38830confiscated at check-points, along with the locations of where they were seized withinits zone of responsibility, such as Knin. 3638 The confiscated items included televisionsets, VCRs, stereos, telephones, tools, musical instruments, vehicles, weapons, etc. 3639Murray Dawes testified that he never saw military police, only HV soldiers, stoppingvehicles at check-points and confiscating such items. 3640 According to an ECMM report, the Orthodox church in Knin was undamaged and guarded by the VP on 8 August1995. 3641 Džolić testified that on 8 August 1995, three to five members of the Crime VPfrom the 72nd Battalion were attached to the Joint Knin Company. 3642904. The Trial Chamber finds, based on the evidence above, that betweenapproximately noon on 5 August 1995 and 8 August 1995 soldiers of the 4th and 7th(“Puma”) Guards Brigades of the HV took from various houses, shops and otherlocations throughout Knin, and in the immediate vicinity of Knin, huge amounts ofitems, including television sets, stereos, radios, video recorders, refrigerators, otherelectric/electronic appliances, furniture, clothes, food, bottles of alcohol, and civilianvehicles. The evidence of certain witnesses, mainly Croatian, who travelled to Knin on5, 6 or 7 August 1995 and testified that they did not witness HV soldiers perpetratingsuch acts, cannot overcome the concordant eye-witness testimonies of numerouscredible international witnesses who were stationed in or in the immediate vicinity ofKnin at the time, and whose observations are recorded in part in contemporaneousdocuments. The Trial Chamber notes some evidence suggesting that the removal ofitems was organized and might not have been done merely by individuals for theirpersonal gain. However, the Trial Chamber finds that this evidence was relativelymarginal, and does not prevail over the dominant picture of disorganization in whichitems were taken for personal gain. As for the affiliation of the perpetrators, the TrialChamber relies in particular on its finding above on the arrival in Knin of the 7th andthe 4th Guards Brigades of the HV, as well as the perpetrator identification evidence ofLiborius and Marker Hansen on 5 August 1995, Widén and Boucher on 6 August 1995,Liborius and Dangerfield on 7 August 1995, and UNMO report P112 according to3638 D868 (Report on items temporarily confiscated at check-points in the zone of responsibility of the 5thCompany of the Military Police, Sinj, 8 August 1995).3639 D868 (Report on items temporarily confiscated at check-points in the zone of responsibility of the 5thCompany of the Military Police, Sinj, 8 August 1995).3640 Murray Dawes, T. 10524-10525.3641 P806 (ECMM Knin daily report, 8 August 1995), p. 3.3642 P876 (Boško Džolić, witness statement, 20 August 2008), para. 32; Boško Džolić, T. 8961, 8989-8990, 9010.485Case No.: IT-06-90-T 15 April 2011 `
