<strong>The</strong> following regulations apply to the registration <strong>and</strong> entry <strong>of</strong> animals in the Stud Book <strong>and</strong> Appendix:1. SECTIONS.Animals may be registered in the Stud Book or entered in the Appendix thereto in the appropriateone <strong>of</strong> the following Sections:A. SECTION A: WELSH MOUNTAIN PONIES:Not exceeding 12 h<strong>and</strong>s high.Animals proposed for registration in Section A that qualify by pedigree <strong>and</strong> whose height atmaturity exceeds 12 h<strong>and</strong>s but does not exceed 12.2 h<strong>and</strong>s may be accepted or retained inSection A for breeding purposes only. Such animals cannot be exhibited in <strong>Welsh</strong> Mountain <strong>Pony</strong>classes. Height must be authorised by measurement, not estimation.B. SECTION B: WELSH PONIES:Not exceeding 13.2 h<strong>and</strong>s high.C. SECTION C: WELSH PONIES OF COB TYPE:Not exceeding 13.2 h<strong>and</strong>s high.D. SECTION D: WELSH COBS.Should be over 13.2 h<strong>and</strong>s with no upper limitAppendix <strong>of</strong> Foundation Stock to each <strong>of</strong> the above four sections.E. SECTION E: GELDINGS.F. PART WELSH REGISTER.2. DEFINITIONS.For the purpose <strong>of</strong> these regulations, the following definitions shall apply:A. <strong>The</strong> breeder is the recorded or legal owner or lessee <strong>of</strong> the dam at the time <strong>of</strong> foaling.B. <strong>The</strong> abbreviation AWSB st<strong>and</strong>s for <strong>Australia</strong>n <strong>Welsh</strong> Stud Book.C. A purebred pony or cob is a pony or cob registered in Section A, B, C or D <strong>of</strong> the <strong>Society</strong>’sStud Book. Such animals are by a registered sire from a registered or FS2 dam.D. A reference animal is a pony registered in the <strong>Welsh</strong> Section <strong>of</strong> the APSB as Pure <strong>Welsh</strong> orFS, FS1, FS2 <strong>and</strong> proven to be so.E. An FS filly/mare is a filly/mare, which has been approved by a <strong>Society</strong> Inspector as true totype, entered in the Appendix to the Stud Book in Section A, B, C or D by a registered sire.F. An FS1 filly/mare is a filly/mare, which has been approved by a <strong>Society</strong> Inspector as true totype, entered in the Appendix to the Stud Book in Section A, B, C or D by a registered sire <strong>and</strong> out<strong>of</strong> an FS mare.G. An FS2 filly/mare is a filly/mare, which has been approved by a <strong>Society</strong> Inspector as true totype, entered in the Appendix to the Stud Book in Section A, B, C or D by a registered sire <strong>and</strong> out<strong>of</strong> an FS1 mare.H. A Section E is a pony or cob colt foal that has been gelded, out <strong>of</strong> a registered Section A, B, Cor D dam or FS, FS1 or FS2 dam by a registered sire.I. A Part <strong>Welsh</strong> pony is a pony, horse or cob, either male or female that shows in its pedigree12.5% <strong>Welsh</strong> blood registered with a recognised <strong>Welsh</strong> Stud Book. Refer regulation 26.3. APPLICATION TO REGISTER.A. Every application for registration or entry <strong>and</strong> every notification <strong>of</strong> birth shall be made on formsapproved by the Committee <strong>of</strong> Management <strong>and</strong> shall contain such information as the Committee<strong>of</strong> Management shall from time to time decide.B. <strong>The</strong> prescribed fee shall accompany each such application <strong>and</strong> notification.C. Only Full Financial Members are eligible to register ponies in the AWSB.D. <strong>The</strong> breeder must register the pony <strong>and</strong> sign the form for application <strong>of</strong> initial registration.E. When adult registering a pony, the breeder’s signature is not required if transfer <strong>of</strong> ownershiphas been recorded.F. To register a foal both parents must be registered in the AWSB.4. ENTERED ONCE ONLY.No animal can be registered or entered in more than one Section <strong>of</strong> the <strong>Society</strong>’s Stud Book, itsAppendix or the Part-<strong>Welsh</strong> Register.5. REGISTRATION DATES.A. All applications for registration, except geldings <strong>and</strong> Part <strong>Welsh</strong>, must be in the <strong>of</strong>fice by the31st July, in the foaling year.B. After 1st August, the st<strong>and</strong>ard fee for registration <strong>of</strong> the animal will apply as a penalty fee foreach year the registration is overdue.C. In the case <strong>of</strong> a colt whose birth has been notified as provided in the preceding clauses,application for stallion registration must be made before such a colt attains the age <strong>of</strong> four years<strong>and</strong> not before two years <strong>of</strong> age. Failure to do so will incur the penalty fee as described above.D. Ponies not already registered cannot be entered into the Stud Book after attaining 10 years <strong>of</strong>age.E. Failure to adult register the pony within the prescribed time limit will deem the pony ineligible toenter WPCS run shows.6. MEMBERSHIPS.Ponies are entered, registered <strong>and</strong> transferred into the membership name <strong>of</strong> the breeder <strong>and</strong>/orowner.2


A. Membership is compulsory in order to obtain registration papers.B. If the membership name is in one or more names or in the name <strong>of</strong> a Stud, the names <strong>of</strong> allparties are to be forwarded to the <strong>Society</strong> <strong>of</strong>fice.C. One person is to be nominated as the nominee who is the signatory for signing <strong>of</strong> documents.This is the person who signs the transfers, registrations <strong>and</strong> Service Certificates. Writtennotification from all living parties is required to alter the nominee.D. In order to change the name <strong>of</strong> the Membership a letter signed by all parties is required. Thisletter should formally request the change <strong>of</strong> name, noting that all ponies currently owned are nowto be noted as owned by this new membership name. Payment <strong>of</strong> prescribed fee is also required.E. Once the change to the name <strong>of</strong> Membership is approved, all ponies transferred to <strong>and</strong> bred bythis membership will note the new membership name. <strong>The</strong> Registration Certificate <strong>of</strong> any poniesalready bred or owned by this Membership will hold the name <strong>of</strong> the previous Membership name.To transfer ponies to the new Membership name, the Certificates will need to be forwarded to the<strong>of</strong>fice along with the transfer fee.F. Deceased Estate Membership:To transfer a Stud Prefix <strong>and</strong>/or Br<strong>and</strong> a Statutory Declaration is required to be signed by the legalrepresentative <strong>and</strong> or the executor <strong>of</strong> the membership.G. Divorce/Separation Membership:To transfer a Stud Prefix <strong>and</strong> or Br<strong>and</strong> a Statutory Declaration is required to be signed by the LegalRepresentative <strong>and</strong> or all parties <strong>of</strong> the membership.7. PREFIX AND BRAND APPLICATIONS.A. Members <strong>of</strong> the <strong>Society</strong> shall be entitled to the exclusive use <strong>of</strong> a distinctive Prefix <strong>and</strong> Br<strong>and</strong>for the purpose <strong>of</strong> registration or entry in the <strong>Society</strong>’s publications,.B. <strong>The</strong> Committee <strong>of</strong> Management shall have the right to decline to register any Prefix or Br<strong>and</strong>,which, in its opinion, is unsuitable or objectionable.C. <strong>The</strong> Breeder’s registered prefix <strong>and</strong> br<strong>and</strong> must be used in every instance.D. Application for Prefix <strong>and</strong> Br<strong>and</strong> or change to Prefix <strong>and</strong>/or Br<strong>and</strong> must be made on formsapproved by the Committee <strong>of</strong> Management.E. <strong>The</strong> prescribed fee shall accompany the application.F. To effect the transfer <strong>of</strong> Prefix <strong>and</strong>/or Br<strong>and</strong> to another Member, written confirmation isrequired from the registered breeder.8. BRANDING.A. Animals born in <strong>Australia</strong> are required by the <strong>Society</strong> to be br<strong>and</strong>ed within one year <strong>of</strong> the date<strong>of</strong> foaling.B. Animals must be br<strong>and</strong>ed on the near shoulder with the breeder’s registered br<strong>and</strong> <strong>and</strong>br<strong>and</strong>ed on the <strong>of</strong>f shoulder with the breeding number over the last number <strong>of</strong> the season <strong>of</strong>foaling, or as State Laws require.C. Animals sold before attaining the age <strong>of</strong> one year must be br<strong>and</strong>ed before transfer <strong>of</strong>ownership can be affected by the <strong>Society</strong>.9. STALLION REGISTRATION & VETERINARY CERTIFICATES.A. Application for Stallion Registration must be made before such a colt attains the age <strong>of</strong> fouryears, <strong>and</strong> not before two years <strong>of</strong> age. Failure to do so will incur the penalty