Theyinclude:(a)1); andorganised executions, including those listed in Schedule E (Part(b)(Part 2).opportunistic killings, including those listed III Schedule E66. Alternatively, as alleged in paragraph 9, it was foreseeable that one ormore members of the overarching joint criminal enterprise to permanentlyremove Bosnian Muslims and Bosnian Croats from Bosnian Serb-claimedterritory, and/or persons used by any such member(s) to carry out the crimesof deportation and forcible transfer, might perpetrate these crimes ofextermination and murder. Ratko MLADIC was aware that such acts ofextermination and/or murder were a possible consequence of theimplementation of this overarching objective, and willingly took that risk.Ratko MLADIC is criminally responsible for:Count 4:Extermination, a CRIME AGAINST HUMANITY, punishableunder Articles 5(b), and 7(1) and 7(3) of the Statute;Count 5: Murder, a CRIME AGAINST HUMANITY, punishable underArticles 5(a), and 7(1) and 7(3) of the Statute; andCount 6: Murder, a VIOLATION OF THE LAWS OR CUSTOMS OFWAR, as recognised by Common Article 3(1)(a) of the Geneva Conventionsof 1949, punishable under Articles 3, and 7(1) and 7(3) of the Statute.Case No. IT- 09-92-1 30 1 June 2011
