EDITORIAL
Dear Friends of the Bucerius Law School,
There are universities that seem to close down in August
and take a summer break. The Bucerius Law School is not
among them. Its library is always full, the outside terrace
as well and the „Schülercampus Jura“ takes place then.
Organized by the Ebelin and Gerd Bucerius ZEIT Foundation,
the “Schülercampus Jura” introduces pupils to the
joys of studying law. Needless to say, not everyone is on
campus. The students of the entering class of 2005 are
making their way to their internships and universities
around the world. Some of our faculty are teaching international
law in Suzhou and Beijing. The term papers for
the elective courses have been turned in for evaluation.
Research is an ongoing process. Nevertheless August is a
month for reflection be it during a trip or in the lovely
summer-like Hamburg. We are pleased about the newly
completed library, Bucerius Center for Graduate Studies –
Deutsche Bank Hall. Its official inauguration is on September
28, 2007. We are also excited about the entering
class of 2007 and are pleased to welcome them to Bucerius
on September 28, 2007. Maybe the wishful thinking
contained in the banner “Professor Jacobs remains” will
become reality in August. As if that was not enough, the
newsletter contains information about the recently released
research report, interesting news from the areas
of research and teaching as well as the wonderful events
in Studium generale.
RESEARCH REPORT 2007
Positive Reception
B
ucerius
Law School released its first research report
in June 2007 to document the research performance
of the faculty, graduate assistants and doctoral candidates.
It covers the time period from the foundation of
the Law School in 2000 until the end of 2006. It will be
released at regular intervals in the future.
Bucerius Law School is proud of its academic staff for
broadening the reputation of the Law School to include
research in addition to its reputation for excellence in

teaching. The results of the research emphasize the high
quality of the academic work at the Bucerius Law School.
This is more than just establishing a profile for a university
with above average exam results and more than 50
percent of an entering class continuing on with their doctoral
studies. Research projects are the starting points for
academic self-conception, especially for a private institution.
We sent the research report to partners, friends, sponsors
as well as the academic community, in particular to
law faculties. The feedback that we have received has
been very positive which in turn motivates us to continue
on this path. If you are interested, you can download the
report at www.law-school.de/newsfeed/ 0000298806.pdf.
by Zahra Rahvar, Student
T his year, for the first time, two Bucerius Students were
provided the opportunity to take part in the Tulane
University Summer Law Program in Paris. With focus on
European Legal Studies, the offered courses included –
inter alia – Antitrust and Merger in European Union Law,
Comparative Products Liability, Comparative Constutional
Law and Principles of Corporate Governance. The class
participants were mostly American law students, three
events, such as a visit to the Cour de Cassation
(French Supreme Court), a tour at the Musee d’Orsay, a
visit to the National Assembly and a Seine-boat trip at
night. Visiting Paris for a month, choosing among a variety
of interesting classes with excellent professors from different
jurisdictions and meeting fellow American and
CONGRESS ON LABOR LAW
Discussion with Hamburg Labor Judges
by Roland Czycholl, Student
Under the direction of Professor Matthias Jacobs, the
first congress for students specializing in labor law
took place this year together with Hamburg labor judges.
The students presented current problems in labor law
during their speeches. At the conclusion of their
speeches, the problems were discussed within the plenum,
not only from an academic perspective but also
from the viewpoint of practice. Melanie Buhk and Jan
Boucsein spoke about problems within ethic guidelines. In
particular they focused on the waiting period for receiving
unemployment benefits after employment has been terminated.
Hanna Lemp spoke about the exciting “obligation“
of the employers to terminate other jobs. Roland
Czycholl dealt with the controversial legal concept of the
so-called „secondary strike.“ Contrary to its previous
decisions, the Federal Labor Court declared secondary
strikes to be valid. At the conclusion of the thrilling
speeches and controversial discussions, the congress
ended on the campus of Bucerius Law School with a BBQ.
On behalf of the congress participants, we would like to
thank the labor court judges, Birgit Voßkühler and Klaus-
Michael Arndt, the Chief Judge at the Hamburg District
Labor Court, Werner Rühl (lecturer at the Bucerius Law
School), and the President of Hamburg Labor Court, Dr.
