The term “war”shall not include a war in which the USA is not a party, unless such a war between foreigngovernments affects the USA in such a way as to make the execution <strong>of</strong> this contract impossibleor unfeasible. Should MANAGEMENT invoke the provisions <strong>of</strong> this Article because <strong>of</strong> the war,MANAGEMENT agrees to give ARTIST and AGMA at least two (2) weeks prior written noticethere<strong>of</strong>, and in such case, the Article shall apply only upon the expiration <strong>of</strong> such notice period.ARTICLE XL - TERM OF THIS AGREEMENTA. The term <strong>of</strong> this Agreement shall commence on July 1, <strong>2010</strong> through June 30,<strong>2013</strong>, provided that all contracts with ARTISTS which expire after that date shall be deemedsubject to the minimums and terms and conditions contained in such new Agreement as may beentered into between AGMA and the MANAGEMENT for the next succeeding seasons.B. All ARTISTS’ Per Diems, meal allowances, health coverage\contributions, andwages based on the previous Agreement for services rendered between July 1, <strong>2010</strong> and the date<strong>of</strong> the execution <strong>of</strong> this Agreement, which are less than those negotiated herein for said period,shall be increased retroactively from July 1, <strong>2010</strong>.ARTICLE XLI - OBLIGATIONS OF SIGNATORIESIt is understood and agreed that Michael Mael who is signing this Agreement on behalf<strong>of</strong> MANAGEMENT as agent and representative <strong>of</strong> MANAGEMENT hereby warrants andrepresents that he has the requisite authority as an agent and representative <strong>of</strong> MANAGEMENTto sign this Agreement on behalf <strong>of</strong>, and to bind MANAGEMENT.ARTICLE XLII - AGREEMENT BINDING ON OTHER PARTIESThis Agreement shall be known as the COLLECTIVE BARGAINING AGREEMENTbetween AGMA and WASHINGTON NATIONAL OPERA and shall be binding upon and shallinure to the benefit <strong>of</strong> the signatories hereto and all parties who by reason <strong>of</strong> merger,consolidation, reorganization, sales, assignments, transfer, or the like, shall succeed to, or beentitled to, a substantial part <strong>of</strong> the business <strong>of</strong> any signatory; and MANAGEMENT agrees thatits signature to this Agreement shall likewise bind any and all subsidiary companies engaged inthe production or management <strong>of</strong> Opera, Concerts, Concert Revues, Dance, Recitals, Oratorios,or any other performances within AGMA’s jurisdiction.50COLLECTIVE BARGAINING AGREEMENTJuly 1, <strong>2010</strong> through June 30, <strong>2013</strong>
