Atty. Sansano contain very glaring indicators that will engender a well-founded belief<br />

that <strong>the</strong>se statements were not a recorded face-to-face question and answer between a<br />

police investigator and a suspect. For if <strong>the</strong>se are indeed a result <strong>of</strong> a face-to-face<br />

questioning, <strong>the</strong> natural flow would be to ask a particular fact, one at a time.<br />

T: Ano naman ang iyong pangalan, edad, at iba (sic) bagay ukol<br />

sa iyong tunay na pagkatao?<br />

S: Ikaw JOEL DE JESUS y VALDEZ, alias “TABONG”, 22<br />

taong gulang, may-asawa, tricycle driver, tubong Banga<br />

The use <strong>of</strong> “Ikaw” instead <strong>of</strong> “ako,” while it might have been a typographical<br />

error, is a serious slip which points that it was ano<strong>the</strong>r person and not Joel de Jesus who<br />

supplied and related <strong>the</strong> facts written. A person who is asked his name would simply give<br />

his name without his alias. And it would be unnatural for a person to reveal his address,<br />

and in this instance, his provincial and city addresses, without being specifically asked<br />

about <strong>the</strong>m. “Iba pang bagay tungkol sa iyong pagkatao” is too general a formulation to<br />

elicit an address from a person.<br />

T: May kilala ka bang isang tricycle driver na nagngangalang<br />

“TABONG” na taga-Fairview?<br />

S: Ako po iyon sir.<br />

T: Kaninong motor naman ang ginagamit mo sa pamamasada?<br />

S: Sa Ate ko po (Rosalinda de Jesus)<br />

T: Anong klaseng motor ito?<br />

S: KAWASAKI Plate No. PJ-4478.<br />

These o<strong>the</strong>r supposed answers also give out o<strong>the</strong>r details not called for by <strong>the</strong><br />

question. When asked about <strong>the</strong> type <strong>of</strong> motorcycle, <strong>the</strong> natural answer would only be<br />

Kawasaki. But here it appears that <strong>the</strong> witness volunteered <strong>the</strong> Plate Number. It would<br />

have been believable if <strong>the</strong> questioning went in such a way as to elicit <strong>the</strong>se data one at a<br />

time for that is <strong>the</strong> natural flow <strong>of</strong> a custodial interrogation. And it goes against <strong>the</strong><br />

natural attitude <strong>of</strong> persons, especially those being interrogated, to answer only what is<br />

being asked or to even withhold information.<br />
