EDITORIAL<br />

Dear Friends of the <strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong>,<br />

There are universities that seem to close down in August<br />

and take a summer break. The <strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong> is not<br />

among them. Its library is always full, the outside terrace<br />

as well and the „Schülercampus Jura“ takes place then.<br />

Organized by the Ebelin and Gerd <strong>Bucerius</strong> ZEIT Foundation,<br />

the “Schülercampus Jura” introduces pupils to the<br />

joys of studying law. Needless to say, not everyone is on<br />

campus. The students of the entering class of 2005 are<br />

making their way to their internships and universities<br />

around the world. Some of our faculty are teaching international<br />

law in Suzhou and Beijing. The term papers for<br />

the elective courses have been turned in for evaluation.<br />

Research is an ongoing process. Nevertheless August is a<br />

month for reflection be it during a trip or in the lovely<br />

summer-like Hamburg. We are pleased about the newly<br />

completed library, <strong>Bucerius</strong> Center for Graduate Studies –<br />

Deutsche Bank Hall. Its official inauguration is on September<br />

28, 2007. We are also excited about the entering<br />

class of 2007 and are pleased to welcome them to <strong>Bucerius</strong><br />

on September 28, 2007. Maybe the wishful thinking<br />

contained in the banner “Professor Jacobs remains” will<br />

become reality in August. As if that was not enough, the<br />

<strong>newsletter</strong> contains information about the recently released<br />

research report, interesting news from the areas<br />

of research and teaching as well as the wonderful events<br />

in Studium generale.<br />

RESEARCH REPORT 2007<br />

Positive Reception<br />

B<br />

ucerius<br />

<strong>Law</strong> <strong>School</strong> released its first research report<br />

in June 2007 to document the research performance<br />

of the faculty, graduate assistants and doctoral candidates.<br />

It covers the time period from the foundation of<br />

the <strong>Law</strong> <strong>School</strong> in 2000 until the end of 2006. It will be<br />

released at regular intervals in the future.<br />

<strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong> is proud of its academic staff for<br />

broadening the reputation of the <strong>Law</strong> <strong>School</strong> to include<br />

research in addition to its reputation for excellence in

teaching. The results of the research emphasize the high<br />

quality of the academic work at the <strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong>.<br />

This is more than just establishing a profile for a university<br />

with above average exam results and more than 50<br />

percent of an entering class continuing on with their doctoral<br />

studies. Research projects are the starting points for<br />

academic self-conception, especially for a private institution.<br />

We sent the research report to partners, friends, sponsors<br />

as well as the academic community, in particular to<br />

law faculties. The feedback that we have received has<br />

been very positive which in turn motivates us to continue<br />

new books<br />

Approximately 120 participants from academia and<br />

practice participated in the congress. Special thanks goes<br />

TULANE UNIVERSITY SUMMER LAW<br />

PROGRAM IN PARIS<br />

T his year, for the first time, two <strong>Bucerius</strong> Students were<br />

provided the opportunity to take part in the Tulane<br />

University Summer <strong>Law</strong> Program in Paris. With focus on<br />

European Legal Studies, the offered courses included –<br />

inter alia – Antitrust and Merger in European Union <strong>Law</strong>,<br />

Comparative Products Liability, Comparative Constutional<br />

<strong>Law</strong> and Principles of Corporate Governance. The class<br />

participants were mostly American law students, three<br />

French students from L’Université Panthéon-Assas,<br />

known as the Sorbonne (Paris II) and the <strong>Bucerius</strong> students.<br />