Helmut Nause, for their engagement!
SPEECHES ABOUT LABOR LAW
Current case law for § 613a BGB – Impact on
the business transfer agreement
by Sebastian Naber, Research Assistant
Professor Matthias Jacobs invited Nikolaus Krienke
from the law firm, Clifford Chance in Frankfurt am
Main, to the Bucerius Law School on June 19, 2007.
Krienke held a speech in the lecture series „Guest speakers
talk on Labor Law.“ He spoke about the development
of §613a BGB in case law. It is important in both academics
and practice. Using the example of business transfer
agreements, he concentrated on the area where labor
and company law meet. Using model clauses and examples
from his experience as a lawyer, he was able to
effectively depict the function of a labor lawyer in a large
law firm. Krienke also answered critical questions about
the advantages and disadvantages of accepting employment
at a large law firm. It was a successful and entertaining
event.
Visit from a labor lawyer from Tchibo
The third guest lecture on labor law issues took place
on July 4, 2007. Professor Matthias Jacobs, Chair for
Civil Law, Labor Law and Law of Civil Procedure invited
Peter Deeg, lawyer in the human resources department

of Tchibo GmbH in Hamburg, to speak to students and
doctoral candidates about “Areas of conflict between
labor-management contracts and wage agreements.“
Using the example of the introduction of the 40 hour
workweek, Deeg described the classic problems in labor
law. Although Tchibo is not bound to wage agreements,
collective bargaining rights have priority over the company’s
rights, when – as is the case with the hours
worked per week – areas are to be regulated that are
normally part of collective agreements. Deeg therefore
developed a semi-formal works agreement for his employer.
Subsequently, it had to be tailored to the various
groups of employees. During his speech, it became apparent
that successful legal work is not restricted to the
application of norms, but it also requires visualization
techniques and negotiation skills.
EXCURSION
An exciting afternoon at Airbus
by Nathalie Putterer, Research Assistant
Students specializing in labor law could not have
wished for a more suitable welcome when they visited
Airbus on July 9, 2007: A banner with the words
„Works meeting for the late shift“ was hung over the east
entry of the largest European aircraft construction company.
Together with students from the University of Kiel,
research assistants and Professor Matthias Jacobs and
Stefan Lunk, partner at Latham & Watkins Hamburg, they
accepted Airbus’ invitation to take a tour and participate
in a talk with Karsten Poerschke, Senior Manager of the
HR Department. Poerschke offered the excursion participants
illustrative materials for labor law matters of a
special nature. The visit started off with a special highlight:
an informative as well as exciting tour of the production
halls. Contrary to general expectations, cleanliness
and serenity dictated the working atmosphere. The
only disappointment: The group was only able to view the
A 380 from afar. At the conclusion, Karsten Poerschke
provided them with a comprehensive insight into the job
of a labor lawyer in an international company. It just goes
to show how versatile, challenging and practical issues in
labor law can be.
SYMPOSIUM
Capital Market Legislation for the European
Single Market
by Lars Teigelack, Research Assistant
On June 15, 2007, the symposium „Capital Market
Legislation for the European Single Market“ took
place at the Bucerius Law School. It was organized by the
Max-Planck-Institute for Foreign and International Private
Law in Hamburg and the chairs of Professor Axel Kämmerer
and Professor Rüdiger Veil. Over 30 well-known
representatives from the economic, legal and capital
market practice participated in the symposium, among
others: Professor Jens Wüstemann (Mannheim), Professor
Karl Riesenhuber (Bochum), Professor Gerald Spindler
(Göttingen), Thomas Eufinger (BaFin, Frankfurt a.M.), Professor
Ferdinand Kirchhof (Tübingen) and Professor Christian
Bumke (Bucerius Law School). The morning was
dedicated to understanding capital market regulations.
The lively discussion proved how important the overlap of
legal disciplines and the interdisciplinary exchange of
ideas is for capital market law. The conference volumne
will be published in approximately six months.
The art enthusiasts were led through the contemporary
art exhibit by an entertaining and competent guide. The
collection was located in the upper story of the museum.
Daniel Richter had personally set-up the exhibition.
