ScopeThese regulations apply to all Hotels, Motels, Resorts, Dormitories <strong>and</strong> furnished apartments.2. Third: Regulat<strong>in</strong>g <strong>smok<strong>in</strong>g</strong> <strong>in</strong>Restaurants <strong>and</strong> cafesEffective "18/11/2007" Scope:The follow<strong>in</strong>g regulations apply to the restaurants <strong>and</strong> cafes that allow/ permit Smok<strong>in</strong>g1. D<strong>in</strong><strong>in</strong>g hall must not be less than 1000 square feet2. Smok<strong>in</strong>g areas must be designated <strong>and</strong> marked as <strong>smok<strong>in</strong>g</strong> area dedicated forsmokers only <strong>and</strong> with the follow<strong>in</strong>g requirement <strong>and</strong> conditions as below:A dedicated <strong>in</strong>door area that is totally isolated from all non-<strong>smok<strong>in</strong>g</strong> areas by walls fromfloor to ceil<strong>in</strong>g.Room can be no larger than 50% <strong>of</strong> total <strong>in</strong>door d<strong>in</strong><strong>in</strong>g areaA designated <strong>smok<strong>in</strong>g</strong> area may not <strong>in</strong>clude any wait<strong>in</strong>g area lobby, hall way, elevator,area adjacent to a self-service food l<strong>in</strong>e or cash register, <strong>and</strong> such areas shall also beexcluded from the calculation <strong>of</strong> the square footage <strong>of</strong> the floor areaRoom must be equipped with self-clos<strong>in</strong>g door(s) that is equipped with an alarm that will beactivated if the door rema<strong>in</strong>s open for more than 60 seconds.Occupant density shall be not higher than acceptable limit (1person /20 feet square)Where <strong>smok<strong>in</strong>g</strong> is prohibited a sign us<strong>in</strong>g the <strong>in</strong>ternational "No Smok<strong>in</strong>g" symbol shall beposted <strong>in</strong> a position clearly visible on entry to the designated <strong>smok<strong>in</strong>g</strong> area.Room must not <strong>in</strong>clude any services needed by other than smokers. This requirement<strong>in</strong>cludes, without limitation, <strong>public</strong> telephone, means <strong>of</strong> enterta<strong>in</strong>ment <strong>and</strong> games…Room must be located so no employee or other person needs to enter the room to accessany item or other area such as the toilet rooms, kitchens, entrances, d<strong>in</strong><strong>in</strong>g rooms…3- Ventilation <strong>and</strong> air condition<strong>in</strong>g systems requirements.Design<strong>in</strong>g <strong>of</strong> Smok<strong>in</strong>g area should meets all <strong>of</strong> the follow<strong>in</strong>g criteria:Ma<strong>in</strong>ta<strong>in</strong> <strong>smok<strong>in</strong>g</strong> area depressurized relative to the adjo<strong>in</strong><strong>in</strong>g non <strong>smok<strong>in</strong>g</strong> areas. Thepressure differential must be between -5 to -7 Pascal which is equivalent to (-0.02 to -0.03<strong>in</strong>.w.c.).Supply air provided to the area must be not less than 60 cfm. For each person (design<strong>in</strong>gmust be based on the maximum occupant density).Air from the room must be mechanically exhausted to the outside <strong>and</strong> no air from room canbe re-circulated to non <strong>smok<strong>in</strong>g</strong> area by air condition<strong>in</strong>g <strong>and</strong> ventilation system. Themechanical exhaust system must be on at all <strong>work</strong><strong>in</strong>g time to create negative pressurewith<strong>in</strong> the room <strong>and</strong> the negative pressure must be ma<strong>in</strong>ta<strong>in</strong>ed while door(s) to the room isopen.<strong>Regulation</strong> <strong>of</strong> <strong>smok<strong>in</strong>g</strong> <strong>in</strong> <strong>public</strong> <strong>and</strong> <strong>work</strong> <strong>places</strong>4/12


