of</strong> Decisions Requested <strong>by</strong> Persons Making Submissions, along withcopies <strong>of</strong> <strong>submissions</strong> is now available to the public so that everyone can find outwhat issues have been raised.The public is invited to make Further Submissions. These Further Submissions mayonly be in support or opposition to <strong>submissions</strong> already made. They can not extendthe scope <strong>of</strong> the original Submission and can only seek allowance or disallowancein whole or part <strong>of</strong> the original submission.Only certain <strong>persons</strong> may make a further submission, namely:(a) any person representing a relevant aspect <strong>of</strong> the public interest; or(b) any person that has an interest in the proposed plan change that is greaterthan the interest that the general public has; or(c) the local authority for the relevant area.Your further submission must be in the prescribed form. A standard form called“Further Submission on Proposed Plan Change 9 – Minor District Plan MapAmendments is available from Council Service Centres and can be downloadedfrom our website: www.fndc.govt.nzPlease complete a separate further submission for each original submission youwish to comment on.IMPORTANT PLEASE NOTE:Within five working days <strong>of</strong> sending your further submission to Council, youMUST send a copy <strong>of</strong> that further submission to the person who made theoriginal submission on which you are commenting. Further <strong>submissions</strong>must be received at a Council Office <strong>by</strong> 5.00PM ON THURSDAY 1SEPTEMBER 2011.


2. Notice <strong>of</strong> HearingIf you have made a submission (or a further submission) you have the right to beheard or to be represented at a hearing on the Proposed Plan change 9 - MinorDistrict Plan Map Amendments, as long as you have stated on yoursubmission that you wish to be heard.You will be informed in writing <strong>of</strong> the date, time and place at which your submissionwill be heard at least 10 working days before the hearing.3. Notification <strong>of</strong> DecisionsCouncil will notify <strong>decisions</strong> to the submitters and a copy <strong>of</strong> the decision will be sentto all submitters.4. AppealsIf a submitter disagrees with the Council’s decision, they may appeal to theEnvironment Court to review the decision. The Court will hear the appeals and mayagree or disagree with the Council’s decision. It may direct the Council to amendthe Plan if it supports the appeal.5. Plan Change ApprovalWhen all <strong>submissions</strong> and appeals have been resolved, Proposed Plan Change 9 –Minor District Plan Map Amendments is approved <strong>by</strong> Council.
