Administration and CommunityServicesAttachment 11. City of Bayswater Feedback forProposed Domestic Cat LegislationProposal for Domestic Cat Legislation 19 July 2010Page 1 of 7CITY OF BAYSWATERFEEDBACK INFORMATIONPROPOSED CAT LEGISLATION CONSULTATION PAPERPlease note: question numbers allocated from Feedback Paper.2. What identification methods do you support?Microchipping - YesTags and Collars – YesRationale:Microchipping is a method of identification that provides for life long identification of animals.Microchipping should only be supported if there is a standard chip type that is used throughout theState.3. When should compulsory identification be introduced? To all cats on introduction of the legislation including microchipping and Tags and Collars. This could be phased in over a 6 month period.Rationale:By differentiating between animals already alive and yet to be born, it would provide an increasedproof required by any investigating officer. Evidence would need to be obtained that established theage of the cat that would not apply if all cats were required to be identified. This effect could last forsome 15 – 20 years after the introduction of the legislation.Microchipping is a method of identification that provides for life long identification of animals.Microchipping should only be supported if there is a standard chip type that is used throughout theState.4. At what age should identification be required?3 Months.Rationale:This will provide that the Cat and Dog Act would require the registration of animals after the age ofthree months. This would reduce the risk of mixed messages in the community.5. Are there any other quantifiable costs and benefits associated with identification (microchipping, collars and tags),The costs associated with dogs currently impounded after being left abandoned is considerablein any community. By requiring the compulsory microchipping and registration tags reducesthe likelihood of an animal being abandoned.

Administration and CommunityServicesAttachment 1Proposal for Domestic Cat Legislation 19 July 2010Page 2 of 71. City of Bayswater Feedback forProposed Domestic Cat LegislationAnd; will these proposals achieve the policy objectives?YesRationale:When animals are currently impounded an owner may choose to leave the animal to be destroyedbased on costs and penalties for any alleged offences relating to the animal. Compulsorymicrochipping would ensure that all owners of the cats collected may be identified through themicrochip. The policy objective is to reduce the number of cats being euthanaised. This should achieve thatdesired outcome.6. Is the existence of multiple microchip databases likely to cause a problem, and how can this beovercome? The current process for dog registrations requires that each Council hold a separate DogRegister. This is problematic when dogs are found, collected in another jurisdiction. Althoughnot significant, this problem could be overcome by providing regulations for the sharing of thisinformation, similar to the provisions of section 14(4) of the Dog Act 1976.Rationale:A Cat register maintained by the Local Authority would ensure that any revenue collected is directlyproportional to the number of domestic cats living in the district and the level of enforcement of thelegislation.7. Any other commentsThe City of Bayswater supports the introduction of Cat legislation subject to the State Governmentaddressing the issues raised.8. Do you support compulsory cat registration?YesRationale:Compulsory registration of cats would place a responsibility on the cat owner to comply withcommunity expectations relating to cat ownership. In the event cats are found abandoned, registrationwould reduce the number of cat owners denying ownership. Cat registrations would be required in theevent Cat legislation is introduced in order to fund the administration of the legislation.10. How long should the registration period be? (Can choose more than one)1 year or 3 years.Rationale:The registration process for cats and dogs could be combined. By ensuring that the process and feesare similar would mean that the community receives similar messages when registering both cats anddogs.

Administration and CommunityServicesAttachment 1Proposal for Domestic Cat Legislation 19 July 2010Page 3 of 71. City of Bayswater Feedback forProposed Domestic Cat Legislation11. What is an appropriate registration fee for sterilised and unsterilised cats? The registration fees for cats and dogs should be the same.• Unsterilised Dog - 1 Year Registration $30.00• Unsterilised Dog - 3 Year Registration $75.00• Sterilised Dog - 1 Year Registration $10.00• Sterilised Dog - 3 Year Registration $18.00Rationale:The registration process and fees for cats and dogs could be combined. By ensuring that the processand fees are similar would mean that the community receives similar messages when registering bothcats and dogs.12. Should registration discounts be offered, and for what purpose?By using a similar fee structure to the Dog Act 1976 it would provide incentive for cat owners tosterilise cats.Rationale:By ensuring that the process and fees are similar would mean that the community receives similarmessages when registering both cats and dogs. The current fee structure for dog registrations doesprovide incentive for dog sterilisation. The number of dog owners that delay the registration of theirdogs until after the dog has been sterilised can demonstrates this.13. Is the existence of multiple registration databases likely to cause a problem, and how can this beovercome? No significant problems identifiedRationale:There are no significant issues relating to the management of local dog registration databases. Thereare some timing issues created when Authorised Officers investigating incidents are attempting toobtain ownership details from other Local Authorities.Consideration should be given to adoption of similar Inspection of Register rights as set out in Section14(4) of the Dog Act 1976.14. Are there any other quantifiable costs and benefits associated with registration, and will thisproposal achieve the policy objective?None identified.

