charged with <strong>the</strong>ft. This belies <strong>the</strong> conspiracy <strong>the</strong>ory in <strong>the</strong> judgment <strong>of</strong> conviction for<br />
murder. On <strong>the</strong> o<strong>the</strong>r hand, if we must be consistent and logical about conspiracy, <strong>the</strong>n<br />
<strong>the</strong> dismissal <strong>of</strong> <strong>the</strong> <strong>the</strong>ft conspiracy case should also mean <strong>the</strong> dismissal <strong>of</strong> <strong>the</strong> murder<br />
conspiracy case because, as we said, <strong>the</strong> murderers were also <strong>the</strong> thieves. And <strong>the</strong>refore<br />
<strong>the</strong> turn-over <strong>of</strong> Abadilla’s stolen Omega gold-plated wrist-watch by an ABB personality<br />
to Fr. Reyes shows not only who were <strong>the</strong> thieves but also who were <strong>the</strong> murderers.<br />
Then take <strong>the</strong> dismissals <strong>of</strong> <strong>the</strong> three illegal possession <strong>of</strong> firearms cases against<br />
Lorenzo delos Santos (Crim. Case No. Q-96-66680), SPO2 Cesar Fortuna (Crim. Case<br />
No. Q-96-66682), and Rameses de Jesus (Crim. Case No. Q-96-66683). In any case,<br />
none <strong>of</strong> <strong>the</strong> three cal. .38 revolvers recovered as “illegally possessed firearms” from <strong>the</strong>se<br />
three accused were used for <strong>the</strong> murder <strong>of</strong> Abadilla, as ballistics evidence shows that cal.<br />
.45 and 9 mm. pistols were used. Nei<strong>the</strong>r were any <strong>of</strong> <strong>the</strong> three recovered cal. .38 cal.<br />
revolvers <strong>the</strong> pistol stolen from <strong>the</strong> slain Abadilla which was a cal. .45 pistol. All told,<br />
<strong>the</strong>se dismissals and facts should even reinforce and streng<strong>the</strong>n <strong>the</strong> defenses and<br />
innocence <strong>of</strong> all <strong>the</strong> accused-appellants.<br />
In <strong>the</strong> end, <strong>the</strong> defense should not be begrudged <strong>the</strong> pr<strong>of</strong>fer <strong>of</strong> all defenses<br />
possible for acquittal <strong>of</strong> all <strong>the</strong> accused-appellants not just on reasonable doubt <strong>of</strong> guilt<br />
but on pro<strong>of</strong> <strong>of</strong> innocence beyond reasonable doubt.<br />
