Testimonies <strong>of</strong> <strong>the</strong> witnesses presented by <strong>the</strong> prosecution, notably P/Insp.<br />
Rogelio Castillo and SPO2 Jose Garcia, Jr. do not tie up on material details pertaining to<br />
<strong>the</strong> alleged taking <strong>of</strong> Joel de Jesus’ purported extra-judicial confessions.<br />
Rogelio Castillo said that <strong>the</strong>y went to <strong>the</strong> City Hall Compound at around 1:00<br />
p.m. on June 20, 1996 to look for a lawyer who could assist Joel de Jesus in <strong>the</strong> execution<br />
<strong>of</strong> <strong>the</strong> latter’s extra-judicial confession. Castillo testified that his men scouted for lawyers<br />
and he was left at <strong>the</strong> lobby. (TSN, August 15, 1996, p. 130). SPO2 Jose Garcia, on <strong>the</strong><br />
o<strong>the</strong>r hand, testified that when <strong>the</strong>y arrived at <strong>the</strong> City Hall, it was Lt. Rogelio Castillo<br />
and ano<strong>the</strong>r investigator who went to <strong>the</strong> second floor to look for a lawyer. (TSN,<br />
September 25, 1996, pp. 63-66). And that he, toge<strong>the</strong>r with Joel de Jesus and SPO1<br />
Nicanor was left at <strong>the</strong> lobby. (ibid., p. 76).<br />
These witnesses also testified that <strong>the</strong>y arrived at <strong>the</strong> City Hall Compound at<br />
about 1:00 p.m. (TSN, August 15, 1996, p. 129), that <strong>the</strong>y had to scout for lawyers for<br />
about 15-20 minutes according to Castillo (TSN, August 15, 1996, p. 130) while<br />
according to Garcia it took <strong>the</strong>m about 25-30 minutes to look for a lawyer (TSN,<br />
September 25, pp. 64-65), that when <strong>the</strong>y arrived at <strong>the</strong> IBP Office, Atty. Confesor<br />
Sansano was not yet around so <strong>the</strong>y had to wait for ano<strong>the</strong>r 5-7 minutes according to<br />
Garcia (TSN, October 1, 1996, p. 46) while according to Castillo <strong>the</strong>y had to wait for<br />
about 15-20 minutes (TSN, August 15, 1996, p. 135), that Atty. Sansano talked with Joel<br />
de Jesus for about five minutes according to Garcia (September 25, 1996, p. 127) while<br />
Castillo testified that Atty. Sansano conferred with Joel for about 30 minutes (TSN,<br />
August 15, 1996, p. 149).<br />
Comparing <strong>the</strong> testimonies <strong>of</strong> Castillo and Garcia as to <strong>the</strong> time elapsed for each<br />
<strong>of</strong> <strong>the</strong> significant details <strong>the</strong>y testified to we get <strong>the</strong> following:<br />
