The Tri<strong>al</strong> Chamber has received evidence from P<strong>et</strong>er Marti that on 26 August1995 in Popovići, two houses were compl<strong>et</strong>ely burnt, two houses were burning, tenwere partly burnt and 37 houses had been looted. However, the evidence does notestablish when, by whom, or the circumstances under which these houses were s<strong>et</strong><strong>al</strong>ight, nor wh<strong>et</strong>her, when, or by whom items were taken from these houses. Thereferences cited by the Prosecution in Annex A, page 44 of its Fin<strong>al</strong> Brief in support ofHV troop presence in Popovići haml<strong>et</strong> on 26 August 1995, does not assist the Tri<strong>al</strong>Chamber in this regard as these exhibits either refer to a different date, or places HVtroops in locations other than Popovići or its surroundings on 26 August 1995. Underthese circumstances, the Tri<strong>al</strong> Chamber will not further consider this incident in relationto Counts 1, 4 and 5 of the Indictment.1069. The evidence further indicates that on 3 September 1995, persons referred to assoldiers looted in Popovići haml<strong>et</strong>, which the Tri<strong>al</strong> Chamber understands to mean theytook unspecified items away. Given Mauro’s description of these persons as soldiers,the Tri<strong>al</strong> Chamber is satisfied that they wore military-type uniforms. However, the Tri<strong>al</strong>Chamber has received no other reliable evidence about which armed forces, if any, the<strong>al</strong>leged perp<strong>et</strong>rators belonged to, nor any evidence regarding which armed forces, ifany, were present in or in the vicinity of Popovići at the time.Therefore, the Tri<strong>al</strong>Chamber is unable to draw any conclusions regarding the identity or affiliation of the<strong>al</strong>leged perp<strong>et</strong>rators. Under these circumstances, the Tri<strong>al</strong> Chamber will not furtherconsider this incident in relation to Counts 1 and 4 of the Indictment.Ramljane1070.