Next to the classes, which took place in the morning,<br />

his assistant Julia Wessman arranged several extracurricular<br />

events, such as a visit to the Cour de Cassation<br />

(French Supreme Court), a tour at the Musee d’Orsay, a<br />

visit to the National Assembly and a Seine-boat trip at<br />

night. Visiting Paris for a month, choosing among a variety<br />

of interesting classes with excellent professors from different<br />

jurisdictions and meeting fellow American and<br />

French law students is a great way to spend one´s summer.<br />

CONGRESS ON LABOR LAW<br />

Discussion with Hamburg Labor Judges<br />

Under the direction of Professor Matthias Jacobs, the<br />

first congress for students specializing in labor law<br />

took place this year together with Hamburg labor judges.<br />

The students presented current problems in labor law<br />

during their speeches. At the conclusion of their<br />

speeches, the problems were discussed within the plenum,<br />

not only from an academic perspective but also<br />

from the viewpoint of practice. Melanie Buhk and Jan<br />

Boucsein spoke about problems within ethic guidelines. In<br />

particular they focused on the waiting period for receiving<br />

unemployment benefits after employment has been terminated.<br />

Hanna Lemp spoke about the exciting “obligation“<br />

of the employers to terminate other jobs. Roland<br />

Czycholl dealt with the controversial legal concept of the<br />

so-called „secondary strike.“ Contrary to its previous<br />

decisions, the Federal Labor Court declared secondary<br />

strikes to be valid. At the conclusion of the thrilling<br />

speeches and controversial discussions, the congress<br />

ended on the campus of <strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong> with a BBQ.<br />

On behalf of the congress participants, we would like to<br />

thank the labor court judges, Birgit Voßkühler and Klaus-<br />

Michael Arndt, the Chief Judge at the Hamburg District<br />

Labor Court, Werner Rühl (lecturer at the <strong>Bucerius</strong> <strong>Law</strong><br />

<strong>School</strong>), and the President of Hamburg Labor Court, Dr.<br />

Helmut Nause, for their engagement!<br />

SPEECHES ABOUT LABOR LAW<br />

Current case law for § 613a BGB – Impact on<br />

the business transfer agreement<br />

Professor Matthias Jacobs invited Nikolaus Krienke<br />

from the law firm, Clifford Chance in Frankfurt am<br />

Main, to the <strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong> on June 19, 2007.<br />

Krienke held a speech in the lecture series „Guest speakers<br />

talk on Labor <strong>Law</strong>.“ He spoke about the development<br />

of §613a BGB in case law. It is important in both academics<br />

and practice. Using the example of business transfer<br />

agreements, he concentrated on the area where labor<br />

and company law meet. Using model clauses and examples<br />

from his experience as a lawyer, he was able to<br />

effectively depict the function of a labor lawyer in a large<br />

law firm. Krienke also answered critical questions about<br />

the advantages and disadvantages of accepting employment<br />

at a large law firm. It was a successful and entertaining<br />

event.<br />

The third guest lecture on labor law issues took place<br />

on July 4, 2007. Professor Matthias Jacobs, Chair for<br />

Civil <strong>Law</strong>, Labor <strong>Law</strong> and <strong>Law</strong> of Civil Procedure invited<br />

of Tchibo GmbH in Hamburg, to speak to students and<br />

doctoral candidates about “Areas of conflict between<br />

labor-management contracts and wage agreements.“<br />

Using the example of the introduction of the 40 hour<br />

workweek, Deeg described the classic problems in labor<br />

law. Although Tchibo is not bound to wage agreements,<br />

collective bargaining rights have priority over the company’s<br />

rights, when – as is the case with the hours<br />

worked per week – areas are to be regulated that are<br />

normally part of collective agreements. Deeg therefore<br />

developed a semi-formal works agreement for his employer.<br />

Subsequently, it had to be tailored to the various<br />

groups of employees. During his speech, it became apparent<br />

that successful legal work is not restricted to the<br />

application of norms, but it also requires visualization<br />

techniques and negotiation skills.<br />

EXCURSION<br />

An exciting afternoon at Airbus<br />

Students specializing in labor law could not have<br />

wished for a more suitable welcome when they visited<br />

Airbus on July 9, 2007: A banner with the words<br />

„Works meeting for the late shift“ was hung over the east<br />

entry of the largest European aircraft construction company.<br />

Together with students from the University of Kiel,<br />

research assistants and Professor Matthias Jacobs and<br />

Stefan Lunk, partner at Latham & Watkins Hamburg, they<br />

accepted Airbus’ invitation to take a tour and participate<br />

in a talk with Karsten Poerschke, Senior Manager of the<br />

HR Department. Poerschke offered the excursion participants<br />

illustrative materials for labor law matters of a<br />

special nature. The visit started off with a special highlight:<br />

an informative as well as exciting tour of the production<br />

halls. Contrary to general expectations, cleanliness<br />

and serenity dictated the working atmosphere. The<br />

only disappointment: The group was only able to view the<br />

A 380 from afar. At the conclusion, Karsten Poerschke<br />

provided them with a comprehensive insight into the job<br />

of a labor lawyer in an international company. It just goes<br />

to show how versatile, challenging and practical issues in<br />

labor law can be.<br />

SYMPOSIUM<br />

Capital Market Legislation for the European<br />

Single Market<br />

On June 15, 2007, the symposium „Capital Market<br />

Legislation for the European Single Market“ took<br />

place at the <strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong>. It was organized by the<br />