fee as described inregulation 5B.B. Original Colt Birth Notification Certificate must accompany the Stallion Registration form.C. <strong>The</strong> <strong>Society</strong> will only register or enter the progeny <strong>of</strong> registered stallions in the <strong>Welsh</strong> Section<strong>of</strong> the Stud Book for which a Veterinary Certificate has been lodged with the Secretary stating thatsuch sire is free from hereditary disease or congenital abnormalities.D. <strong>The</strong> Veterinary Certificate must record the pony’s br<strong>and</strong>s <strong>and</strong> markings in order to identify thepony being registered.E. All Colts must be DNA Pr<strong>of</strong>iled prior to being approved for Stallion Registration. <strong>The</strong>Veterinarian may take the DNA sample when completing the Veterinary Certificate. <strong>The</strong> Colt willnot be adult registered until the <strong>Society</strong> has received the DNA Pr<strong>of</strong>ile result.F. For r<strong>and</strong>om testing, the DNA samples may be taken by a Committee <strong>of</strong> Managementnominated Veterinarian or two persons nominated by the Committee <strong>of</strong> Management in thepresence <strong>of</strong> each other <strong>and</strong> the registered owner or their nominee.10. BREEDING.A. If a registered or entered pony or cob is mated with another registered or entered animal, theresulting progeny will be eligible for registration or entry in the Section indicated in the followingtable:A x A = A B x B = B C x C = CA x B = B B x C = C C x D = C or DA x C = C B x D = C or D D x D = DA x D = C or DB. Animals proposed for registration or entry in Section A, whose sire or dam were born before1st August, 1960 <strong>and</strong> who have Section B in their pedigree, may qualify for registration or entry inSection A if approved by the <strong>Society</strong> Inspector as true to Section A type, <strong>and</strong> if their height doesnot exceed 12.0hh.3


11. CERTIFICATE OF SERVICE.A. A Certificate <strong>of</strong> Service must accompany each application, if the stallion <strong>and</strong>/or mare is notowned or leased by the breeder at the time <strong>of</strong> service.B. <strong>The</strong> owner/lessee <strong>of</strong> the sire <strong>and</strong> the owner <strong>of</strong> the dam at the time <strong>of</strong> service must sign theCertificate <strong>of</strong> Service.C. <strong>The</strong> Certificate must state the dates the dam was served <strong>and</strong> specify the stallion, which mustbe adult registered.D. Where the breeder owns <strong>and</strong>/or leases the stallion <strong>and</strong>/or mare the breeder’s declaration onthe application form must be completed <strong>and</strong> signed.12. MARKINGS.A. <strong>The</strong> markings <strong>of</strong> an animal must be carefully set out on the form <strong>of</strong> application for registrationor entry.B. It is the responsibility <strong>of</strong> the person who applies for registration or entry to satisfy the <strong>Society</strong>, ifrequired, <strong>of</strong> the accuracy <strong>of</strong> information <strong>and</strong> sketch <strong>of</strong> markings given at the time <strong>of</strong> application.C. Whorls must be included as markings on registration applications. <strong>The</strong> location <strong>of</strong> whorls orirregular setting <strong>of</strong> coat hairs should be precisely indicated on the diagram by an X.13. GELDINGS & DECEASED PONIES.A. Registration Certificate <strong>of</strong> castrated stallions <strong>and</strong> <strong>of</strong> animals which have died or have beenexported must be surrendered to the Secretary <strong>of</strong> the <strong>Society</strong>.B. <strong>The</strong> Certificate for a deceased animal will be marked “cancelled” <strong>and</strong> then returned to the lastregistered owner <strong>of</strong> the animal if requested.C. A castrated stallion may be recorded in the Gelding Section <strong>of</strong> the Stud Book upon application,without fee if the pony was previously registered.D. A castrated registered stallion must be entered in Section E before transfer <strong>of</strong> ownership canbe recorded.14. PENALTY FEES.A. Incorrect or incomplete application forms may incur a penalty fee.B. Application for registration requiring further information will be archived if the requestedinformation is not forthcoming within 90 days. To retrieve the file from archive stores a penalty feewill apply.C. Late penalty fees are the st<strong>and</strong>ard fees for registration <strong>of</strong> the animal for each year theregistration is overdue.15. IMPORTED PONIES.Animals imported into <strong>Australia</strong> may be accepted for registration or entry in the <strong>Society</strong>’s StudBook. Animals must conform to the following regulations:A. Animals must, at the time <strong>of</strong> export, be fully registered with the <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong>(Wales), <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong> <strong>of</strong> New Zeal<strong>and</strong> (Inc.) or any other <strong>Society</strong> recognised by the<strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong> <strong>of</strong> <strong>Australia</strong> Inc.B. Must be DNA Pr<strong>of</strong>iled in the country <strong>of</strong> origin <strong>and</strong> noted on the Export Certificate.C. Each application for the registration or entry <strong>of</strong> an animal imported into <strong>Australia</strong> must beaccompanied by an Export Certificate or Passport issued by the <strong>Society</strong> <strong>of</strong> the country in which theanimal is currently registered at the time <strong>of</strong> export to <strong>Australia</strong>.D. Imported ponies, purchased or leased, must be registered or entered in this <strong>Society</strong>’s StudBook before their progeny can be accepted for registration or entry.E <strong>The</strong> prescribed fee shall accompany each application.16. EXPORTED PONIES.A. Ponies to be exported are to be issued with an Export Certificate.B. Application for the Export Certificate is to be made prior to the departure <strong>of</strong> the pony. <strong>The</strong>Registration Certificate is to be completed on the reverse with the new owner’s details <strong>and</strong> theexport fee as set by the Committee <strong>of</strong> Management is to be paidC. All export stallions require a Certificate <strong>of</strong> Soundness.D. When a pony is to be taken overseas for showing purposes the owner must notify the Officeprior to the pony leaving the country.E. When the pony is sold whilst overseas Regulation 16A, C & D apply <strong>and</strong> the pony will need tobe identified by a registered veterinarian, verifying that the pony is one <strong>and</strong> the same as per theRegistration Certificate identified by its br<strong>and</strong>s & markings.17. OVERSEAS REGISTERED PONIES.Animals bred <strong>and</strong> resident in overseas countries may be accepted for registration or entry in this<strong>Society</strong>’s Stud Book under the existing regulations governing registration <strong>and</strong> entry <strong>of</strong> animals bredin <strong>Australia</strong>. Animals for which registration or entry is applied must also conform to the followingadditional regulations:A. Animals must be by a registered stallion in respect <strong>of</strong> which, if exported, the <strong>Society</strong> with whichthe animal was registered issued an Export Certificate <strong>and</strong> out <strong>of</strong> a registered or entered mare inrespect <strong>of</strong> which, if exported, the <strong>Society</strong> with which the animal was registered issued an ExportCertificate orB. Animals descended from those registered or entered under A above, <strong>and</strong> providing theapplication for registration complies with Regulation 5.4


