E. MANAGEMENT may create recordings (audio and/or visual) <strong>of</strong> rehearsals orperformances for study purposes, without compensation to ARTISTS. Such tapes shall remain atall times in the custody <strong>of</strong> MANAGEMENT. MANAGEMENT shall not permit duplication <strong>of</strong>any study tape, nor will it allow any use <strong>of</strong> a study tape for purposes other than study <strong>of</strong> stagingand review by the Stage Director, Conductor/Music Director, singers, potential co-producers orrenting companies, or other parties directly involved in the production, unless otherwise agreedupon by MANAGEMENT and AGMA.The following disclaimer shall appear on all tapes:This tape was created for the archival record <strong>of</strong> the physicalproduction only and no way is intended to represent the creative orartistic talents <strong>of</strong> the artists involved.F. Should there be any MANAGEMENT-authorized release, distribution, sale, orany other use made <strong>of</strong> these “study” tapes, MANAGEMENT agrees to compensate all ARTISTSinvolved no less than the prevailing applicable minimums.G. To the extent MANAGEMENT can require or control such credit, AGMA andeach ARTIST recorded will receive name credit in the released or distributed material.H. For purposes <strong>of</strong> definition, “promotional,” “promotion,” or “promoting” as used inthis Article shall mean any “not-for-pr<strong>of</strong>it” activity which may enhance the current or futuresales, fundraising, reputation, or recognition <strong>of</strong> MANAGEMENT or its affiliates and for whichactivity neither MANAGEMENT nor any <strong>of</strong> its personnel (including stage hands, orchestra, etc.)nor any <strong>of</strong> its performing artists hired for the ongoing live stage presentation, receives additionalremuneration.I. AGMA, ARTISTS, and MANAGEMENT shall work together to aggressivelyidentify and eliminate unauthorized or pirated tapes <strong>of</strong> rehearsal or performances. Further,AGMA and MANAGEMENT shall cooperate to discourage and/or prevent the creation and/ordistribution <strong>of</strong> unauthorized recordings in whatever manner they may deem appropriate.J. The following language will be inserted in the Standard ARTIST’s <strong>Contract</strong>:PLEASE TAKE NOTICE:ARTIST agrees that pursuant to the Collective Bargaining Agreement,MANAGEMENT may create a documentary or educational film, video, orradio program for broadcast on the local television or radio which mayutilize up to thirty (30) minutes <strong>of</strong> any performance or rehearsal materialand may create recordings <strong>of</strong> rehearsals or performances for studypurposes.By signing this Standard ARTIST’s <strong>Contract</strong>, ARTIST consents to theairing <strong>of</strong> one (1) live or tape-delayed local radio broadcast <strong>of</strong> a46COLLECTIVE BARGAINING AGREEMENTJuly 1, <strong>2010</strong> through June 30, <strong>2013</strong>
