38873witness to s<strong>et</strong> up a police office in the primary school in Kistanje. 3282 Witness 84 statedthat the police learnt that the road b<strong>et</strong>ween Knin and Šibenik which went via Kistanjeand Skradin was used extensively to transport looted goods and therefore a check-pointwas s<strong>et</strong> up on the road in Kistanje. 3283815. On 31 August 1995, at 5:25 p.m., at the Kistanje barrier check-point a VW vanwas stopped with undocumented goods. 3284 Knin VP members brought the HV memberin, who gave a statement and was <strong>al</strong>lowed to leave. On the same day, at 7:27 p.m., HVmembers were found taking items in Kistanje. The MUP l<strong>et</strong> them go before a patrolarrived. 3285 On 2 September 1995, at 12:15 p.m., MUP officers stopped two soldierstransporting items without papers; a patrol was sent. 3286 On 3 September 1995, at 2:10p.m. the VP reported from the ground that at the Kistanje roadblock, HV soldiers werestopped with stolen goods. After this, a patrol brought the HV soldiers in, handed themover to a crime inspector, after this they were released. 3287816. As s<strong>et</strong> out above, the Tri<strong>al</strong> Chamber has received much evidence on the <strong>al</strong>legeddestruction and plunder in Kistanje in August and September 1995. First, the Tri<strong>al</strong>Chamber will turn to the events in Kistanje in the period from the beginning ofOperation Storm until and including 6 August 1995. The Tri<strong>al</strong> Chamber notes at theouts<strong>et</strong> that the evidence of certain witnesses, who were present in Kistanje on 6 August1995, like Rajčić or Perković, reported that they did not see any or only very isolatedincidents of looting or burning. The Tri<strong>al</strong> Chamber considered these accounts, and thatthey may have been influenced by ulterior motives, against the backdrop of otherconcordant accounts of eye-witnesses of different backgrounds, and ofcontemporaneous Croatian documentation, like the SIS report of 8 August 1995 (P203).817. The Tri<strong>al</strong> Chamber finds, based on Dawes’s testimony, that in Kistanje, on 6August 1995, after 10 a.m., persons referred to as HV soldiers blew up at least twohouses.