18. TRANSFER BETWEEN SECTIONS.<strong>The</strong> Editing Committee subject to the following conditions may consider the transfer <strong>of</strong> a pony orcob from one Section to another <strong>and</strong> the transfer may be authorised by the COM.A. Transfer may only be taken from:Section A to Section B, <strong>of</strong> stock which has grown over 12hh.Section C to Section D, <strong>of</strong> stock which has grown over 13.2hh.Section D to Section C, <strong>of</strong> stock seven years or older, which does not exceed 13.2hh.B. <strong>The</strong> request for transfer must be made in writing to the <strong>Society</strong>.C. <strong>The</strong> request must be accompanied by:i. A Certified letter signed by two <strong>Society</strong> Inspectors whose names appear on the current panelfor the Section to which it is proposed to transfer the animal, orii. An EFA/RAS height certificate <strong>and</strong> a recommendation from one <strong>Society</strong> Inspector as describedabove.D. <strong>The</strong> Certified letter must recommend the transfer on the grounds <strong>of</strong> height (certified bymeasurement <strong>of</strong> height, not estimation), type <strong>and</strong> character.19. TRANSFER OF WELSH PONIES FROM OTHER STUD BOOKS.Transfer from an approved Stud Book in <strong>Australia</strong> to the <strong>Australia</strong>n <strong>Welsh</strong> Stud Book:A. Animals currently registered or entered in the <strong>Welsh</strong> Section <strong>of</strong> an approved Stud Book in<strong>Australia</strong> may be transferred to the appropriate section in the AWSB, provided such animalscomply with the regulations governing the Section or Appendix in which it is proposed to register orenter.<strong>The</strong> breeder or the registered owner (if transferred) must provide a photocopy <strong>of</strong> the animal’soriginal Registration Certificate, showing ownership, <strong>and</strong> a four-generation pedigree to the EditingCommittee for consideration before transfer <strong>of</strong> registration may be effected.B. Animals registered with the <strong>Welsh</strong> Section <strong>of</strong> the <strong>Australia</strong>n <strong>Pony</strong> Stud Book (APSB):i. An AWSB registered Prefix <strong>and</strong> Br<strong>and</strong> MUST be used when the animal is registered by thebreeder.ii. When registered by the registered owner <strong>and</strong> the Prefix <strong>and</strong> Br<strong>and</strong> are not registered with theAWSB, (APSB) will be noted after the <strong>Pony</strong>’s name.iii. If the sire <strong>and</strong>/or dam are not registered with the AWSB, but are registered in the <strong>Welsh</strong>Section <strong>of</strong> the APSB, they will be known as Reference animals.iv. If the dam is an APSB FS2 registered mare then the pony being registered MUST be inspectedprior to registration.C. All APSB Foundation Stock Mares (FS, FS1 & FS2) MUST be inspected prior to registrationwith the AWSB.D. <strong>The</strong> AWSB Section to which the animal is entered may not agree with the APSB. <strong>The</strong> AWSBentry <strong>and</strong> calculation <strong>of</strong> the blood level will apply.E. To register a foal with the AWSB, both parents, MUST be registered with the AWSB. This alsoapplies to animals only Foal Recorded with the APSB.20. TRANSFER OF OWNERSHIP.A. It is the responsibility <strong>of</strong> the owner <strong>of</strong> the animal disposing <strong>of</strong> the same, to notify the Secretary<strong>of</strong> the <strong>Society</strong>, surrender the Registration Certificate for endorsement <strong>and</strong> pay the transfer fee.Notification must be received within 60 days <strong>of</strong> completion <strong>of</strong> sale or a penalty fee will apply.B. Membership is compulsory in order to obtain registration papers.C. Notification <strong>of</strong> transfer <strong>of</strong> ownership <strong>of</strong> animals, registered or entered, must be completedbefore registration or entry <strong>of</strong> their progeny can be accepted.D. In case where a pony is sold to a non member <strong>and</strong> then sold to a member the following isrequired:i. A Statutory Declaration signed by the recorded registered owner, acknowledging the transfer<strong>and</strong> identifying the pony that they owned (either by photos or inspection) as the one <strong>and</strong> the samepony as per the Certificate <strong>of</strong> Registration.ii. A Statutory Declaration signed by the new owner acknowledging legal ownership <strong>and</strong>identifying the pony as the one <strong>and</strong> the same pony as per the Registration Certificate.E. Ponies sold without papers:i. <strong>The</strong> Registration Certificate must be returned to the <strong>of</strong>fice noting that the pony has been soldwithout papers.ii. Transfer <strong>of</strong> ownership can only be recorded with written approval from the last registeredowner.F. An Office Administration fee, as set by the Committee <strong>of</strong> Management will apply for transferringall registered ponies owned by the Stud/Membership to a member <strong>of</strong> the family or pursuant to aWill.21. RECORDING A LEASE OF A PONY.A. Where an animal has been leased, the owner <strong>of</strong> the same must complete a Certificate <strong>of</strong>Lease on the appropriate <strong>Society</strong> form, which shall be forwarded to the Secretary <strong>of</strong> the <strong>Society</strong>.B. Both parties must be Financial Members in order to record a lease <strong>of</strong> a pony.C. Notification must be received within 60 days <strong>of</strong> commencement <strong>of</strong> lease or a penalty fee willapply.5


D. In the case <strong>of</strong> colts or stallions this must be done before Certificates <strong>of</strong> Service can be issued<strong>and</strong>, in the case <strong>of</strong> stallions <strong>and</strong> mares or fillies, before registration or entry <strong>of</strong> progeny can beconsidered.E. In order for the lessee to register a pony the following regulations apply:i. <strong>The</strong> lease must be recorded as per above Regulation.ii. <strong>The</strong> breeder or owner must sign the application <strong>and</strong> be Financial Members as per <strong>Regulations</strong>.3.22. JOINT OWNERSHIP OF A PONY.For the <strong>Society</strong> to recognise ownership <strong>of</strong> ponies in two or more membership names:A. All parties:-i. Must be Financial Members in their own right.ii. Enter into a written agreement nominating a signatory/signatories to regulate <strong>and</strong> operate thisJoint Ownership/Co-ownership registration. Copy must be forwarded to the <strong>Society</strong>’s Office. If nowritten agreement is provided, ALL signatories will be required to operate this Joint Ownership/Coownershipregistration.B. Ownership is to be stated as either:i. Joint Ownership.If persons are joint owners then their share in the animal ceases entirely on their death so thatultimately the surviving owner/s owns/own the animal outright.ii. Co-ownership.If persons are Co-owners then each Co-owner is able to separately deal with their share <strong>and</strong> thatshare is not lost on the death <strong>of</strong> the Co-owner but forms part <strong>of</strong> the Co-owners estate to be dealtwith according to his or her will.C. Applications will not be accepted unless accompanied by the appropriate fee/s.D. A transfer fee is paid for each pony attached to this Joint Ownership/Co-ownership registration.E. Joint or Co-Ownership registered mares may be bred from. <strong>The</strong> following applies:i. All parties must be FULL Financial Members in their own right.ii. When registering progeny from the Joint or Co-ownership, a separate Prefix <strong>and</strong> Br<strong>and</strong> may beapplied for. Or the individually registered Prefix <strong>and</strong> Br<strong>and</strong> <strong>of</strong> either <strong>of</strong> the Joint/Co-owners may beused.iii. All parties must sign the Application for Registration form. (This will indicate agreementbetween the parties that the progeny is to be registered as bred <strong>and</strong> owned by the breeder towhom the Prefix <strong>and</strong> Br<strong>and</strong> appearing on the Application form belongs to).iv. <strong>The</strong> appropriate registration <strong>and</strong> transfer fees accompany the Application for Registration <strong>of</strong>progeny.23. SYNDICATES.Any animal registered in the AWSB may be syndicated. <strong>The</strong> following applies:A. <strong>The</strong> Syndicate must be a fully paid up Financial Member <strong>of</strong> the <strong>Welsh</strong> <strong>Pony</strong> <strong>and</strong> <strong>Cob</strong> <strong>Society</strong> <strong>of</strong><strong>Australia</strong> Inc.B. Names <strong>and</strong> addresses for all parties to the Syndicate <strong>and</strong> name <strong>of</strong> the Syndicate Managermust be forwarded to the Secretary <strong>of</strong> the <strong>Society</strong>, together with a copy <strong>of</strong> the legal agreementbetween the parties.C. <strong>The</strong> Syndicate Manager is the nominee for the Syndicate.D. <strong>The</strong> Syndicate Manager <strong>and</strong> the nominated Stud Manager are required to jointly signCertificates <strong>of</strong> Service for every mare served by the syndicated animal.E. <strong>The</strong> Syndicate Manager must inform the Secretary <strong>of</strong> the <strong>Society</strong> annually <strong>of</strong> the name <strong>and</strong>address <strong>of</strong> the Stud Manager.F. Where a pony, registered in the AWSB is syndicated, notification <strong>of</strong> transferring ownership tothe syndicate is required as per Regulation 20.24. APPENDIX FOUNDATION STOCK:<strong>The</strong> following regulations apply for the entry <strong>of</strong> animals in the Foundation Stock Appendix <strong>of</strong> theStud Book:A. Section A:i. Applications will be considered for an FS1 or an FS2 filly by a registered Section A stallion <strong>and</strong>out <strong>of</strong> an FS or an FS1 mare. <strong>The</strong> mare’s height must not exceed 12.0hh, <strong>and</strong> must be entered inthe Appendix in Section A or in an approved Stud Book in <strong>Australia</strong>.ii. <strong>The</strong> filly whose entry is applied for must be approved by a <strong>Society</strong> Inspector as true to type <strong>and</strong>not exceed 12.0hh.B. Section B:i. Applications will be considered for an FS1 or an FS2 filly, by a registered Section A or SectionB stallion <strong>and</strong> out <strong>of</strong> an FS or an FS1 mare. <strong>The</strong> mare’s height must not exceed 13.2hh <strong>and</strong> mustbe entered in the Appendix in Section A or Section B or in an approved Stud Book in <strong>Australia</strong>.ii. <strong>The</strong> filly whose entry is applied for must be approved by a <strong>Society</strong> Inspector as true to type <strong>and</strong>must be 12.0hh <strong>and</strong> not exceed 13.2hh.C. Fillies/mares which may qualify as Section C - FS may be entered in the Appendix at any age.D. Section D:i. Applications were considered for an FS B mare foaled prior to 01/08/1981, by a registeredSection A or Section B stallion out <strong>of</strong> a riding type mare not necessarily in a Stud Book.iv. <strong>The</strong> Foundation Stock (FS) for the Stud Book for section B was closed at 01/08/1999 to allanimals not already registered but born before 01/08/1981.25. FOUNDATION STOCK GENERAL REGULATIONS.In addition to the general regulations the following regulations also apply for the entry <strong>of</strong> animals inthe Foundation Stock Appendix <strong>of</strong> the Stud Book:A. All applications for registration <strong>of</strong> FS, FS1 <strong>and</strong> FS2 mares <strong>and</strong> fillies in all sections must bemade on forms approved by the Committee <strong>of</strong> Management <strong>and</strong> be in the Office by the 31st Julyfollowing birth, not 12 months after birth or a penalty fee will apply as per Regulation 5B.B. A Service Certificate must be provided as per Regulation 11.C. All FS, FS1 or FS2 fillies/mares must be inspected for conformation, height <strong>and</strong> type but notbefore they attain 9 months <strong>of</strong> age. All APSB Foundation Stock Mares (FS, FS1 & FS2) MUST beinspected prior to registration with the AWSB. <strong>The</strong> AWSB calculation <strong>of</strong> the Foundation Stock levelwill apply.D. <strong>The</strong> owner or breeder <strong>of</strong> a pony to be inspected will be responsible for any costs incurred bythe Inspectors.E. Where the inspection <strong>of</strong> an animal occurs, any objection to the verdict <strong>of</strong> the <strong>Society</strong> Inspectorconcerned may be appealed against upon payment <strong>of</strong> a fee to be determined, <strong>and</strong> in such case,the Committee <strong>of</strong> Management would be empowered to appoint two <strong>Society</strong> Inspectors to reviewthe original inspection.F. FS, FS1 <strong>and</strong> FS2 mares <strong>and</strong> fillies are ineligible for exhibition in <strong>Welsh</strong> classes at shows untilthey have been approved by a <strong>Society</strong> Inspector <strong>and</strong> issued with a Registration Number.Registered FS, FS1 <strong>and</strong> FS2 mares are eligible for exhibition in <strong>Welsh</strong> classes.G. Female progeny <strong>of</strong> FS <strong>and</strong> FS1 Mares by <strong>Welsh</strong> registered stallions may be registered ineither the Foundation Stock section <strong>of</strong> the Stud Book or the Part <strong>Welsh</strong> Register.H. Male progeny <strong>of</strong> FS <strong>and</strong> FS1 Mares by <strong>Welsh</strong> registered stallions may be registered asgeldings in Section E or as Part <strong>Welsh</strong> colts, geldings or stallions in the Part <strong>Welsh</strong> Register.I.Once the animal is registered it must remain in that Section <strong>and</strong>/or Register <strong>of</strong> the Stud Book forlife.J.<strong>The</strong> <strong>Society</strong> will not accept in the Appendix Section A - FS, FS1 or FS2 the progeny <strong>of</strong> a sire ordam whose breeding cannot be authenticated. That is:i. Those stallions in the <strong>Australia</strong>n <strong>Pony</strong> Stud Book which are by or from an unregistered sire ordam.ii. Those mares in the <strong>Australia</strong>n Foundation Mare (WA) Section <strong>of</strong> the <strong>Australia</strong> <strong>Pony</strong> Stud Book.However, the female progeny <strong>of</strong> an acceptable Section A or B stallion <strong>and</strong> a mare in the <strong>Australia</strong>nFoundation Mare (WA) Section <strong>of</strong> the <strong>Australia</strong>n <strong>Pony</strong> Stud Book may be accepted into the7


Appendix Section B - FS subject to inspection by a <strong>Society</strong> Inspector providing it has attained theheight <strong>of</strong> 12.00hh <strong>and</strong> does not exceed 13.2hh <strong>and</strong> was foaled prior to 1st August 1981.26. PART WELSH REGISTER.In addition to the general regulations the following regulations also apply for the entry <strong>of</strong> animals inthe Part-<strong>Welsh</strong> Register <strong>of</strong> the Stud Book:A. A Part <strong>Welsh</strong> pony, horse or cob, either male or female will be accepted for entry into the Part<strong>Welsh</strong> register provided that the breeding <strong>of</strong> the animal shows 12.5% <strong>Welsh</strong> blood registered witha recognised <strong>Welsh</strong> Stud Book calculated from either sire or dam, or cumulative from both.Approved Societies are the <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong> <strong>of</strong> <strong>Australia</strong>, <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong>UK, <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong> NZ, approved overseas <strong>Welsh</strong> Societies <strong>and</strong> the <strong>Welsh</strong> Section <strong>of</strong>the <strong>Australia</strong>n <strong>Pony</strong> Stud Book.B. Entries will be accepted for ponies, horses or cobs <strong>of</strong> any age.C. Entries will be accepted without inspection, subject to the condition that the Committee <strong>of</strong>Management can require inspection should it be considered necessary or desirable.D. Application forms for the entry <strong>of</strong> Part <strong>Welsh</strong> into the Register will only be accepted from FullFinancial Members.E. A Part <strong>Welsh</strong> animal must have an AWSB registered Prefix <strong>and</strong> Br<strong>and</strong> when registered by theBreeder. Refer Regulation 7.F. A Part <strong>Welsh</strong> animal being registered by a person other than the Breeder, when the Prefix isnot recorded with the AWSB but is recorded with a recognized Stud Book <strong>Society</strong>, that <strong>Society</strong>’sinitials will appear after the animal’s name (ie: RPSB, APSB, etc). A copy <strong>of</strong> the animal’sRegistration Certificate with the relevant recognized Stud Book <strong>Society</strong> is required for pro<strong>of</strong> <strong>of</strong>registration <strong>and</strong> ownership.G. Applications for stallion registration must be accompanied by a Veterinary Certificate <strong>of</strong>Soundness for Breeding. Refer Regulation 9.H. In the case <strong>of</strong> a colt, whose birth has been notified as provided in the preceding clause,application for stallion registration must be made before such a colt attains the age <strong>of</strong> four years,<strong>and</strong> not before two years <strong>of</strong> age.I. Where the <strong>Welsh</strong> blood is calculated from the sire, he must be stallion registered for progeny tobe eligible for entry into the Part <strong>Welsh</strong> Register.J. Where a sire <strong>and</strong>/or dam is not registered with the AWSB, pro<strong>of</strong> <strong>of</strong> ownership <strong>and</strong> breeding isrequired via copy <strong>of</strong> Certificate <strong>of</strong> Registration with another <strong>Society</strong>, to be submitted with the Part<strong>Welsh</strong> application.K. If a sire <strong>and</strong>/or dam is unregistered, the sire <strong>and</strong>/or dam owner must sign the ServiceCertificate <strong>and</strong> sire <strong>and</strong>/or dam will be recorded as unregistered (UR) with the AWSB.L. A Certificate <strong>of</strong> Service must accompany each application as per Regulation 11, except wherea Registration Certificate <strong>of</strong> the animal being registered is provided from an approved <strong>Society</strong>.M. Mares entered in the Part-<strong>Welsh</strong> Register will not be accepted to produce Foundation Stock(FS) in Sections A B or C but may be accepted to produce Foundation Stock in Section D providedthey exceed 13.2hh until closure <strong>of</strong> FS Section D on 1/8/2001.N. Identification will be by the initials PW - M/S/G/C (i.e.: Mare, Stallion, Gelding or Colt) <strong>and</strong> theregistration number.O. Ponies, horses <strong>and</strong> cobs entered in the Part <strong>Welsh</strong> Register <strong>of</strong> the <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong><strong>of</strong> <strong>Australia</strong> Inc. are NOT eligible to compete for <strong>Welsh</strong> Championships or Supreme <strong>Welsh</strong> Exhibitawards. <strong>The</strong>y are only eligible to compete in the Part <strong>Welsh</strong> section which is provided for them atshows conducted by or on behalf <strong>of</strong> the <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong> <strong>of</strong> <strong>Australia</strong> Inc. unless it isspecifically stated that they are eligible for a particular class or award.27. ARTIFICIAL INSEMINATION.Definitionsi