Ratko MLADIC failed to take the necessary and reasonable measuresto prevent the commission of crimes by members of the VRS and elements ofSerb Forces under his effective control and/or to punish the perpetratorsthereof. The term "committed", as used in the context of Article 7(3) of theStatute, includes all modes of liability covered by Articles 7(1) and 7(3) ofthe Statute. The acts and omissions of Ratko MLADIC that demonstrate hisfailure to take such necessary and reasonable measures include:(a) his failure to order or initiate genuine or adequate investigationsinto credible allegations of the commission of crimes by members ofthe VRS and/or elements of Serb Forces under his effective control;(b) his failure to report information about the commISSIOn orpossible commission of crimes by members of the VRS and/orelements of Serb Forces under his effective control to the appropriateauthorities;(c) his failure to discipline, dismiss, demote or refrain frompromoting members of the VRS and/or elements of Serb Forces underhis effective control who were involved in the commission of crimesand/or who failed to prevent or punish the commission of crimes bytheir subordinates; and/or(d) his failure to issue the orders that were necessary and reasonablein the circumstances to prohibit or put a stop to the commission ofcrimes by members of the VRS and/or elements of Serb Forces underhis effective control.Case No. IT- 09-92-1 15 1 June 2011