Fifth: Shisha Places <strong>Regulation</strong>sEffective "18/11/2007" Scope:1. These conditions are applied to all permitted Shisha cafes <strong>and</strong> restaurants.2. These conditions are effective from 2007 - 2008, <strong>and</strong> will be reviewed <strong>and</strong> updated <strong>in</strong>20093. These conditions will be implemented to all permitted cafes <strong>and</strong> restaurants that serveshisha after the approval <strong>of</strong> these conditions.4. Shisha cafes that are permitted to serve shisha <strong>in</strong> their trade license are given maximumone year to rectify their position.5. Restaurants that serve shisha are given a period until their permit is expired to rectify theirposition.First: Shisha Cafes Plann<strong>in</strong>g Conditions1. Shisha cafes are only permitted <strong>in</strong> the areas classed as commercial, commercialresidential or tourist attraction area.2. Must be located on the ground floor only, except hotels.3. Must be at least 25 feet away from the entrances or exits <strong>of</strong> the build<strong>in</strong>g.4. Must be at least 200 meter away from schools, mosques, education establishments <strong>and</strong>tra<strong>in</strong><strong>in</strong>g centers.5. Must be with<strong>in</strong> a build<strong>in</strong>g located near park<strong>in</strong>g or <strong>in</strong> such areas where park<strong>in</strong>g is at easyaccess. Licens<strong>in</strong>g requirements1. All shisha <strong>places</strong> must be licensed from the Economic development department as shisha(Cafe)2. The total floor area must be not less than 2000 square feet3. Obta<strong>in</strong> an approval from Plann<strong>in</strong>g Department / Dubai Municipality <strong>in</strong>dicat<strong>in</strong>g the area.(Area must not be amended or changed only after tak<strong>in</strong>g the approval from the Plann<strong>in</strong>gDepartment).4. Obta<strong>in</strong> the approval from Build<strong>in</strong>gs Department /Dubai Municipality for the <strong>in</strong>terior design<strong>and</strong> decoration.5. A permit must be obta<strong>in</strong>ed from the Cl<strong>in</strong>ic <strong>and</strong> community Health Section/ Public HealthDepartment. [This permit would express the conditions <strong>and</strong> regulations <strong>of</strong> ventilation <strong>and</strong>air condition<strong>in</strong>g systems), commitments to <strong>work</strong><strong>in</strong>g hours also required (from 9 AM-1.00after midnight)].<strong>Regulation</strong> <strong>of</strong> <strong>smok<strong>in</strong>g</strong> <strong>in</strong> <strong>public</strong> <strong>and</strong> <strong>work</strong> <strong>places</strong>8/12


Health & Safety conditions1. Area must be equipped with self-clos<strong>in</strong>g door/s that is equipped with an alarm that will beactivated if the door rema<strong>in</strong>s open for more than 60 second. It must be kept closed all thetime except upon enter<strong>in</strong>g <strong>and</strong> exit<strong>in</strong>g.2. Occupant density shall be not higher than acceptable limit (1person /20 feet square).3. shisha preparation area requirements:3.1 Provide an area <strong>of</strong> at least 50 square feet for clean<strong>in</strong>g <strong>and</strong> prepar<strong>in</strong>g <strong>of</strong> shisha .3.2 Provide a sta<strong>in</strong>less steel table for shisha preparation.3.3 Provide a separate shisha wash<strong>in</strong>g bas<strong>in</strong> (s<strong>in</strong>k) for wash<strong>in</strong>g shishas only.3.4 Coal preparation area (platform) must be provided with mechanical exhaust systemto expel polluted air outside the premises directly.3.5 Shisha Smok<strong>in</strong>g area must be separated from the preparation <strong>of</strong> shishapreparation/ tea or c<strong>of</strong>fee <strong>and</strong> others preparation areas.4. Ventilation <strong>and</strong> air condition<strong>in</strong>g systems requirements.