AI: means Artificial Insemination which is the artificial introduction <strong>of</strong> semen into the genitaltract <strong>of</strong> the female as compared with natural insemination in which semen is introduced into thefemale genital tract by the male at the time <strong>of</strong> copulation.ii AI Permit: means a Permit issued by the <strong>Society</strong> to a Stallion for life permitting semen to becollected <strong>and</strong> used for the insemination <strong>of</strong> a Mare.iii AI Technician: means a person who has satisfied the <strong>Society</strong> either by examination,recommendation, reputation or otherwise that he/she/they possess such skills as will permithim/her/them to carry out the procedures necessary to comply with the provisions <strong>of</strong> these rules inrelation to the collecting <strong>of</strong> semen <strong>and</strong> preservation <strong>of</strong> same, <strong>and</strong> the artificial inseminating <strong>of</strong>mares with semen whether such semen be frozen, chilled or fresh <strong>and</strong> to whom the <strong>Society</strong> hasgranted a Permit in identification under these rules on such terms <strong>and</strong> conditions as the<strong>Society</strong> thinks fit.iv DNA Pr<strong>of</strong>iling: means Veterinary sampling <strong>of</strong> hair follicles/blood semen accompanyingdescription <strong>of</strong> identification so as to establish a horse’s particular DNA for the purpose <strong>of</strong> parent orprogeny verification.v Owner: means the owner <strong>of</strong> any stallion or mare used hereunder, or the lessee <strong>of</strong> such or theduly appointed agent <strong>of</strong> such owner or lessee.8


vi Breeding Season: means a period <strong>of</strong> 12 months commencing on the 1st day <strong>of</strong> August in eachyear.vii Ultrasound: means the use <strong>of</strong> high frequency sound to image internal structures for pregnancydiagnosis.A. <strong>The</strong> <strong>Society</strong> shall not be obliged to register any foal born by Artificial Insemination or other thanby means <strong>of</strong> natural service unless the registration or recording <strong>of</strong> the birth <strong>of</strong> such foal by the<strong>Society</strong> is sought in accordance with the provisions <strong>of</strong> these rules. <strong>The</strong> <strong>Society</strong> may limit thenumber <strong>of</strong> foals registered by AI stallions in one breeding season.B. <strong>The</strong> owner <strong>of</strong> any stallion (“the stallion”) used in accordance with the provisions <strong>of</strong> these rules,shall be current Financial Members <strong>of</strong> the <strong>Society</strong> at the time <strong>of</strong> issue <strong>of</strong> the Permit, <strong>and</strong> at the time<strong>of</strong> collection <strong>of</strong> semen.C. Subject to Regulation Q <strong>and</strong> R here<strong>of</strong>:i All stallions <strong>and</strong> all mares to be used in conjunction with these <strong>Rules</strong> must be duly registered inaccordance with the rules <strong>of</strong> the <strong>Society</strong> from time to time <strong>and</strong> must be DNA Pr<strong>of</strong>iled according tothe requirements <strong>of</strong> the rules <strong>of</strong> the <strong>Society</strong>.ii Stallions <strong>and</strong> mares to be used for AI must be DNA Pr<strong>of</strong>iled, however, where semen is takenfrom the stallion <strong>and</strong> directly inseminated into the mare, having been at all times in the possession<strong>of</strong> the Veterinarian <strong>and</strong>/or AI Technician, that mare is not required to be DNA Pr<strong>of</strong>iled. ADeclaration to be signed by Veterinarian or AI Technician to this effect.D. No stallion shall be used (collected) by any person under the provisions <strong>of</strong> these rules unlessan AI Permit in the form prescribed is first obtained <strong>and</strong> the appropriate fee is paid in respect <strong>of</strong>such Permit by a person who is referred to in Regulation 27B hereto. No person, who is not anowner as defined in these <strong>Rules</strong> shall be entitled to nor shall apply to the <strong>Society</strong> for an AI Permitfrom the <strong>Society</strong>. If leased, written confirmation signed by the lessor is required to be forwarded tothe <strong>of</strong>fice prior to the issue <strong>of</strong> a Permit. Any Permit issued by the <strong>Society</strong> shall be issued for life<strong>and</strong> the permit must be transferred for a Transfer fee (payable by the transferee) when the Stallionis sold. Any semen held at the time <strong>of</strong> transfer remains the property <strong>of</strong> the owner at the time <strong>of</strong>collection.E. A separate Permit shall be required for each stallion intended to be used under these rules <strong>and</strong>must be applied for before semen is collected <strong>and</strong> before any mare is inseminated with semenfrom such stallion.F. Before commencing to use a Mare in any one breeding season for AI, the registered ownermust notify in writing the <strong>of</strong>fice <strong>of</strong> the <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong> <strong>of</strong> <strong>Australia</strong> Inc., the Mare’s name<strong>and</strong> registration number, <strong>and</strong> intention to use the Mare for AI. Application is to be made for a DNAKit with appropriate fees, or pro<strong>of</strong> that the Mare has been DNA pr<strong>of</strong>iled. If the Mare is leased,written confirmation signed by the lessor is required to be forwarded to the <strong>of</strong>fice before the DNAKit will be forwarded <strong>and</strong> before any insemination takes place.G. <strong>The</strong> collection <strong>of</strong> semen from any stallion to which these rules apply must be made under thedirect personal supervision <strong>of</strong> a duly registered <strong>and</strong> practising Veterinarian or personally by an AITechnician whose qualifications for such collections are accepted by the <strong>Society</strong>. <strong>The</strong> <strong>Society</strong> mayaccept or reject the qualification <strong>of</strong> any AI Technician in its absolute discretion without beingrequired to give reasons in respect there<strong>of</strong>.H. <strong>The</strong> processing <strong>and</strong> storage <strong>of</strong> semen must be carried out by a Veterinarian or a qualified AITechnician according to good clinical practice for the collection <strong>and</strong> storage <strong>of</strong> semen <strong>and</strong> only inaccordance with <strong>Rules</strong> (if any) made from time to time in respect there<strong>of</strong> by the <strong>Society</strong>. Semen tobe preserved, must be transferred to a sterile container which container shall be sealed, identified<strong>and</strong> signed by both the owner <strong>and</strong> his/her/their appointed agent <strong>and</strong> the Veterinarian or such AITechnician who has collected such semen <strong>and</strong> shall be signed in the presence <strong>of</strong> each other at theone time.I. All persons registered as owners <strong>of</strong> a recorded AI Stallion must:i Lodge a report <strong>of</strong> semen collected for AI with the <strong>Society</strong> within 30 days <strong>of</strong> Collection.ii Prepare <strong>and</strong> maintain an annual report <strong>of</strong> any semen held/used/disposed <strong>of</strong> in accordance withthe form prescribed by the <strong>Society</strong> from time to time. It must be specified whether such servicewas by means <strong>of</strong> fresh, chilled or frozen semen. <strong>The</strong> report must also specify any semen held ordisposed <strong>of</strong>, the name <strong>of</strong> the storage centre <strong>and</strong> be signed by the recorded owner or his agent (A.I.storage centre).iii Such forms, duly completed in accordance with these <strong>Rules</strong> must be returned to the <strong>Society</strong> by31st July each year <strong>and</strong> unless the <strong>Society</strong> has received such a form in which the details <strong>of</strong> suchsemen held/used/disposed <strong>of</strong> have been recorded in accordance with these rules, no foal that isborn <strong>and</strong> subsequently sought to be registered by such service shall be registered by the <strong>Society</strong>.iv Registered owners <strong>of</strong> AI recorded Stallions that have been sold must notify the <strong>of</strong>fice at thetime <strong>of</strong> transfer, details <strong>of</strong> any semen which has been retained by them, <strong>and</strong> comply withregulations (ii) <strong>and</strong> (iii) above.J. Semen may only continue to be used after the death or gelding <strong>of</strong> a stallion provided that suchsemen has been collected <strong>and</strong> stored in accordance with the requirements <strong>of</strong> the <strong>Society</strong> current atthe time <strong>of</strong> collection <strong>of</strong> such semen.9