Administration and CommunityServicesAttachment 11. City of Bayswater Feedback forProposed Domestic Cat LegislationRationale:Proposal for Domestic Cat Legislation 19 July 2010Page 4 of 7The benefits provided by reducing the number of abandoned cats would reduce the impact on theenvironment and financial burdens placed on cat welfare agencies. The City does not have any dataavailable to quantify any potential savings.15. Any other comments?Seizure and ImpoundingThe consultation paper is silent on the methods of capture and maintenance of animals onceseized and detained. The City of Bayswater would suggest that provision be included by way of Cat Regulations, setting out prescribed methods of capture and capture devices.MicrochippingMicrochipping is a method of identification that is becoming popular with pet owners. Iflegislation provided for the registration and microchipping of cats, the City of Bayswater wouldrecommend that the legislation include specifications for a standard type of microchip for usewithin the State. This could be done through a tender process that would also ensurecompetition for the supply of microchips.Alignment with the Dog Act 1976As outlined in previous answers the City of Bayswater would recommend alignment betweenCat Legislation and the Dog Act 1976. The purpose of this alignment would be for communitybenefit in understanding registration process, periods, fees and charges.Education CampaignsThe consultation paper provides options for community education. What type of education isproposed and who would be responsible for the development and funding of any educationcampaigns?IncentivesThe consultation paper provides options for incentives. What type of education is proposed andwho would be responsible for the development and funding of incentive programs?16. Do you support compulsory sterilisation?NoRationale:The decision to sterilise a cat should lie with the Cat owner. One objective of the legislation is toencourage responsible cat ownership. Providing for mandatory sterilisation of cats removes thedecision relating to sterilisation from the cat owner.

Administration and CommunityServicesAttachment 1Proposal for Domestic Cat Legislation 19 July 2010Page 5 of 71. City of Bayswater Feedback forProposed Domestic Cat Legislation17. When should compulsory sterilisation be required?Applicable to answer 16.18. Administration and CommunityServicesAttachment 1Proposal for Domestic Cat Legislation 19 July 2010Page 6 of 71. City of Bayswater Feedback forProposed Domestic Cat Legislation23. Are there any other options that could be undertaken to reduce the number of cats that are semiowned, including any known costs for such measures?Nil24. What are the major complaints about cats, and will these legislative provisions resolve them? The main source of complaint received are wandering cats and the noise they create duringmating season. Other impacts are addressed in the discussion paper.25 - 26. Local governments, particularly those which have cat local laws, are specifically requested toprovide detail on the following matters (if known). The City does not have Local Laws relating to Cats. There is insufficient information toestablish costs of administration of the proposed cat legislation.27. Will local governments, particularly those without cat local laws, enforce the proposed provisions? Please include a reason for the response? The City of Bayswater would consider the enforcement of the proposed cat legislation.Anecdotal evidence indicates that there is a community expectation for Local Government tomanage cat issues in the community.28. What are the practical issues local governments see relating to enforcement of this cat legislation?a) Use of Cat Traps and the welfare implications use of traps provide.Rationale:Local Governments that currently seize and impound cats, unlike dogs, use cat traps as the primarymethod of capture.Advice received from a Western Australian animal welfare agency is that the use of traps for catsendorsed by that agency. The City would seek that the legislation includes prescribed methods of capture and capture devices.b) The costs associated with administration of the legislation and the costs associated witheducation.

Administration and CommunityServicesAttachment 11. City of Bayswater Feedback forProposed Domestic Cat LegislationRationale:Proposal for Domestic Cat Legislation 19 July 2010Page 7 of 7Most Local Governments administer dog legislation at a considerable cost to the community. Thesecosts are only normally partially funded through dog registrations.29. Once legislation is introduced, how long would it take for a local government to be able tocommence administering and enforcing the provisions? There is currently insufficient information to provide an informed response to this question.Once a Bill is provided that provides details of the proposed registration fees and charges, theCity will be in a better position to analyse the cost implications.
