The Calculation <strong>and</strong> Invoicing of Fees for Building Approval WorkCalculating FeesThe calculation of Building <strong>Fire</strong> Safety <strong>fees</strong> is based on the <strong>Fire</strong> <strong>and</strong> <strong>Rescue</strong> <strong>Service</strong> Act1990 (FRSA 1990) <strong>and</strong> the Building <strong>Fire</strong> Safety Regulation 2008 (BFSR 2008).Fees for a building approval activity are calculated based on the <strong>fees</strong> applicable for the datethe application for that activity was received.For example, if an ‘Application to Assess/Reassess Special <strong>Fire</strong> <strong>Service</strong>s <strong>and</strong>/or AlternativeSolution Design’ is received on 28 June 2011; however, the Assessment Report <strong>and</strong> theinvoice was not published until 12 July 2011, the fee for the activity would be calculatedusing the <strong>fees</strong> as at the 28 June 2011.Travel <strong>and</strong> Accommodation CostsThe following table outlines when costs for travel <strong>and</strong> accommodation should be charged tothe billing customer. MeetingsPreliminary Meetings (BFSR 2008 s74)The <strong>fees</strong> for preliminary meetings are:Regulated <strong>and</strong>;Calculated at the hourly Preliminary Meeting Fee rate;For the first preliminary meeting for a job, the first hour has a nil fee, each additional hour, orpart of an hour, of the meeting is charged at the hourly Preliminary Meeting Fee rate.For any subsequent preliminary meetings for a job, each hour, or part of an hour, of themeeting is charged at the hourly Preliminary Meeting Fee rate.FEB/FER Meetings (BFSR 2008 s62)The <strong>fees</strong> for FEB/FER meetings are:Regulated <strong>and</strong>;Calculated at an hourly FEB/FER Meeting Fee rate;There is no fee associated with the first three FEB/FER meetings for the one job.For the fourth <strong>and</strong> any subsequent FEB/FER meetings, each hour, or part of an hour, of themeeting is charged at the hourly FEB/FER Meeting Fee rate.Minor Performance Meetings (BFSR 2008 s63)The <strong>fees</strong> for Minor Performance meetings are:Regulated <strong>and</strong>;Not calculated at an hourly rate;The total fee for a Minor Performance meeting is a sum total of:The research fee for evaluation of one subsystem <strong>and</strong>The Minor Performance meeting fee.BAO Consultancy Meetings (QFRS St<strong>and</strong>ing Order SO-Q-BM-2.4)The <strong>fees</strong> for BAO Consultancy meetings are:Non-Regulated <strong>and</strong>;Calculated at the hourly BAO Consultancy rate;The fee for BAO Consultancy Meetings is charged at a flat rate per hour or part of an hour.Version 0.1 July 2013Page 4


St<strong>and</strong>ard Building ApplicationsAssessment (BFSR 2008 s60)The <strong>fees</strong> for st<strong>and</strong>ard building approval assessments are:Regulated <strong>and</strong>;Not calculated at an hourly rate.Special <strong>Fire</strong> <strong>Service</strong> Fees as mentioned in the following sections are calculated using theformula SFSF = BF x SFS% where:SFSF means the special fire service fee for the required special fire service;BF means the base fee for stated building work (BFSR 2008 Sch.2 Part 1); <strong>and</strong>SFS% means the percentage for the required special fire service (BFSR 2008 Sch.2Part 2).Deemed to SatisfyIf the application is a DTS Assessment, the applicant must pay the following <strong>fees</strong>:The base fee for the stated building work (BF);The special fire service fee for each required special fire service for the statedbuilding work (SFSF).Calculation Example ResultFormula: BF + SFSFBF: Building Chargeable m 2 = 1000m 2 BF =$2,318.75SFSF: Calculated on thesum of the percentagesfor required SFSsmultiplied by the BF.FDAS 40%Hydrants 10%Sprinklers 15%Sum of SFS% = 65%Therefore, SFSF = 65% x $2,318.75 (BF)SFSF =$1,507.19DTS Fee: Calculated asBF + SFSF$2,318.75 (BF) + $1,507.19 (SFSF) Total Fee =$3,825.94Note: Values are based on rates as at 1 July 2012. Note, different <strong>fees</strong> apply to the first (or part of the first)hour of the Inspection <strong>and</strong> each additional (or part of an additional) hour.The <strong>fees</strong> for a second or subsequent Inspection (‘Reinspection’ or ‘Additional Inspection’)are calculated at the hourly, ‘Reinspection’ fee. Building Fit-outAssessment / Reassessment (BFSR 2008 s59)The <strong>fees</strong> for building fit-out assessments are:RegulatedWhere the BAO has indicated that the fit-out:Affects the performance of a SFS; butDoes not include the modification, replacement or addition of a SFS.The fee is the base fee for the stated building work (BFSR 2008 Sch.2 Part 1).Where the BAO has indicated that the fit-out:Affects the performance of a SFS; <strong>and</strong>Does include the modification, replacement or addition of a SFS.The fee is the Deemed-to-Satisfy Assessment <strong>and</strong> Inspection fee which is calculated usingthe formula Base Fee + SFSF.Note: The SFSF is calculated based on ‘modified, replaced or added’ SFSs only.Inspection/Reinspection (BFSR 2008 s68)The <strong>fees</strong> for building fit-out inspections are the same as those applicable for st<strong>and</strong>ardbuilding inspections. See section above – ‘St<strong>and</strong>ard Building Applications -Inspection/Reinspection’.Building Change of Classification/UseAssessment/ReassessmentSome <strong>fees</strong> for Assessment/Reassessment of ‘Change of Classification/Use’ applications arenon-regulated <strong>and</strong> subject to GST while others are regulated <strong>and</strong> GST-exempt. Where the BAO has indicated that the Change of Classification/Use is for: A building which does contain SFSs; <strong>and</strong> A building not ‘in existence’ before 14 December 1993.The fee for Assessment is the Deemed-to-Satisfy Assessment <strong>and</strong> Inspection fee which iscalculated using the formula Base Fee + SFSF. This fee is regulated <strong>and</strong> GST-exempt. Ifthe application is a Reassessment, the regulated, hourly, Reassessment fee for each (orpart of an) hour is charged.Where the BAO has indicated that the Change of Classification/Use is for:A building which does not contain SFSs; <strong>and</strong>The Certifier has asked the QFRS to comment on the <strong>Fire</strong> Safety Considerations.The fee for Assessment/Reassessment is calculated at the hourly, BAO Consultancy rate.This fee is non-regulated <strong>and</strong> subject to GST.As there is no Inspection stage, no Inspection Report is generated <strong>and</strong> therefore noInspection fee is applicable. The BAO will visit the building as part of the Assessmentprocess to determine the suitability of the <strong>Fire</strong> Safety Considerations for the writing of thereport (Building Act 1975 s.112).Inspection/ReinspectionSome <strong>fees</strong> for Inspection/Reinspection of ‘Change of Classification/Use’ applications arenon-regulated <strong>and</strong> subject to GST while others are regulated <strong>and</strong> GST-exempt. The type offee is specified below for each type of ‘Change of Classification/Use’ application.Where the BAO has indicated that the Change of Classification/Use is for:A building which does contain SFSs; <strong>and</strong>A building ‘in existence’ before 14 December 1993; <strong>and</strong>The Certifier has not requested that the building be assessed as a St<strong>and</strong>ard BuildingApproval.The <strong>fees</strong> for Inspection/Reinspection are to be calculated at the hourly BAO Consultancyrate.Where the BAO has indicated that the Change of Classification/Use is for:A building which does contain SFSs; <strong>and</strong>A building ‘in existence’ before 14 December 1993; <strong>and</strong>The Certifier has requested that the building be assessed as a St<strong>and</strong>ard BuildingApproval.The <strong>fees</strong> for Inspection/Reinspection are the same as the St<strong>and</strong>ard Building ApprovalInspection process. MarinasThe <strong>fees</strong> for Assessment/Reassessment or Inspection/Reinspection of an applicationinvolving a marina are:Non-Regulated <strong>and</strong>;Calculated at the hourly BAO Consultancy rate.Temporary StructuresSome <strong>fees</strong> for Inspection/Reinspection of ‘Temporary Structure’ applications are nonregulated<strong>and</strong> subject to GST while others are regulated <strong>and</strong> GST-exempt. The type of fee isspecified below for each type of ‘Temporary Structure’ application.Assessment/ReassessmentThe fee for Assessment or Reassessment of an application involving a temporary structureis to be calculated at the non-regulated, hourly BAO Consultancy fee.Inspection / ReinspectionWhere the BAO has indicated that the application involving a Temporary Structure does notinclude SFSs, the fee for Inspection or Reinspection of the temporary structure is to becalculated at the non-regulated, hourly BAO Consultancy fee.Where the BAO has indicated that the application involving a Temporary Structure doesinclude SFSs, the fee for Inspection or Reinspection of the temporary structure is to becalculated at the regulated, hourly, general Inspection fee for each hour, or part of an hour,of the Inspection.Fees are calculated at both Assessment <strong>and</strong> Inspection <strong>and</strong> charged/invoiced separately.Special StructuresThe <strong>fees</strong> for Assessment/Reassessment or Inspection/Reinspection of special structuresare:Non-Regulated <strong>and</strong>;Calculated at the hourly BAO Consultancy fee rate.Fees are calculated at both Assessment <strong>and</strong> Inspection <strong>and</strong> charged/invoiced separately.Referral Agency ResponseThe <strong>fees</strong> for Assessment of an application for ‘Referral Agency Response prior toApplication to a Certifier’ are:Non-Regulated <strong>and</strong>;Calculated at the hourly BAO Consultancy fee rate.As there is no Inspection stage for ‘Referral Agency Response prior to Application to aCertifier’, the fee is calculated at Assessment only.Request for Comment on FEBThe <strong>fees</strong> for ‘Request for Comment on a FEB’ are:Non-Regulated <strong>and</strong>;Version 0.1 July 2013Page 11