K. AI service certification in respect <strong>of</strong> which a service has been provided under these <strong>Rules</strong> shallbe signed by the owner to whom such certificates have been issued in respect <strong>of</strong> any progenysought to be registered under these rules. <strong>The</strong> owner <strong>of</strong> the stallion from which such semen hasbeen collected shall notify the <strong>Society</strong> in writing <strong>of</strong> the particulars <strong>of</strong> any agent authorised to sign AIService Certificates on such owner’s behalf. No certificate shall be signed by any person on behalf<strong>of</strong> the owner until the particulars <strong>of</strong> such person have been registered with the <strong>Society</strong> inaccordance with the requirements <strong>of</strong> the <strong>Society</strong> from time to time.L. Any insemination <strong>of</strong> any mares under the provision <strong>of</strong> these rules shall be carried out under thedirect personal supervision <strong>of</strong> a duly licensed <strong>and</strong> practising Veterinarian or personally by an AITechnician who is acceptable to the <strong>Society</strong> under these rules <strong>and</strong> such Veterinarian or AITechnician shall countersign the AI Service Certificate at the time <strong>and</strong> place <strong>of</strong> such service.M. If a mare is served by both AI <strong>and</strong> natural service methods within 42 days <strong>of</strong> each such serviceany foal born will be considered progeny to which these rules apply unless pro<strong>of</strong> <strong>of</strong> age <strong>of</strong> foetus bya Veterinarian by ultrasound is provided to the <strong>Society</strong>.N. Any foal born as a result <strong>of</strong> insemination under these rules must be DNA Pr<strong>of</strong>iled at the cost <strong>of</strong>the owner <strong>of</strong> such foal according to the requirements <strong>of</strong> the <strong>Society</strong> from time to time <strong>and</strong> shall beidentified by a Veterinarian on the <strong>Society</strong>’s AI Application for Registration form which form must belodged with the <strong>Society</strong> by the 31st July in the foaling year. <strong>The</strong> registration <strong>of</strong> the foal will only beaccepted by the <strong>Society</strong> if no DNA Pr<strong>of</strong>iling exclusion occursO. Subject to these <strong>Rules</strong> all progeny born from AI service where such progeny is accepted underthese <strong>Rules</strong> will be recorded as progeny born by such service in the AWSB subject to the payment<strong>of</strong> the fees payable in respect <strong>of</strong> such registration.P. <strong>The</strong> <strong>Society</strong> may from time to time delegate to its Secretary or other employee the power toissue Permits under these rules <strong>and</strong> the power to receive Certificates <strong>and</strong> other documentshereunder.Q. Nothing in these <strong>Rules</strong> shall affect the registration <strong>of</strong> progeny produced by naturalinsemination.R. <strong>The</strong> owner <strong>of</strong> a stallion to whom these <strong>Rules</strong> apply <strong>and</strong> the semen <strong>of</strong> which stallion is intendedto be exported from <strong>Australia</strong> shall at least one month prior to its export notify the <strong>Society</strong> on theprescribed form <strong>of</strong> the intention <strong>of</strong> such owner to export such semen <strong>and</strong> such owner shall provideto the <strong>Society</strong> such information as it requires from time to time in respect <strong>of</strong> such stallion <strong>and</strong> suchsemen including the method <strong>of</strong> collection <strong>and</strong> storage <strong>of</strong> such semen <strong>and</strong> shall pay to the <strong>Society</strong>the fee prescribed from time to time by the <strong>Society</strong> in respect <strong>of</strong> filing with the <strong>Society</strong> <strong>of</strong> suchforms. Upon completion <strong>of</strong> required documentation an AI Export Certificate will be issued.S. Use <strong>of</strong> Imported Semeni <strong>The</strong> stallion must be registered in the appropriate Section <strong>of</strong> a <strong>Welsh</strong> Stud Book recognised bythe <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong> <strong>of</strong> <strong>Australia</strong>. <strong>The</strong> Stallion must in addition be or have been licensed<strong>and</strong> DNA Pr<strong>of</strong>iled in accordance with the rules <strong>of</strong> the appropriate Stud Book in that country.ii <strong>The</strong> semen from the stallion must be collected <strong>and</strong> stored in strict compliance with theregulations covering the export <strong>of</strong> equine semen from the country in which the stallion is resident.iii Copies <strong>of</strong> the stallions registration papers, licence, DNA Pr<strong>of</strong>iling report <strong>and</strong> extended pedigreemust be lodged with the secretary <strong>of</strong> the <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong> <strong>of</strong> <strong>Australia</strong> with theApplication for registration <strong>of</strong> progeny.iv Imported semen must at all times meet the requirements <strong>of</strong> the <strong>Australia</strong>n Quarantine <strong>and</strong>Inspection Service (AQIS) in addition to the conditions laid down by the <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong><strong>of</strong> <strong>Australia</strong>.v <strong>The</strong> regulations governing the storage <strong>and</strong> use <strong>of</strong> imported semen once it arrives in <strong>Australia</strong>are as laid down by the <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong> <strong>of</strong> <strong>Australia</strong> for the storage <strong>and</strong> use <strong>of</strong> semencollected in <strong>Australia</strong>.T. Any person seeking to register Part <strong>Welsh</strong> Progeny born under the provisions <strong>of</strong> these rulesshall:i Comply with these <strong>Rules</strong> as if the progeny sought to be registered by the stallion <strong>and</strong> from themare to which these <strong>Rules</strong> apply <strong>and</strong> must comply with requirements <strong>of</strong> these <strong>Rules</strong> <strong>and</strong> theregulations for recording animals in the Part <strong>Welsh</strong> Register.ii Where a registered stallion or mare is used in an AI program to produce Part <strong>Welsh</strong> progeny,the regulations governing the use <strong>of</strong> AI in pure bred stock must be complied with.iii In the case <strong>of</strong> the use <strong>of</strong> a stallion not eligible for registration with the <strong>Society</strong>, <strong>and</strong> intended tobe used under these <strong>Rules</strong> to produce Part <strong>Welsh</strong> progeny, such stallion must be currently adultregistered with a body approved <strong>of</strong> by the <strong>Society</strong> <strong>and</strong> documentary evidence <strong>of</strong> its identity <strong>and</strong>evidence <strong>of</strong> compliance with such body’s AI rules (if any) must be supplied to the <strong>Society</strong> with theapplication to register the progeny. Should the body with which the stallion is registered have norules as to the use <strong>of</strong> AI or where in the opinion <strong>of</strong> the <strong>Society</strong>, such rules are not <strong>of</strong> a st<strong>and</strong>ard thatwill ensure that any progeny to be registered will be sufficiently identified as having been born bysuch procedure, then the <strong>Society</strong> shall not be required to register such progeny.iv In the case <strong>of</strong> a mare not eligible for registration with the <strong>Society</strong> <strong>and</strong> intended to be usedunder these <strong>Rules</strong> to produce Part <strong>Welsh</strong> progeny, such mare must be currently adult registeredwith a body approved <strong>of</strong> by the <strong>Society</strong> <strong>and</strong> documentary evidence <strong>of</strong> its identity <strong>and</strong> evidence <strong>of</strong>10


