38811basis for the qu<strong>al</strong>ification of the <strong>al</strong>leged perp<strong>et</strong>rators as belonging to the HV.Consequently, the Tri<strong>al</strong> Chamber cannot assess wh<strong>et</strong>her this qu<strong>al</strong>ification was made ona proper factu<strong>al</strong> basis. The Tri<strong>al</strong> Chamber has received no other reliable evidence aboutwhich armed forces, if any, the <strong>al</strong>leged perp<strong>et</strong>rators belonged to. Nor has the Tri<strong>al</strong>Chamber received sufficient evidence about which armed forces, if any, were present inor in the vicinity of Torbice at the time. The Tri<strong>al</strong> Chamber is therefore unable to drawany conclusions regarding the identity or affiliation of the <strong>al</strong>leged perp<strong>et</strong>rators.951. Furthermore, the Tri<strong>al</strong> Chamber has not received sufficient evidence regardingthe circumstances under which houses burnt down and items were <strong>al</strong>legedly looted inthe Plavno V<strong>al</strong>ley on 21 August and in Plavno on 24 August 1995.952. The Tri<strong>al</strong> Chamber considers Eric Hendriks’s account of destruction and <strong>al</strong>legedlooting in Plavno V<strong>al</strong>ley on 29 August 1995 to refer to the same incident described bySøren Liborius in Bašinac. The evidence indicates that persons referred to as uniformedHV soldiers s<strong>et</strong> fire to houses, shot anim<strong>al</strong>s, and looted, which the Tri<strong>al</strong> Chamberunderstands to mean they took unspecified items away. While the Tri<strong>al</strong> Chamber issatisfied that the perp<strong>et</strong>rators wore military-type uniforms, the evidence does notprovide a factu<strong>al</strong> basis for the qu<strong>al</strong>ification of them as belonging to the HV.Consequently, the Tri<strong>al</strong> Chamber cannot assess wh<strong>et</strong>her this qu<strong>al</strong>ification was made ona proper factu<strong>al</strong> basis. The Tri<strong>al</strong> Chamber has received no other reliable evidence aboutwhich armed forces, if any, the perp<strong>et</strong>rators belonged to. Nor has the Tri<strong>al</strong> Chamberreceived sufficient evidence about which armed forces, if any, were present in or in thevicinity of the Plavno V<strong>al</strong>ley at the time. The Tri<strong>al</strong> Chamber is therefore unable to drawany conclusions regarding the identity or affiliation of the perp<strong>et</strong>rators. Under thesecircumstances, the Tri<strong>al</strong> Chamber will not further consider these incidents b<strong>et</strong>ween 15and 29 August 1995 in the Plavno V<strong>al</strong>ley in relation to Counts 1, 4, and 5 of theIndictment.953. In relation to the incident in P<strong>et</strong>rovići, the Tri<strong>al</strong> Chamber considered that theinformation relayed to Anttila by the villagers of P<strong>et</strong>rovići insufficiently establisheswhen the described events occurred. The Tri<strong>al</strong> Chamber finds that on 2 or 3 September1995, persons referred to as uniformed Croatian soldiers came in three vehicles and took20-30 sheep and other unspecified property from villagers in P<strong>et</strong>rovići haml<strong>et</strong>. Whil<strong>et</strong>he Tri<strong>al</strong> Chamber is satisfied that the perp<strong>et</strong>rators wore military-type uniforms, theevidence does not provide a factu<strong>al</strong> basis for the qu<strong>al</strong>ification of them being Croatian.504Case No.: IT-06-90-T 15 April 2011 `
