The Tri<strong>al</strong> Chamber has received relevant evidence with regard to the <strong>al</strong>legedmurders of Dušan Borak and others primarily through the testimonies of Milan L<strong>et</strong>unicaand Bogdan Dobrić and documentary evidence, including documentation on thecrimin<strong>al</strong> investigation conducted in Croatia with regard to the <strong>al</strong>leged murders. L<strong>et</strong>unicaand Dobrić were in, or in the vicinity of, Gošić at the time of the <strong>al</strong>leged murders.282. Milan L<strong>et</strong>unica, a Serb inhabitant of the Serb village of Gošić in Kistanjemunicip<strong>al</strong>ity, 1051 stated that on 5 August 1995, upon discovering that Knin had beencaptured by the HV, he decided to hide in the forest. 1052 At approximately 4 p.m. on 27August 1995 he visited Gošić where he m<strong>et</strong> Dušan and Milka Borak at Nebojša Borak’shouse. During this time he heard a car engine and fled to the forest. En route to theforest, the witness saw a white car. The witness shortly thereafter heard gunshots forapproximately ten minutes. L<strong>et</strong>unica went through the forest to his house and saw thesame car driving <strong>al</strong>ong the road. He remained at his house for ten to fifteen minutes andm<strong>et</strong> Bogdan Dobrić there who told him that he had found people dead at the houses ofthe Boraks. The witness spent the night in the forest. On 28 August 1995, at 6 a.m., thewitness went to the village, where a policeman brought him to the houses of theBoraks. 1053 He saw a police car, a military truck, and an ambulance, and he identifiedthe bodies of Sava, Gordana, Vaso, Kosa, Marija, Dušan, and Milka Borak, and GojkoLežajić to a nurse. 1054 Persons on the scene placed the bodies in separate plastic bags,labelled them, and put them in the truck. 1055283.
