Where:K = 10 for a contract duration of one year or less, 15 for a contract duration ofmore than one year up to two years, and 20 for a contract duration ofmore than two years.The CLC must be at least equal to ten percent (10%) of the ABC for this Project. Ifissued by a foreign bank, it shall be confirmed or authenticated by a Universal orCommercial Bank. In the case of local government units (LGUs), the Bidder mayalso submit CLC from other banks certified by the Bangko Sentral ng Pilipinas(BSP) as authorized to issue such financial instrument.6. Bidder’s Responsibilities6.1. The Bidder or its duly authorized representative shall submit a sworn statementin the form prescribed in Section VIII. <strong>Bidding</strong> Forms as required in ITB Clause12.1(b)(iii).6.2. The Bidder is responsible for the following:(a)Having taken steps to carefully examine all of the <strong>Bidding</strong> <strong>Documents</strong>;(b) Having acknowledged all conditions, local or otherwise, affecting theimplementation of the contract;(c)(d)(e)(f)(g)(h)(i)(j)Having made an estimate of the facilities available and needed for the contractto be bid, if any; andHaving complied with its responsibility to inquire or secure Supplemental/BidBulletin(s) as provided under ITB Clause 10.3.Ensuring that it is not “blacklisted” or barred from bidding by the GOP or any ofits agencies, offices, corporations, or LGUs, including foreigngovernment/foreign or international financing institution whose blacklistingrules have been recognized by the GPPB;Ensuring that each of the documents submitted in satisfaction of the biddingrequirements is an authentic copy of the original, complete, and all statementsand information provided therein are true and correct;Authorizing the Head of the Procuring Entity or its duly authorizedrepresentative/s to verify all the documents submitted;Ensuring that the signatory is the duly authorized representative of the Bidder,and granted full power and authority to do, execute and perform any and allacts necessary and/or to represent the Bidder in the bidding, with the dulynotarized Secretary’s Certificate attesting to such fact, if the Bidder is acorporation, partnership, cooperative, or joint venture;Complying with the disclosure provision under Section 47 of RA 9184 in relationto other provisions of RA 3019; andComplying with existing labor laws and standards, in the case of procurementof services.Failure to observe any of the above responsibilities shall be at the risk of the Bidderconcerned.6.3. The Bidder is expected to examine all instructions, forms, terms, andspecifications in the <strong>Bidding</strong> <strong>Documents</strong>. Unless otherwise indicated in the BDS,failure to furnish all information or documentation required in the <strong>Bidding</strong><strong>Documents</strong> shall result in the rejection of the bid and the disqualification of theBidder.Page 6 of 38
