38808Chamber further finds that based on the Serb uniforms found in the house, the housewas owned or inhabited by (a) Serb(s).959. In relation to the incident in Plavno on 10 September 1995, the Tri<strong>al</strong> Chamberfinds that four persons referred to as armed soldiers entered houses and loaded amilitary truck with furniture. Based on the witness’s description of these persons assoldiers, the Tri<strong>al</strong> Chamber is satisfied they wore military-type uniforms. Consideringthe persons’ behaviour of entering houses and the fact that they had a military truck, theTri<strong>al</strong> Chamber finds that the perp<strong>et</strong>rators were members of armed forces. Furtherconsidering that Croatian persons in military-type uniforms were in Zorići haml<strong>et</strong> inPlavno on 10 September 1995, 3773 the Tri<strong>al</strong> Chamber finds that the perp<strong>et</strong>rators weremembers of Croatian military forces or Speci<strong>al</strong> Police. Considering the <strong>et</strong>hniccomposition of Plavno in 1991 and Jovan Grubor’s evidence on the amount of Serbfamilies in Plavno, the Tri<strong>al</strong> Chamber finds that the vast majority, if not <strong>al</strong>l, of thefurniture taken was owned by Krajina Serbs.960. The Tri<strong>al</strong> Chamber has further received evidence about <strong>al</strong>leged looting in thePlavno area on 12 or 13 September 1995. The Tri<strong>al</strong> Chamber considers that the ECMMand the HRAT report refer to the same incident. Based on the evidence received, theTri<strong>al</strong> Chamber finds that persons referred to as HV soldiers and civilians lootedunspecified items, which the Tri<strong>al</strong> Chamber understands to mean they took these itemsaway, from Zorići. Given the descriptions of some of these persons as soldiers, the Tri<strong>al</strong>Chamber is satisfied they wore military-type uniforms. Further considering that some ofthe persons drove a vehicle with HV licence plates, the Tri<strong>al</strong> Chamber finds that someof the perp<strong>et</strong>rators were members of the HV. Considering the <strong>et</strong>hnic composition ofPlavno in 1991 and Jovan Grubor’s evidence on the amount of Serb families in Plavno,the Tri<strong>al</strong> Chamber finds that the vast majority, if not <strong>al</strong>l, of the items taken was ownedby Krajina Serbs. The Tri<strong>al</strong> Chamber will further consider the incidents of 10 and 12 or13 September 1995 in Plavno in relation to Counts 1, 4, and 5 of the Indictment inchapters 5.5.2, 5.6.2, and 5.8.2 (f) and (g) below.961.