(Design<strong>in</strong>g <strong>of</strong> Smok<strong>in</strong>g area should meets all <strong>of</strong> the follow<strong>in</strong>g criteria):4.1 Ma<strong>in</strong>ta<strong>in</strong> <strong>smok<strong>in</strong>g</strong> area depressurized relative to the adjo<strong>in</strong><strong>in</strong>g non <strong>smok<strong>in</strong>g</strong> areas.The pressure differential must be between -5 to -7 Pascal which is equivalent to (-0.02 to -0.03 <strong>in</strong>.w.c.).4.2 Supply air provided to the area must be not less than 60 cfm. For each person(design<strong>in</strong>g must be based on the maximum occupant density).4.3 Air from the room must be mechanically exhausted to the outside <strong>and</strong> no air fromroom can be re-circulated to non <strong>smok<strong>in</strong>g</strong> area by air condition<strong>in</strong>g <strong>and</strong> ventilationsystem. The mechanical exhaust system must be on at all <strong>work</strong><strong>in</strong>g time to createnegative pressure with<strong>in</strong> the room <strong>and</strong> the negative pressure must be ma<strong>in</strong>ta<strong>in</strong>edwhile door(s) to the room is open.4.4 Exhausted air must be a m<strong>in</strong>imum separation distance not less than 25 feet fromthe entrances or exits <strong>of</strong> the build<strong>in</strong>g, w<strong>in</strong>dows <strong>and</strong> the fresh air <strong>in</strong>take <strong>of</strong> theventilation <strong>and</strong> air condition<strong>in</strong>g system.4.5 Ventilation <strong>and</strong> air condition<strong>in</strong>g system for smokers must be separated from othersystems. The air shall not be re-circulated with adjacent no <strong>smok<strong>in</strong>g</strong> areas.5. Must use Disposable mouth pieces only.6. Must provide one toilet <strong>and</strong> external h<strong>and</strong> wash bas<strong>in</strong> for ladies <strong>and</strong> another for Gents.7. A warn<strong>in</strong>g sign shall be posted on the shop entrance <strong>in</strong>dicate that no person under 20years <strong>of</strong> age is allowed to enter the place or permitted <strong>in</strong> the area.8. No shisha take away services is allowed, that is no shisha to be delivered to the cars orhomes or <strong>of</strong>fices or others.9. All employees with<strong>in</strong> the shisha place should possess valid occupational health card.<strong>Regulation</strong> <strong>of</strong> <strong>smok<strong>in</strong>g</strong> <strong>in</strong> <strong>public</strong> <strong>and</strong> <strong>work</strong> <strong>places</strong>9/12


Safety <strong>Regulation</strong>s1. Provide a first aid box.2. Safety requirements must be provided <strong>and</strong> fire ext<strong>in</strong>guishers should be <strong>in</strong>stalled <strong>in</strong>approved location <strong>and</strong> <strong>in</strong> adjacent to the area where the coals are prepared.3. Coal must be stored <strong>in</strong> safe <strong>places</strong> away from flammable materials4. Hot coal/charcoal must be placed <strong>in</strong> a safe non combustible conta<strong>in</strong>er made <strong>of</strong> ceramic ormetal <strong>and</strong> kept at a distant not less than 10 feet away from any combustible material .Theconta<strong>in</strong>er shall be labeled "Hot Coals only”.5. All combustible decorative materials shall be flame resistance. This <strong>in</strong>cludes curta<strong>in</strong>s, tablecloths <strong>and</strong> all materials hanged from ceil<strong>in</strong>gs <strong>and</strong>/ or wall. All textile <strong>and</strong> film materials shallbe treated <strong>and</strong> ma<strong>in</strong>ta<strong>in</strong>ed flame resistance. Floor<strong>in</strong>g should not be covered withcombustible materials or difficult to be cleaned materials.6. If the occupant load <strong>of</strong> the lounge is 50 or more then requirements for assemblyoccupancies shall <strong>in</strong>clude a second exit <strong>and</strong> illum<strong>in</strong>ated exit signs.7. Shisha <strong>places</strong> shall not cause any disturbances or nuisance to the build<strong>in</strong>g occupants,traffic, neighbor hood <strong>and</strong> <strong>public</strong> park<strong>in</strong>g areas.Second: The Restaurants Licens<strong>in</strong>g requirementsMust be licensed from the Economic development department as Restaurant.The total d<strong>in</strong><strong>in</strong>g area must be not less than 1000 square feet.Obta<strong>in</strong> an approval from Plann<strong>in</strong>g Department / Dubai Municipality <strong>in</strong>dicat<strong>in</strong>g the area.