The Internati<strong>on</strong>al Civil Aviati<strong>on</strong> Organizati<strong>on</strong> (ICAO), recognising <str<strong>on</strong>g>the</str<strong>on</strong>g> limitati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g>present air navigati<strong>on</strong> <strong>systems</strong> and <str<strong>on</strong>g>the</str<strong>on</strong>g> need to meet future requirements, has taken steps topromote <str<strong>on</strong>g>the</str<strong>on</strong>g> introducti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>satellite</strong>-based technologies for communicati<strong>on</strong>, navigati<strong>on</strong> andsurveillance (CNS) elements in support <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>global</strong> air traffic management (ATM). A fundamentalprerequisite for <str<strong>on</strong>g>the</str<strong>on</strong>g> implementati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> <strong>systems</strong> <strong>on</strong> a <strong>global</strong> basis includes <str<strong>on</strong>g>the</str<strong>on</strong>g> development <str<strong>on</strong>g>of</str<strong>on</strong>g>uniform Standards and Recommended Practices (SARPs).227. ICAO has developed SARPs for <strong>global</strong> navigati<strong>on</strong> <strong>satellite</strong> system (GNSS), 3 whichinclude provisi<strong>on</strong>s for core <strong>satellite</strong> c<strong>on</strong>stellati<strong>on</strong>s (GPS and GLONASS) and aircraft-based,ground-based and <strong>satellite</strong>-based augmentati<strong>on</strong> <strong>systems</strong>, to improve <str<strong>on</strong>g>the</str<strong>on</strong>g> overall GNSSperformance as required for aer<strong>on</strong>autical applicati<strong>on</strong>s. Work is also underway to develop ICAOstandards for GNSS enhancements and new elements such as GPS L5, an additi<strong>on</strong>al civilfrequency for GPS, standards for aer<strong>on</strong>autical applicati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> GALILEO and enhancements toGLONASS.228. The ICAO Assembly at its thirty-sec<strong>on</strong>d sessi<strong>on</strong> in 1998 adopted <str<strong>on</strong>g>the</str<strong>on</strong>g> Charter <strong>on</strong> <str<strong>on</strong>g>the</str<strong>on</strong>g>Rights and Obligati<strong>on</strong>s <str<strong>on</strong>g>of</str<strong>on</strong>g> States relating to GNSS Services (Resoluti<strong>on</strong> A32-19) and <str<strong>on</strong>g>the</str<strong>on</strong>g> LegalFramework for GNSS (Resoluti<strong>on</strong> A32-20), which state fundamental principles applicable toGNSS. An ICAO Secretariat study group was established to c<strong>on</strong>sider, inter alia, <str<strong>on</strong>g>the</str<strong>on</strong>g> creati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g>an appropriate l<strong>on</strong>g-term legal framework to govern <str<strong>on</strong>g>the</str<strong>on</strong>g> operati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> GNSS. In 2001, <str<strong>on</strong>g>the</str<strong>on</strong>g>thirty-third sessi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <str<strong>on</strong>g>the</str<strong>on</strong>g> ICAO Assembly decided that fur<str<strong>on</strong>g>the</str<strong>on</strong>g>r work should be carried out in thisrespect. Regarding financial and o<str<strong>on</strong>g>the</str<strong>on</strong>g>r related aspects <str<strong>on</strong>g>of</str<strong>on</strong>g> GNSS, a study is under way to estimateacceptable and equitable cost allocati<strong>on</strong> shares for major user groups.3 According to <str<strong>on</strong>g>the</str<strong>on</strong>g> definiti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> GNSS in ICAO standards, GNSS is <str<strong>on</strong>g>the</str<strong>on</strong>g> system which comprises two types<str<strong>on</strong>g>of</str<strong>on</strong>g> elements: core <strong>satellite</strong> c<strong>on</strong>stellati<strong>on</strong>s (GPS, GLONASS and future GALILEO) and augmentati<strong>on</strong><strong>systems</strong> (aircraft-based, ground-based and <strong>satellite</strong>-based).41
