T. MUTE BIT – (Not listed in Schedule C) Any CHORISTER or CORPSDANCER who performs an activity in which less than 50% <strong>of</strong> the chorus unit (men’s chorus,women’s chorus or chorus divisi) or CORPS DE BALLET, as the case may be, is called by thedirector to appear in a scene in which the chorus or CORPS DE BALLET does not traditionallyappear.ARTICLE III - APPLICATION OF PROVISIONSA. MANAGEMENT agrees that the provisions <strong>of</strong> this Agreement shall apply to andinure to the benefit <strong>of</strong> all ARTISTS engaged by MANAGEMENT or by an affiliate, subsidiaryor the like <strong>of</strong> MANAGEMENT directly or indirectly, or through agents or independentcontractors, notwithstanding anything herein to the contrary. Whenever there shall be used inthis Agreement any phrase <strong>of</strong> a more restricted meaning, such as, for example, “ARTISTSemployed by MANAGEMENT” such phrase shall be deemed to mean “all ARTISTS engaged byMANAGEMENT, or by an affiliate or subsidiary <strong>of</strong> MANAGEMENT directly or indirectly, orthrough agents, or independent contractors.”B. MANAGEMENT agrees that the terms <strong>of</strong> this Agreement apply only to rehearsalsand performances in the U.S. and Canada and their dependencies or possessions. AGMA andMANAGEMENT agree to negotiate terms and conditions, including all terms <strong>of</strong> engagement,rehearsal, travel and performance, as a condition for granting approval to MANAGEMENT totake ARTISTS for an engagement or series <strong>of</strong> engagements on tour outside <strong>of</strong> the U. S. orCanada.ARTICLE IV - EXCLUSIONSExcluded from this Agreement are public education, training and local communityoutreach programs <strong>of</strong> MANAGEMENT. “Local community outreach programs” shall meanthose programs specifically designed for communities or groups that may not otherwise beexposed to the opportunities to see opera.ARTICLE V - ALTERNATE THEATERWhen an alternate facility that is smaller than the House Facility (as defined below), isused (an “Alternate Theatre”) compensation shall be calculated in accordance with thisARTICLE V.The term “House Facility” shall mean with respect to rehearsals, any location in whichthe majority <strong>of</strong> rehearsals are held, and with respect to performances, any location in which themajority <strong>of</strong> performances are held. The minimum rates <strong>of</strong> pay for PRINCIPALS (Lead,Featured, Supporting, Solo Bit and Solo Dancer roles) engaged to perform on a per performance3COLLECTIVE BARGAINING AGREEMENTJuly 1, <strong>2010</strong> through June 30, <strong>2013</strong>