Max-Planck-Institute for Foreign and International Private<br />

<strong>Law</strong> in Hamburg and the chairs of Professor Axel Kämmerer<br />

and Professor Rüdiger Veil. Over 30 well-known<br />

representatives from the economic, legal and capital<br />

market practice participated in the symposium, among<br />

others: Professor Jens Wüstemann (Mannheim), Professor<br />

Karl Riesenhuber (Bochum), Professor Gerald Spindler<br />

(Göttingen), Thomas Eufinger (BaFin, Frankfurt a.M.), Professor<br />

Ferdinand Kirchhof (Tübingen) and Professor Christian<br />

Bumke (<strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong>). The morning was<br />

dedicated to understanding capital market regulations.<br />

The lively discussion proved how important the overlap of<br />

legal disciplines and the interdisciplinary exchange of<br />

ideas is for capital market law. The conference volumne<br />

will be published in approximately six months.<br />

Maja Stadler-Euler, partner at the law firm Taylor<br />

Wessing, led a mixed group of students and lawyers<br />

from Taylor Wessing on the traditional art foray. She<br />

led them through the Daniel Richter Exhibit at the Hamburg<br />

Art Museum as part of Studium generale.

The art enthusiasts were led through the contemporary<br />

art exhibit by an entertaining and competent guide. The<br />

collection was located in the upper story of the museum.<br />

Daniel Richter had personally set-up the exhibition.<br />

Among other things, tour participants learned that the<br />

taciturn artist carefully composed his paintings over several<br />

months, sometimes even working on more than one<br />

work of art at a time. The comprehensive exhibit contained<br />

pieces that were of a purely abstract nature to<br />

works that show the first signs of objects up to numerous<br />

concrete works in bright colors.<br />

STUDENTS’ DAY<br />

Students organize Studium generale for a day<br />

A<br />

special Studium generale day was held on June 20,<br />

2007 at the <strong>Law</strong> <strong>School</strong>: The program was completely<br />

organized by students of the <strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong>.<br />

Daniel Schneider (student of the entering class of 2004)<br />

invited Volker Eichener, professor for political science at<br />

the FH Düsseldorf, to speak about the topic “Demographical<br />

Change“ and its consequences for citizens, the state,<br />

cities and personal future plans. The <strong>Law</strong> <strong>School</strong> organization<br />

“Soziale Aktivitäten“ organized a different kind of city<br />

tour together with “Hinz & Kunzt“ to provide students<br />

with insight into the daily life of Hamburg’s homeless.<br />

Christine Preuß (student of the entering class of 2003)<br />

initiated actions to save human lives: What happens with<br />

our organs when we donate them? Claus Clausen (Transplantation<br />

Center of the University Hospital Hamburg-<br />

Eppendorf) provided answers to these explosive questions<br />

in his speech. Assistant Medical Director Lutz<br />

Schmitt (provisional director of the blood donor center in<br />

Hamburg) informed students about donating blood, while<br />

<strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong> was turned into a “field hospital“:<br />

Numerous students and employees took part in the action<br />

“Saving lives“ and filled up the blood reserves of<br />

Hamburg.<br />

In the evening, Peter U. Meyer (Hamburger Abendblatt)<br />

moderated a panel discussion about the party-political<br />

concepts for the further development of our Hanseatic<br />

City. Which ideas are best suitable to cultivating Ham-<br />

burg? How can we remain competitive, where are we<br />

headed and what is actually important in our society<br />

today? The various party representative invited by the<br />

student political groups actively discussed Hamburg as a<br />

“growing,” “free,” “creative,” and “human“ metropolis.<br />

We would like to thank the many students involved in<br />

organizing the various events!<br />

WHAT IS TO BE DONE?<br />

Visit to documenta 12 in Kassel<br />

At 6:00 a.m. on June 22, 2007, 20 very tired art lovers<br />

met at the <strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong> to travel with Ulrike<br />

