A banning order can last for any period up to a maximum of 6 months andmay:• Ban the subject from a specified area in the vicinity of the specifiedplace• Authorise the ejection of the subject from the place or area• Prohibit the subject from moving any specified thing from the specifiedplace• Direct any specific person to take specific measures to preserve anymoveable property owned or controlled by the subject• Be made subject to specific conditions• Require or authorise any person to do, or refrain from doing, anythingelse which the sheriff thinks necessary for the proper enforcement ofthe order.Application for a temporary banning order may be made where it isinadvisable to wait for a full hearing on a banning order application. Atemporary banning order expires on the date a banning order is made, thedate on which it is recalled or any specified expiry date.A condition specified in a banning order may authorise the subject of the orderto be allowed into the place they are banned from for specific reasons, forexample, supervised contact.The sheriff may attach a power of arrest to the banning or temporary banningorder if there is a likelihood of the subject breaching the conditions of theorder. The power of arrest becomes effective only when served on the subjectof the order and will expire at the same time as the order.41