Among other things, tour participants learned that the
taciturn artist carefully composed his paintings over several
months, sometimes even working on more than one
work of art at a time. The comprehensive exhibit contained
pieces that were of a purely abstract nature to
works that show the first signs of objects up to numerous
concrete works in bright colors.
STUDENTS’ DAY
Students organize Studium generale for a day
by Nele Bull, Student
A
special Studium generale day was held on June 20,
2007 at the Law School: The program was completely
organized by students of the Bucerius Law School.
Daniel Schneider (student of the entering class of 2004)
invited Volker Eichener, professor for political science at
the FH Düsseldorf, to speak about the topic “Demographical
Change“ and its consequences for citizens, the state,
cities and personal future plans. The Law School organization
“Soziale Aktivitäten“ organized a different kind of city
tour together with “Hinz & Kunzt“ to provide students
with insight into the daily life of Hamburg’s homeless.
Christine Preuß (student of the entering class of 2003)
initiated actions to save human lives: What happens with
our organs when we donate them? Claus Clausen (Transplantation
Center of the University Hospital Hamburg-
Eppendorf) provided answers to these explosive questions
in his speech. Assistant Medical Director Lutz
Schmitt (provisional director of the blood donor center in
Hamburg) informed students about donating blood, while
Bucerius Law School was turned into a “field hospital“:
Numerous students and employees took part in the action
“Saving lives“ and filled up the blood reserves of
Hamburg.
In the evening, Peter U. Meyer (Hamburger Abendblatt)
moderated a panel discussion about the party-political
concepts for the further development of our Hanseatic
City. Which ideas are best suitable to cultivating Ham-
burg? How can we remain competitive, where are we
headed and what is actually important in our society
today? The various party representative invited by the
student political groups actively discussed Hamburg as a
“growing,” “free,” “creative,” and “human“ metropolis.
We would like to thank the many students involved in
organizing the various events!
WHAT IS TO BE DONE?
Visit to documenta 12 in Kassel
by Anna-Kristin Edler, Student
At 6:00 a.m. on June 22, 2007, 20 very tired art lovers
met at the Bucerius Law School to travel with Ulrike
Pluschke and the Hamburg art historian Dagmar Lott-
Reschke to documenta 12 in Kassel as part of Studium
generale. Once there, the art tour started at castle Wilhelmshöhe
with the “Terraced Rice Fields Art Project“ by
Sakarin Krue-On. It continued with the exploration of the
exhibitions Documenta-Halle and Aue-Pavillon lead by
Lott-Reschke.
The project “Fairytale – Märchen“ by the Chinese artist Ai
Weiwei had caused a lot of excitement in advance. We
did not see any of the 1001 Chinese that were flown in
especially for this event, but we did find 1001 historical
chairs that invited us to sit down and relax. The chairs
were imported from China especially for this purpose.
During the following tours through the Friedericianum

and the Neue Galerie, the exhibitions by Mary Kelly,
James Coleman, Trisha Brown, Gerhard Richter and Iole
de Freitas among others, provided us with the opportunity
to think about the guiding themes of the documenta
12: „Is modernity our antiquity?,“ „What is bare life?“ and
„What is to be done?“
LIVING BRIDGE
Hadi Teherani at Taylor Wessing
by Matthis Kreyer, Student
On Wednesday, June 27, 2007, Maja Stadler-Euler,
lawyer and long-time partner at the law firm Taylor
Wessing, welcomed numerous students to the traditional
talk at TaylorWessing with the following words: „Being
interested in architecture is comparable to being interested
in art.“ Per special request, she had invited the
Hamburg architect, Hadi Teherani, to the talk. In the relaxed
atmosphere high above the emerging HafenCity,
Teherani talked about his current and completed projects.
He put special emphasis on the “Living Bridge“ (still being
planned), a habitable bridge. It is supposed to connect
north and south Hamburg true to the motto „Jump over
the Elbe.“
Using his charm, Teherani was able to explain the ambitious
HafenCity project to the students. He also explained
the procedure for architecture competitions and legal
hurdles for completing his project. During the question
and answer period, he knew how to handle the critical
comments that were made – leading to a lively discussion
with the students. The discussions carried on during the
reception.
