In celebration <strong>of</strong> <strong>the</strong> 120th Anniversary on 30 May 2008,thousands <strong>of</strong> passengers rode on <strong>the</strong> Peak Tram for only HK$0.30,<strong>the</strong> same fare as on <strong>the</strong> Tram’s opening day in 1888. Adding <strong>to</strong><strong>the</strong> enjoyment <strong>of</strong> this ride up and down memory lane, staff andconduc<strong>to</strong>rs <strong>of</strong> <strong>the</strong> Peak Tram were attired in Vic<strong>to</strong>rian-era uniforms<strong>to</strong> serve passengers, who also received a free newspaper dated 30May 1888, and whose tickets were validated by conduc<strong>to</strong>rs using<strong>the</strong> original, mechanical ticket bell punchers now rarely seen. <strong>The</strong>community’s response was overwhelming and <strong>the</strong> celebration was<strong>to</strong> become <strong>the</strong> talk <strong>of</strong> <strong>the</strong> <strong>to</strong>wn.Giving Back <strong>to</strong> <strong>the</strong> SocietyRealising that <strong>the</strong> success <strong>of</strong> <strong>the</strong> Peak Tram depends on <strong>the</strong>sustainable development <strong>of</strong> our society, we have provided support<strong>to</strong> many organisations in charitable causes. Methods for selecting <strong>the</strong> Chief Executive andfor Forming <strong>the</strong> Legislative Council in 2012In January this year we consulted Members on arrangements for <strong>the</strong> Transport Functional Constituency. <strong>The</strong> resultswere sent <strong>to</strong> <strong>the</strong> Government on 18th February by letter, extracts <strong>of</strong> which are copied below. Fuller results areavailable on <strong>the</strong> CILT website (login through Members’ Corner – file can be accessed at /IS-Disk/ CILTHK Disk/ CILTHKMembers' Survey on FC (2010)).Extract: Letter <strong>to</strong> <strong>the</strong> Secretary for Constitutional and Mainland AffairsWe sent 2033 questionnaires and received 502 valid responses, a 25% response rate.Analysis1. On <strong>the</strong> FC system and <strong>the</strong> Transport Seat:a. Members’ views are sharply divided on whe<strong>the</strong>r <strong>the</strong>y should be retained permanently ordisestablished (241/48% for retention, 219/44% for disestablishment, 42/8% don’t knows)b. Members who are for disestablishment strongly favour early change with 181/83% <strong>of</strong> responses infavour <strong>of</strong> disestablishment by 2016, and 134/61% in favour <strong>of</strong> disestablishment in 2012.In sum, views are divided, and those in favour <strong>of</strong> disestablishment stronglyfavour early disestablishment.2. YMC Men<strong>to</strong>rship Programme 2010YMC Men<strong>to</strong>rship Programme was kicked <strong>of</strong>f in <strong>the</strong> evening on26th February at <strong>the</strong> Hong Kong Polytechnic University in <strong>the</strong>presence <strong>of</strong> 15 Men<strong>to</strong>rs <strong>of</strong> diversified backgrounds and more than40 Mentees. Men<strong>to</strong>rs and Mentees were matched and groupedfor <strong>the</strong> first personal interactions in a joyful atmosphere. <strong>The</strong>participants looked forward <strong>to</strong> <strong>the</strong> Peng Chau Walk on 28th March(Sun)!Sharing Sessions at SecondarySchoolTwo sharing sessions at secondary schools were held on 29thJanuary and 10th February respectively by <strong>the</strong> YMC representatives.In January, Harry Poon (Vice-Executive Chair <strong>of</strong> YMC), Leo Cha andTracy Chan visited Lingnan Hang Yee Memorial Secondary Schoolat Siu Sai Wan, and presented a talk <strong>to</strong> Form 5 students on careersdevelopment and brief introduction <strong>of</strong> <strong>the</strong> industry.In February, <strong>the</strong> above 3 members, accompanied by Patrick Ip, gavea talk <strong>to</strong> those Form 4 students at Ju Ching Chu Secondary Schoolin Tin Shui Wai. <strong>The</strong>y introduced <strong>the</strong> “3+3+4 New AcademicStructure” and explained how this structure related <strong>to</strong> Logistics& Transport subjects. transport policy committeeOn 24th November 2009, <strong>the</strong> <strong>Institute</strong> responded <strong>to</strong> <strong>the</strong> publicconsultation on “Air Quality Objectives Review” (an extractwas published in <strong>the</strong> last CILTHK Newsletter). On 25th January2010, we called on Mr. Henry Tang, <strong>the</strong> Chief Secretary, and Mr.Edward Yau, <strong>the</strong> Secretary for <strong>the</strong> Environment, <strong>to</strong> elaborate ourproposals. <strong>The</strong> CILTHK representatives were Mr. Robert Footman,Chairman <strong>of</strong> TPC, Pr<strong>of</strong>. Becky Loo, Vice President, and Miss HarrietLeung.We said that <strong>the</strong> AQO review was a good opportunity <strong>to</strong> identifyand implement a comprehensive programme <strong>of</strong> initiatives <strong>to</strong>benefit Hong Kong, its people and its economy. We recognisedit had become increasingly clear that transport emissions are aserious threat <strong>to</strong> our citizens’ health. CILTHK was suggestingspecific programmes <strong>to</strong> address <strong>the</strong> issue. Self-employed Person?Recently, <strong>the</strong>re has been widespread public concern and discussion about <strong>the</strong> issue <strong>of</strong> “employee versus self-employed person”.Actually, in determining whe<strong>the</strong>r a person is an employee or a self-employed person, it is not <strong>the</strong> title <strong>of</strong> <strong>the</strong> job or <strong>the</strong> contract butwhat it is in substance that matters. If <strong>the</strong> relationship between <strong>the</strong> parties is in essence one <strong>of</strong> employer-employee, <strong>the</strong> employer stillhas <strong>to</strong> fulfil his obligations under labour legislation such as <strong>the</strong> Employment Ordinance and <strong>the</strong> Employees’ Compensation Ordinance.How <strong>to</strong> differentiate an employee from a self-employed person?<strong>The</strong>re is no single conclusive test <strong>to</strong> differentiate an employee from a self-employed person. Below are some examples for reference.However, <strong>the</strong>y are not conclusive tests applicable <strong>to</strong> every case, as different industries and companies may have different cus<strong>to</strong>ms ortrade practices.
