39025disposition as described by Junjga, the Tri<strong>al</strong> Chamber finds that one or more of thesesoldiers s<strong>et</strong> the two said houses <strong>al</strong>ight. The Tri<strong>al</strong> Chamber has received no directevidence as to the <strong>et</strong>hnicity of the owners of the two houses. However, according to the1991 Population Census, the population of Uzdolje was <strong>al</strong>most entirely Serb in 1991.Considering the overwhelming Serb majority in Uzdolje and the lack of any evidence tothe contrary, the Tri<strong>al</strong> Chamber finds that Jovo Injac and Milan or Milos Šare, whoowned or inhabited the two houses, were Krajina Serbs. The Tri<strong>al</strong> Chamber will furtherconsider this incident in relation to Counts 1 and 5 of the Indictment in chapters 5.5.2and 5.8.2 (g) below. The Tri<strong>al</strong> Chamber further finds, based on the testimony of Witness67, that on 8 August 1995 three persons referred to as soldiers took a tractor and a trailerfrom Nikola Berić’s house and s<strong>et</strong> fire to the houses of Nikola Berić, Jova Berić, andSv<strong>et</strong>o Bogdanović. The Tri<strong>al</strong> Chamber rec<strong>al</strong>ls its findings above about the <strong>et</strong>hniccomposition of Uzdolje and in chapter 4.2.15 (Knin-Drniš road) and above about thepresence of Croatian military forces in the area. The Tri<strong>al</strong> Chamber will further considerthis incident in relation to Counts 1, 4, and 5 of the Indictment in chapters 5.5.2, 5.6.2,and 5.8.2 below.505. With regard to the <strong>al</strong>leged murder of Stevo Berić and others and based on theevidence received, the Tri<strong>al</strong> Chamber finds that on the morning of 6 August 1995, threemen armed with automatic rifles arrived in a white civilian car at the haml<strong>et</strong> of Šare,village of Uzdolje, in Orlić municip<strong>al</strong>ity. They <strong>al</strong>l had black hair; two of them worecamouflage uniforms, while a third one had a black handkerchief around his neck, andwore camouflage pants and a black t-shirt with a black ribbon which said “for thefatherland – ready”. The three men <strong>al</strong>l wore dark blue caps with checkerboard emblems.There, they encountered Krste Šare in front of his house with Jandrija Šare, Stevo Berić,Janja Berić, Milica Šare, ðurñija Berić, Bosiljka Berić, and another person, <strong>al</strong>l dressedin civilian clothes. One of the three armed men spotted Witness 67, and after hitting herarm with a rifle butt, he ordered her to join the others. The armed men ordered the groupto w<strong>al</strong>k towards the Knin-Drniš asph<strong>al</strong>t road, and at one point one of the three armedmen pushed Stevo Berić to the ground and tore apart his identification documents,telling him he would not need them anymore. Shortly after, one of the armed men said“l<strong>et</strong>’s finish them off, or our lamb will g<strong>et</strong> cold”. Then the group stopped about 30m<strong>et</strong>res from the road, out of sight from the vehicles transiting there. At that point, twoof the armed men w<strong>al</strong>ked away with two villagers, who were then transported to Knin in290Case No.: IT-06-90-T 15 April 2011 `
