APPELLANTS’ BRIEF<br />
People <strong>of</strong> <strong>the</strong> <strong>Philippines</strong> vs. Fortuna, et. al.<br />

(now a city in Metro Manila) and Jonas testified that he and<br />
Augusto came from Jonas’ house in Buendia to go to Fabella<br />
Hospital in Sta. Cruz, Manila at 7:00 in <strong>the</strong> morning.<br />
These two places (Fairview, Q.C. and Buendia, Makati)<br />
are separated by long distances and <strong>the</strong> traffic jam in both is<br />
terrible. How on earth Augusto will proceed first to Buendia,<br />
Makati before 7:00 in <strong>the</strong> morning to fetch Jonas when Augusto<br />
as well as Jonas could have more reasonably and easily gone<br />
straight separately to Fabella Hospital in Sta. Cruz, Manila<br />
(behind <strong>the</strong> Central Market) is largely amazing.<br />
(c) moreover, <strong>the</strong> court has not been cited to any<br />
special reason why Augusto’s presence (considering that he is<br />
from Fairview, Q.C., while Jonas is from Buendia, Makati) at<br />
Fabella Hospital to help fetch Jonas’ wife and new-born baby is<br />
necessary. In our family life, it is usually <strong>the</strong> womenfolk who are<br />
expected to help fetch a woman who has just delivered in a<br />
hospital. Yet, here, it appears that not one woman from ei<strong>the</strong>r <strong>the</strong><br />
family <strong>of</strong> Jonas or his wife Dorothy came over to help fetch<br />
Dorothy from <strong>the</strong> hospital. How come this is so is not reflected<br />
in <strong>the</strong> evidence.<br />
Indeed, this court, on numerous occasions, has ruled that “an alibi buttressed by<br />
an accused’s relatives is highly suspect.” Alibi which appears to be an afterthought, a<br />
flimsy attempt to place <strong>the</strong> accused in ano<strong>the</strong>r place when in fact such accused was<br />
indeed at <strong>the</strong> crime scene can easily be detected. While such an alibi is highly suspect,<br />
<strong>the</strong>re are also instances when factual circumstances reveal that <strong>the</strong> alibi presented is<br />
reliable and truthful even if <strong>the</strong>y are presented by <strong>the</strong> accused’s relatives.<br />
For indeed, <strong>the</strong>re are instances when <strong>the</strong>re would be no one else who could be<br />
presented in court o<strong>the</strong>r than <strong>the</strong> accused’s relatives. The fact alone that <strong>the</strong> defense <strong>of</strong><br />
alibi is buttressed by a relative, while it renders <strong>the</strong> testimony suspect, does not<br />
instantaneously and automatically discredit <strong>the</strong> testimony given. It is not <strong>the</strong> relationship<br />
per se <strong>of</strong> <strong>the</strong> witness with <strong>the</strong> accused that renders <strong>the</strong> testimony suspect, ra<strong>the</strong>r, it should<br />
be <strong>the</strong> content and <strong>the</strong> nature <strong>of</strong> <strong>the</strong> story related in court that makes it suspect <strong>of</strong> having<br />
been concocted to get a relative <strong>of</strong>f <strong>the</strong> hook.<br />
In this case, Jonas Ayhon’s testimony that his wife Dorothy gave birth and was<br />
confined at <strong>the</strong> Fabella Hospital where he and accused Augusto Santos fetched <strong>the</strong>m on<br />