compliance with such body’s AI rules (if any) must be supplied to the <strong>Society</strong> with the application toregister the progeny. <strong>The</strong> insemination <strong>of</strong> such mare shall be in accordance with the rules <strong>of</strong> suchbody or where such body has no rules as to the insemination <strong>of</strong> such mare or where, in the opinion<strong>of</strong> the <strong>Society</strong>, such rules are not <strong>of</strong> a st<strong>and</strong>ard that will ensure that any progeny to be registeredwill be sufficiently identified as having been born by such service, the <strong>Society</strong> shall not be requiredto register such birth.v Part <strong>Welsh</strong> progeny which are produced by AI methods in accordance with these rules <strong>and</strong>subject to the rules governing entry into the Part <strong>Welsh</strong> Register (Reg 26) will be recorded as suchin the Register.28. EMBRYO TRANSFER.Definitionsi ET: means Embryo Transfer which is the flushing <strong>of</strong> embryo/s from a donor mare <strong>and</strong> theintroduction <strong>of</strong> the flushed embryo/s to recipient mare/s.ii ET Permit: means a Permit issued by the <strong>Society</strong> for any breeding year commencing on the1st day <strong>of</strong> August permitting the use <strong>of</strong> a mare as a donor from which embryos are collected.iii ET Technician: means a person who has satisfied the <strong>Society</strong> either by examination,recommendation, reputation or otherwise that he/she/they possesses such skills as will permithim/her/them to carry out the procedures necessary to comply with the provisions <strong>of</strong> these <strong>Rules</strong> inrelation to the flushing <strong>of</strong> mares <strong>and</strong> the freezing <strong>and</strong> storage <strong>of</strong> embryos <strong>and</strong> the implantation <strong>of</strong>such embryos in a recipient mare.iv DNA Pr<strong>of</strong>iling: means Veterinary sampling <strong>of</strong> hair follicles/blood/semen accompanyingdescription <strong>of</strong> identification so as to establish a horse’s particular DNA for the purpose <strong>of</strong> parent orprogeny verification.v Breeding year: means a period <strong>of</strong> 12 months commencing on the 1st day <strong>of</strong> August in eachyear.vi AI: means Artificial Insemination which is the artificial introduction <strong>of</strong> semen into the genitaltract <strong>of</strong> the female, as compared with natural insemination in which semen is introduced into thefemale genital tract by the male at the time <strong>of</strong> copulation.Vii Owner: means the owner <strong>of</strong> any stallion or mare used hereunder, or the lessee <strong>of</strong> such or theduly appointed agent <strong>of</strong> such owner or lessee.viii <strong>The</strong> <strong>Society</strong>: means the <strong>Welsh</strong> <strong>Pony</strong> <strong>and</strong> <strong>Cob</strong> <strong>Society</strong> <strong>of</strong> <strong>Australia</strong> Incorporated.ix Ultrasound: means the use <strong>of</strong> high frequency sound to image internal structures for pregnancydiagnosis.A. <strong>The</strong> owners <strong>of</strong> any stallion (“the stallion”) or mare (“the mare”) used in accordance with theprovision <strong>of</strong> these <strong>Rules</strong> shall be current Financial Members <strong>of</strong> the <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong> <strong>of</strong><strong>Australia</strong> Inc. (“the <strong>Society</strong>”) at the time <strong>of</strong> issue <strong>of</strong> the permit.B. Donor mares from which embryos are collected for use under these rules must be registeredwith the <strong>Society</strong>, DNA Pr<strong>of</strong>iled according to <strong>Society</strong> requirements <strong>and</strong> be issued with the <strong>Society</strong>’sET permit prior to embryos being collected. If leased, written confirmation signed by the lessor isrequired to be forwarded to the <strong>of</strong>fice prior to the issue <strong>of</strong> Permit.C. An ET Permit is issued only for one breeding year <strong>and</strong> cannot be extended or transferred <strong>and</strong>is not valid for any subsequent breeding year. No person shall apply to the <strong>Society</strong> for more thanone ET Permit in respect <strong>of</strong> any one mare in any one breeding season.D. Stallions used in an ET program must be registered with the <strong>Society</strong> <strong>and</strong> be DNA Pr<strong>of</strong>iledaccording to <strong>Society</strong> requirements. If the donor mare is to be served by any method other than bynatural service, the <strong>Rules</strong> appropriate to such forms <strong>of</strong> service must be complied with in addition tothe provisions <strong>of</strong> these <strong>Rules</strong>. If AI is to be used, the owner must first comply with the <strong>Society</strong>’s AIrequirements.E. A permit to use ET will be issued by the <strong>Society</strong> upon the owner <strong>of</strong> a registered donor marelodging with the <strong>Society</strong> a duly executed <strong>and</strong> completed ET Permit Application in the formprescribed by the <strong>Society</strong>, accompanied by the fee decided by the <strong>Society</strong> from time to time.F. No more than two foals born under these <strong>Rules</strong> from any one donor mare in any one breedingseason may be registered with the <strong>Society</strong>.G. No foal that is born after embryo transfer shall be registered with the <strong>Society</strong> unless anapplication has been lodged before 31st July in the foaling year.H. No donor mare shall be aged less than 36 calendar months from its actual date <strong>of</strong> birth at thetime <strong>of</strong> collection <strong>of</strong> embryos to be used under these <strong>Rules</strong> <strong>and</strong> no ET Certificate shall be issued inrespect <strong>of</strong> any such mare until the mare is aged in excess <strong>of</strong> two years <strong>of</strong> age from its actual date<strong>of</strong> birth as at the 1st August one year preceding the breeding season for which an ET Certificate isapplied for.I. <strong>The</strong> documentation <strong>of</strong> service preceding Embryo Transfer shall be dealt with in accordancewith the procedures prescribed by the <strong>Society</strong> as for when natural service occurs, <strong>and</strong> both thestallion <strong>and</strong> mare are in the one ownership.J. All stages <strong>of</strong> the Embryo Transfer including, but without limiting the foregoing, the flushing fromthe donor mare, the introduction <strong>of</strong> the flushed embryo to the recipient mare <strong>and</strong>/or the freezing<strong>and</strong> storage <strong>of</strong> embryos, must be carried out by a duly registered <strong>and</strong> practising Veterinarian or byan ET Technician whose qualifications for such collection are accepted by the <strong>Society</strong>. <strong>The</strong>11


<strong>Society</strong> may accept or reject the qualification <strong>of</strong> any such ET Technician in its absolute discretionwithout being required to give reason in respect there<strong>of</strong>.K. Within 15 days <strong>of</strong> embryo collection, the owner <strong>of</strong> the donor mare shall lodge with the <strong>Society</strong> acertificate countersigned by the Veterinarian or Technician specifying the date on which suchcollection <strong>and</strong>/or implantation or storage took place. Stored embryos must be transferred to acontainer/s, sealed, separately identified <strong>and</strong> signed by the owner, or his/her/their appointed agent,<strong>of</strong> the donor mare <strong>and</strong> the Veterinarian or Technician who actually effected the flushing <strong>of</strong> suchembryos <strong>and</strong> their storage.L. Embryos that have been frozen under the provision <strong>of</strong> these <strong>Rules</strong> remain the property <strong>of</strong> theregistered owner <strong>of</strong> the donor mare at the time <strong>of</strong> collection. If sold or otherwise dealt with, suchembryo must be transferred or otherwise dealt with in accordance with these <strong>Rules</strong>. No progenyborn as a result <strong>of</strong> the use <strong>of</strong> embryos the property in which is transferred other than in accordancewith these <strong>Rules</strong> shall be registered by the <strong>Society</strong>.M. <strong>The</strong> owner <strong>of</strong> any embryo may transfer such embryo only in accordance with these <strong>Rules</strong>. <strong>The</strong>owner <strong>of</strong> any Embryo that has been sold must lodge with the <strong>Society</strong> a Certificate <strong>of</strong> Transfer <strong>of</strong>ownership <strong>of</strong> embryo before any implantation takes place or within 21 days <strong>of</strong> sale <strong>of</strong> embryo whichever occurs first, <strong>and</strong> pay the fee set by the <strong>Society</strong> from time to time. Upon receipt <strong>of</strong> transfersigned by the owner or his/her/their Agent <strong>and</strong> the Purchaser <strong>and</strong> payment <strong>of</strong> the appropriate feeset by the <strong>Society</strong>, such transfer will be registered by the <strong>Society</strong>.N. Within 60 days <strong>of</strong> Embryo Transfer to a recipient mare taking place, the registered owner <strong>of</strong> thedonor mare, or when the embryo has been transferred under the <strong>Rules</strong>, the registered owner <strong>of</strong> thefrozen embryo, shall lodge with the <strong>Society</strong> a certificate <strong>of</strong> positive pregnancy <strong>of</strong> the recipient maresigned by a Veterinarian or Technician who has personally examined such mare, which must bepositively identified by the Veterinarian on the pregnancy certificate. If such a certificate is notlodged with the <strong>Society</strong> as foresaid, the progeny born shall not be capable <strong>of</strong> registration underthese or any other <strong>Rules</strong> <strong>of</strong> the <strong>Society</strong>.O. In the event that the recipient mare fails to become pregnant from Embryo Transfer <strong>and</strong> theprocedure <strong>of</strong> collection <strong>and</strong> transfer <strong>of</strong> the embryo is repeated, then new certificates <strong>of</strong> transfer<strong>and</strong> pregnancy (as described in Regulation