Stat. tit. 10, §7101 et. seq.Any volunteer shall be immune from liability <strong>in</strong> a civil action on thebasis of any act or omission of the volunteer result<strong>in</strong>g <strong>in</strong> damageor <strong>in</strong>jury if: (1) the volunteer was act<strong>in</strong>g <strong>in</strong> good faith <strong>and</strong> with<strong>in</strong> thescope of the volunteer’s official functions <strong>and</strong> duties for a charitableorganization…; <strong>and</strong> (2) the damage or <strong>in</strong>jury was not caused bygross negligence or willful <strong>and</strong> wanton misconduct by the volunteer.Okla. Stat. tit. 76, §31(A). In any civil action aga<strong>in</strong>st a charitableorganization or not-for-profit corporation for damages based on theconduct of a volunteer, the doctr<strong>in</strong>e of respondeat superior shall applynotwithst<strong>and</strong><strong>in</strong>g the immunity granted to the volunteer.