Pluschke and the Hamburg art historian Dagmar Lott-<br />

Reschke to documenta 12 in Kassel as part of Studium<br />

generale. Once there, the art tour started at castle Wilhelmshöhe<br />

with the “Terraced Rice Fields Art Project“ by<br />

Sakarin Krue-On. It continued with the exploration of the<br />

exhibitions Documenta-Halle and Aue-Pavillon lead by<br />

Lott-Reschke.<br />

The project “Fairytale – Märchen“ by the Chinese artist Ai<br />

Weiwei had caused a lot of excitement in advance. We<br />

did not see any of the 1001 Chinese that were flown in<br />

especially for this event, but we did find 1001 historical<br />

chairs that invited us to sit down and relax. The chairs<br />

were imported from China especially for this purpose.<br />

and the Neue Galerie, the exhibitions by Mary Kelly,<br />

James Coleman, Trisha Brown, Gerhard Richter and Iole<br />

de Freitas among others, provided us with the opportunity<br />

to think about the guiding themes of the documenta<br />

12: „Is modernity our antiquity?,“ „What is bare life?“ and<br />

„What is to be done?“<br />

LIVING BRIDGE<br />

Hadi Teherani at Taylor Wessing<br />

On Wednesday, June 27, 2007, Maja Stadler-Euler,<br />

lawyer and long-time partner at the law firm Taylor<br />

Wessing, welcomed numerous students to the traditional<br />

talk at TaylorWessing with the following words: „Being<br />

interested in architecture is comparable to being interested<br />

in art.“ Per special request, she had invited the<br />

Hamburg architect, Hadi Teherani, to the talk. In the relaxed<br />

atmosphere high above the emerging HafenCity,<br />

Teherani talked about his current and completed projects.<br />

He put special emphasis on the “Living Bridge“ (still being<br />

planned), a habitable bridge. It is supposed to connect<br />

north and south Hamburg true to the motto „Jump over<br />

the Elbe.“<br />

Using his charm, Teherani was able to explain the ambitious<br />

HafenCity project to the students. He also explained<br />

the procedure for architecture competitions and legal<br />

hurdles for completing his project. During the question<br />

and answer period, he knew how to handle the critical<br />

comments that were made – leading to a lively discussion<br />

with the students. The discussions carried on during the<br />

reception.<br />

IMPORTANT DATES<br />

Events at the <strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong><br />

SEPTEMBER 2007<br />

• On September 4, 2007 <strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong> together<br />

with the Financial Times Deutschland will be<br />

holding a conference with the title “Criminality and<br />

Corruption in the Economy.“ Among others, Thomas<br />

Rönnau and Clifford Larsen will be speaking on this<br />

topic and they will be drawing on examples from the<br />

companies MAN, ABB and Deutsche Bahn. A panel<br />

discussion will be held at the conclusion. The FTD<br />

editor Andreas Kurz will moderate the discussion.<br />

• On Friday, September 28, 2007, at 11:00 a.m., <strong>Bucerius</strong><br />

<strong>Law</strong> <strong>School</strong> invites you to the Commencement<br />

Ceremony for the entering class of 2007 at<br />

the Hamburg Chamber of Commerce. As in the past<br />

year, all of those who have passed their First State<br />

Examination or obtained their doctorate or their postdoctorate<br />

qualification will be congratulated on their<br />

achievements. In addition, the new entering class,<br />

the international students and the Master’s Students<br />

will be welcomed. The keynote speaker is Dr. Klaus<br />

von Dohnanyi, former Mayor of the Free and Hanseatic<br />

City of Hamburg. The prize for outstanding<br />

academic performance and social service will be<br />

awarded. Afterwards the Ebelin and Gerd <strong>Bucerius</strong><br />

ZEIT Foundation invites everyone to the inauguration<br />

of the “<strong>Bucerius</strong> Center for Graduate Studies –<br />

Deutsche Bank Hall“ at <strong>Bucerius</strong> <strong>Law</strong> <strong>School</strong>. For further<br />