(Area must not be amended or changed only after tak<strong>in</strong>g the approval from the Plann<strong>in</strong>g).Obta<strong>in</strong> the approval from Build<strong>in</strong>gs Department /Dubai Municipality for the <strong>in</strong>terior design<strong>and</strong> decoration.A permit must be obta<strong>in</strong>ed from the Cl<strong>in</strong>ic <strong>and</strong> the community Health Section/ Public HealthDepartment. [This permit would express the conditions <strong>and</strong> regulations <strong>of</strong> ventilation <strong>and</strong>air condition<strong>in</strong>g systems, commitments to <strong>work</strong><strong>in</strong>g hours (from 9 AM– 1.00 aftermidnights)]. Health & Safety conditionsIn addition to the conditions <strong>in</strong> shisha café the follow<strong>in</strong>g must be applied:1. A dedicated <strong>in</strong>door area that is totally isolated from all non-<strong>smok<strong>in</strong>g</strong> areas by walls fromfloor to ceil<strong>in</strong>g.2. Shisha place can be no larger than 50% <strong>of</strong> total <strong>in</strong>door d<strong>in</strong><strong>in</strong>g area <strong>and</strong> no more than 50%<strong>of</strong> outdoor area.<strong>Regulation</strong> <strong>of</strong> <strong>smok<strong>in</strong>g</strong> <strong>in</strong> <strong>public</strong> <strong>and</strong> <strong>work</strong> <strong>places</strong>10/12


Third: Us<strong>in</strong>g the pavements <strong>and</strong> outside areas for shisha <strong>smok<strong>in</strong>g</strong> Plann<strong>in</strong>g conditions1. No adjacent outdoor areas <strong>of</strong> the build<strong>in</strong>g must be used.2. No adjacent areas that are not owned by others would be used.3. No <strong>public</strong> facilities or <strong>public</strong> park<strong>in</strong>g /<strong>public</strong> services areas would be used.4. Occupied outdoor area must not exceed the front <strong>of</strong> the licensed premise.5. No temporary or permanent extensions with sheds are allowed externally.6. Changes to the external floor<strong>in</strong>gs not allowed only if permission is obta<strong>in</strong>ed. Licens<strong>in</strong>g requirements1. The c<strong>of</strong>fee shop or restaurant should be licensed from the Economic Developmentdepartment <strong>and</strong> permitted to serve shisha.2. Approval by Plann<strong>in</strong>g Department (with<strong>in</strong> the commercial <strong>and</strong> tourist attraction areas only,not allowed <strong>in</strong> residential areas).3. Approval by Roads <strong>and</strong> Transport Authority/ Park<strong>in</strong>g Department.4. Annual Permit from Cl<strong>in</strong>ic <strong>and</strong> Community Health section/ Public Health Department. Health <strong>and</strong> Safety requirementIn addition to the conditions <strong>in</strong> shisha café <strong>and</strong> restaurant the follow<strong>in</strong>g must be applied:1. The external area must not be used for coal storage or preparation, or shisha preparationor clean<strong>in</strong>g.2. Shisha cannot be displayed to advertise <strong>smok<strong>in</strong>g</strong>.3. Should not cause any <strong>in</strong>convenience to the build<strong>in</strong>g or the neighbors or the surround<strong>in</strong>garea.4. Commitment to all the requirements <strong>and</strong> regulation for pavement use <strong>and</strong> external areasfor build<strong>in</strong>g <strong>and</strong> commercial shops <strong>in</strong> the emirate <strong>of</strong> Dubai accord<strong>in</strong>g to local order No. (1)For the year 2006 <strong>and</strong> its executive by laws No. (173) for the year 2007.<strong>Regulation</strong> <strong>of</strong> <strong>smok<strong>in</strong>g</strong> <strong>in</strong> <strong>public</strong> <strong>and</strong> <strong>work</strong> <strong>places</strong>11/12
