outlines both the <strong>Shire</strong> <strong>of</strong> <strong>Yarra</strong> <strong>Ranges</strong>, and Melbourne Water’s roles andobligations with respect to flooding.Melbourne Water is the Regional Drainage and <strong>Flood</strong>plain <strong>Management</strong>Authority for the Port Phillip and Westernport Region. Consequently,Melbourne Water is responsible for the provision and maintenance <strong>of</strong> maindrains, the management <strong>of</strong> stormwater overflows from its drainage systemand inundation from rivers and creeks within the <strong>Yarra</strong> <strong>Ranges</strong> <strong>Shire</strong>.Responsibility for managing local stormwater and flooding issues rests withCouncils; however this has not been explicitly defined by Government. Theoperational and authoritative roles <strong>of</strong> Councils are absent from the Water Actand the <strong>Plan</strong>ning and Environment Act.The Local Government Act, 1989, prescribes the function <strong>of</strong> council is toprovide and maintain community infrastructure. All sub 60 hectare drainageand local roads (commonly major overland flow paths) are generally theresponsibility <strong>of</strong> Council. As such Council are involved in the maintenance,development, and design <strong>of</strong> flood conveyance measures. Changes need to bemade to the legislation with councils being provided with legislative powers forthese responsibilities.Legislative responsibilities for a range <strong>of</strong> relevant areas are shown below.• <strong>Flood</strong>plain Manager – Melbourne Water• Asset Managers – Melbourne Water and Council (traditionallycatchments greater than 60ha are Melbourne Water’sresponsibility however this may not always be the case)• <strong>Plan</strong>ning Authority – Council• Emergency <strong>Management</strong> – VICSES• Community <strong>Flood</strong> Education – VICSESFigure 1 displays primary and secondary responsibilities <strong>of</strong> agencies involvedin flood management.
