production, and up to three (3) minutes <strong>of</strong> a production’s rehearsal orperformance, for purpose <strong>of</strong> promoting the activities <strong>of</strong> MANAGEMENTonly.ARTISTS will be notified prior to any recording.K. The AGMA Internet Release Agreement shall govern compensation for the release<strong>of</strong> work product produced under this Agreement. MANAGEMENT will review and commentupon the AGMA Audio/Video Release Agreement and the AGMA Sound Recording Agreementupon delivery there<strong>of</strong> by AGMA.ARTICLE XXXV - ENGAGEMENT OF ALIEN ARTISTSMANAGEMENT recognizes that Washington National Opera is and shall remain apredominantly <strong>American</strong> organization. All non-leading roles shall be assigned to <strong>American</strong>ARTISTS unless, for extraordinary artistic reasons, MANAGEMENT finds it necessary to assignsuch a role to a foreign ARTIST. MANAGEMENT shall continue to have the right to engageforeign ARTISTS <strong>of</strong> proven distinguished merit and ability for leading roles. The term “foreignartist” as used herein shall mean only a non-resident alien. AGMA agrees that nationality ornational origin shall not be a criterion for eligibility for membership in AGMA in the case <strong>of</strong> anARTIST’s engagement, pursuant to the provisions <strong>of</strong> this Article. Canadian ARTISTS, for thesepurposes, shall not be considered “foreign ARTISTS.”ARTICLE XXXVI - HOTEL RESERVATIONSMANAGEMENT shall be responsible for securing hotel reservations and shall furnish allARTISTS a list <strong>of</strong> accommodations at different price ranges. Two (2) weeks prior to the first(1st) week <strong>of</strong> rehearsals or performance, whichever is earlier, the advance agent or companymanager will submit to all ARTISTS <strong>of</strong> the company a list <strong>of</strong> available accommodations at thevarious price ranges. Within one (1) week thereafter, ARTIST shall indicate his/her acceptanceor his/her preference to arrange for his/her own accommodations. Unless ARTIST notifies thecompany manager <strong>of</strong> his/her acceptance <strong>of</strong> such accommodations and the associated financialliabilities, MANAGEMENT shall be relieved <strong>of</strong> further responsibility. If ARTIST complies withthis requirement and does not receive accommodations upon arrival, s/he shall not be required torehearse or perform until such accommodations are made available. However, shouldcircumstances beyond the control <strong>of</strong> MANAGEMENT (such as a hotel confirming a reservationand its not being available upon arrival <strong>of</strong> ARTIST) make it impossible for MANAGEMENT toprovide the proposed accommodations, ARTIST shall not avail him/herself <strong>of</strong> such right, andMANAGEMENT shall provide other accommodations which are <strong>of</strong> the same or better quality.47COLLECTIVE BARGAINING AGREEMENTJuly 1, <strong>2010</strong> through June 30, <strong>2013</strong>