Calculated at the hourly BAO Consultancy fee rate.As there is no Inspection stage for ‘Request for Comment on a FEB’, the fee is calculated atthe initial application only.Fee Calculation for Non BCA Required Special <strong>Fire</strong> <strong>Service</strong>sOutlined below are rules regarding the calculation of <strong>fees</strong> depending on whether or not SFSsincluded in a building approval application are required by the BCA. These rules apply onlyto Deemed-to-Satisfy Applications as the QFRS has jurisdiction on all FSIs/ SFSs in ASApplications.If a SFS is not required by the BCA <strong>and</strong> the Building Certifier requests the QFRS toassess/inspect, the BAO will assess/inspect <strong>and</strong> charge the appropriate <strong>fees</strong>. Thisrequest must be in writing e.g. email, to assist in clarification of <strong>fees</strong> to the applicant ifnecessary.If a SFS is not required by the BCA <strong>and</strong> the Building Certifier does not request theQFRS to assess, the BAO will not provide advice on that SFS (compliant/noncompliant) <strong>and</strong> not charge the <strong>fees</strong> for that SFS. This request must be in writing, forexample email, to assist in clarification of <strong>fees</strong> to the applicant if necessary.The CSOS will have the functionality to record that a non BCA required SFS has beeninstalled, but not include this SFS in the calculation of <strong>fees</strong> in the event that the BuildingCertifier does not request the SFS to be assessed.The Assessment/Inspection reports generated by the CSOS will include these 'non BCArequired SFS', however no jurisdictional points will be included. The CSOS will also providest<strong>and</strong>ard commentary to be inserted in the Assessment/Inspection reports in theseinstances, which identify the SFSs for which “the QFRS have not assessed <strong>and</strong> for which theQFRS are not able to provide advice as per the SPR 2009 Schedule 7, Table 1 although it isexpected that the SFS complies to all relevant codes or st<strong>and</strong>ards".Fees Payable If Building Work Does Not Go AheadIf building work doesn’t go ahead after an Assessment Report is provided to theApplicant/Building Certifier <strong>and</strong> an invoiced issued, no refund on the fee paid or payable willoccur as the <strong>fees</strong> are for Assessment <strong>and</strong> Inspection <strong>and</strong> are not separated in the BFSR2008.Multiple Buildings on One ‘Application to Assess’The QFRS will separate a single ‘Application to Assess’ into multiple ’Applications’ if itincludes more than one assessable building. This is in alignment with the BFSR 2008 whichrefers to <strong>fees</strong> being applied for a ‘building’; however, see also the following Multiple BuildingApplications section.In the event that multiple separate assessable buildings on one site are included in anapplication, the QFRS will separate the application into relevant individual buildingapprovals. Each building will then be treated as a separate application for the site, (e.g.individual Assessment <strong>and</strong> Inspection reports) <strong>and</strong> nil fee is charged for the first Inspection(excluding interim inspections) of each building. The BAO will charge the appropriate basefee for each building <strong>and</strong> apply the SFS % for any SFS that are installed in each building(e.g. special automatic fire suppression systems) <strong>and</strong> will also apply the SFS % for any SFSthat serves that building (e.g. hydrant booster).Version 0.1 July 2013Page 12


Multiple Building Applications (MBAs)On the Application to Assess/Reassess Special <strong>Fire</strong> <strong>Service</strong>s <strong>and</strong>/or Alternative SolutionDesign (Form CSO 020), applicants can elect to have buildings assessed as part of aMultiple Building Application. The QFRS will assess multiple buildings as a ‘MBA’ as long asthey:Are lodged on the same day; <strong>and</strong>Are for the same site; <strong>and</strong>Have the same billing customer; <strong>and</strong>Have the same Development Approval for Building Work number; <strong>and</strong>Have the same nature of application (that being either: Building Approval, Fit-out of aBuilding, or Fit-out (DTS) in an AS Building.In the event that multiple separate assessable buildings on one site are included in anapplication submitted as a MBA, the QFRS will nominate a ‘parent’ building <strong>and</strong> theremaining assessable buildings become ‘children’ for the purpose of producing one RFTI.Each building will then be treated as a separate job in the CSOS, (e.g. individualAssessment <strong>and</strong> Inspection reports); however, will be treated as a sum total as if it was onebuilding when calculating <strong>fees</strong>. A nil fee is charged for the first Inspection for the site (not perstructure) (excluding interim inspections). The BAO will charge the appropriate <strong>fees</strong> asoutlined in each section of this module.Fee Complaint/Enquiry ManagementIncluded in Appendix A is the process to be followed when managing fee related complaintsor enquiries.