M <strong>and</strong> N here<strong>of</strong>) shall be provided to the <strong>Society</strong> inrespect <strong>of</strong> every repeated procedure.P. All persons holding a Permit under these rules must:i Lodge a report <strong>of</strong> embryos collected with the <strong>Society</strong> within 15 days <strong>of</strong> collection.ii Prepare <strong>and</strong> maintain an annual report <strong>of</strong> any embryo held/used/disposed <strong>of</strong> in accordancewith the form prescribed by the <strong>Society</strong> from time to time. It must specify whether such embryowas used by means <strong>of</strong> fresh or frozen. <strong>The</strong> report must also specify any embryo held or disposed<strong>of</strong>, the name <strong>of</strong> the storage centre <strong>and</strong> be signed by the Permit holder or his agent (storagecentre).iii Such forms, duly completed in accordance with these rules must be returned to the <strong>Society</strong> by31st July each year <strong>and</strong> unless the <strong>Society</strong> has received such a form in which the details <strong>of</strong> suchembryos held/used/disposed <strong>of</strong> have been recorded in accordance with these <strong>Rules</strong>, no foal that isborn <strong>and</strong> subsequently sought to be registered by such service shall be registered by the <strong>Society</strong>.Q. Foals born to ET must be DNA Pr<strong>of</strong>iled according to <strong>Society</strong> requirements <strong>and</strong> identified by aVeterinarian on an ET Application for Registration form lodged with the <strong>Society</strong> by the 31st July inthe foaling year. <strong>The</strong> registration <strong>of</strong> the foal will only be accepted if no DNA Pr<strong>of</strong>iling exclusionoccurs when comparison is effected with the sire <strong>and</strong> donor mare.R. ET progeny born under these <strong>Rules</strong> will be identified as such in the <strong>Society</strong>’s Stud Book.S. <strong>The</strong> owner <strong>of</strong> an embryo which is to be exported from <strong>Australia</strong> shall at least one month prior toits export, notify the <strong>Society</strong> on the prescribed form <strong>of</strong> the intention to export such embryo <strong>and</strong> payto the <strong>Society</strong> the fee prescribed from time to time by the Committee <strong>of</strong> Management for lodging <strong>of</strong>such form; upon completion <strong>of</strong> required documentation an ET Export Certificate will be issued.T. Where a registered stallion or registered donor mare is used in an ET program to produce Part<strong>Welsh</strong> progeny regulations governing use <strong>of</strong> ET in pure bred stock must be complied with, subjectto the following rules.i In the case <strong>of</strong> the use <strong>of</strong> a stallion not eligible for registration with the <strong>Society</strong> <strong>and</strong> intended tobe used under these <strong>Rules</strong> to produce Part <strong>Welsh</strong> progeny, such stallion must be currently adultregistered with a body approved by the <strong>Society</strong> <strong>and</strong> documentary evidence <strong>of</strong> its identity <strong>and</strong>evidence <strong>of</strong> compliance with such body’s ET rules (if any) must be supplied to the <strong>Society</strong> with theapplication to register the progeny. Should the body with which the stallion has been registeredhave no rules as to the collection <strong>and</strong> use <strong>of</strong> ET or where, in the opinion <strong>of</strong> the <strong>Society</strong>, such rulesare not <strong>of</strong> a st<strong>and</strong>ard that will ensure that any progeny to be registered will be sufficiently identifiedas having been born by such procedures, then the <strong>Society</strong> shall not be required to register suchprogeny.ii In the case <strong>of</strong> a donor mare not eligible for registration with the <strong>Society</strong> <strong>and</strong> intended to beused under these <strong>Rules</strong> to produce Part <strong>Welsh</strong> progeny, such donor mare must be currently adultregistered with a body approved by the <strong>Society</strong> <strong>and</strong> documentary evidence <strong>of</strong> its identity <strong>and</strong>evidence <strong>of</strong> its compliance with such body’s ET rules (if any) must be supplied to the <strong>Society</strong> withthe application to register the progeny. <strong>The</strong> flushing <strong>of</strong> such mare shall be in accordance with the12


ules as to the flushing <strong>of</strong> the mare or where such body has no rules as to the flushing <strong>of</strong> the mareor where, in the opinion <strong>of</strong> the <strong>Society</strong> such rules are not <strong>of</strong> a st<strong>and</strong>ard that will ensure that anyprogeny to be registered will be sufficiently identified as having been born from such donor mare bysuch procedures, then the <strong>Society</strong> shall not be required to register such birth.iii Part <strong>Welsh</strong> progeny which are produced by ET methods in accordance with these rules will berecorded as such in the Register.U. <strong>The</strong> <strong>Society</strong> may from time to time delegate to its Secretary or other employee the power toissue Permits under these rules <strong>and</strong> the power to receive Certificates or other documentshereunder.V. Nothing in these <strong>Rules</strong> shall affect the registration <strong>of</strong> progeny produced by natural means.29. DNA PROFILING.A. All stallions must be DNA Pr<strong>of</strong>iled prior to being approved for registration. <strong>The</strong> Veterinarianmay take the DNA sample when they complete the Veterinary Certificate. <strong>The</strong> stallion will not beadult registered until the <strong>Society</strong> has received the DNA result.B. For r<strong>and</strong>om testing, the DNA samples may be taken by a Committee <strong>of</strong> Managementnominated Veterinarian or two persons nominated by the Committee <strong>of</strong> Management in thepresence <strong>of</strong> each other <strong>and</strong> the registered owner or their nominee.30. COMPLAINTS.A. A Member who complains as to the correctness <strong>of</strong> pedigree <strong>of</strong> any pony or cob registered withthe <strong>Society</strong> shall deposit with the <strong>Society</strong> a sum, to be determined by the Committee <strong>of</strong>Management, <strong>and</strong> submit a signed statement substantiating their complaint.B. If following investigation the complaint is deemed by the <strong>Society</strong> to be well founded the sumwill be repaid.C. If following investigation the complaint is deemed by the <strong>Society</strong> to be ill founded the sum willbe forfeited.31. ERRORS.A. In the event <strong>of</strong> any error or omission by the <strong>Society</strong> <strong>of</strong> any <strong>of</strong>ficer, servant or agent <strong>of</strong> the<strong>Society</strong> resulting in registration or entry contrary to any <strong>of</strong> the foregoing regulations, the <strong>Society</strong>shall investigate <strong>and</strong> hereafter:i Confirm registration or entry notwithst<strong>and</strong>ing the fact that it was made contrary to one or more<strong>of</strong> the above regulations, orii Extend any time stipulated by the said regulations <strong>and</strong> allow a fresh application for registrationor entry to be made, oriii Refuse to confirm the registration or entry <strong>and</strong> order it to be deleted.B. In the event <strong>of</strong> any error or omission by the breeder <strong>and</strong>/or owner who registered the pony thefollowing applies:i. Written notification <strong>of</strong> the error is to be submitted to the <strong>of</strong>fice.ii. Payment <strong>of</strong> the duplicate certificate fee is required.C. Errors or omissions reported after the relevant Stud Book has gone to print may be recorded inthe Errata <strong>of</strong> subsequent Stud Books.32. CHANGES TO REGISTRATION CERTIFICATES.A. If the pony has been br<strong>and</strong>ed not according to the Registration Certificate Regulation 31applies.B. If the recorded markings have changed the following applies:i. Written confirmation from the breeder is required.ii. Photos are required showing the current markings <strong>of</strong> the pony.C. No change <strong>of</strong> any part <strong>of</strong> the animal’s name (prefix <strong>and</strong> name) will be permitted onceregistration is processed.33. REGISTRATION CERTIFICATE.A. <strong>The</strong> Registration Certificate remains the property <strong>of</strong> the <strong>Welsh</strong> <strong>Pony</strong> & <strong>Cob</strong> <strong>Society</strong> <strong>of</strong> <strong>Australia</strong>Inc.B. Replacement <strong>of</strong> lost or misplaced registration certificates will only be issued when a signedrequest from the last registered owner <strong>and</strong> payment <strong>of</strong> the duplicate certificate fee is received.34. ALTERATION TO REGULATIONS OR FEES.A. Any or all <strong>of</strong> the <strong>Society</strong>’s regulations, including fees chargeable, may be amended from timeto time.B.
