LAW REVISION AND REFORM DIVISIONThe Law Revision and Reform Division (<strong>LRRD</strong>) consists of the Revision Section and theReform Section. The Revision Section is divided into three units namely the RevisionUnit, the Reprint Unit and the Extension Unit. Similarly, the Reform Section is alsodivided into three units known as Unit I, Unit II and Unit III.The <strong>LRRD</strong>’s main functions are to –i) Reprint laws in both the national and English language;ii) Publish revised texts of laws;iii) Extend laws of Peninsular Malaysia to Sabah and Sarawak and the FederalTerritories;iv) Translate English texts of pre-1967 laws to the national language;v) Undertake research for the modernization of Malaysian laws in tandem withcurrent needs and globalization; andvi) Undertake research for the harmonization of Malaysian laws with internationalobligations.This <strong>LRRD</strong> has a strength of 63 officers and staff from both headquarters and the State<strong>LRRD</strong> Units.1

REVISION SECTIONRevision UnitState EnactmentsThe establishment of an inhouse Law Revision Committee to review and ascertain theproper application of revision powers by the State Law Revision Units has added a newperspective to the functions of the Law Revision Unit of this Division. Where previouslythe main focus of the unit is in the revision of federal laws, the unit now plays a dual rolein reviewing laws revised by the state revision units as well.The Committee has made steady progress in achieving the purpose of itsestablishment. It has managed to ensure that not only laws revised by each State aredone according to the powers conferred upon the State Law Commissioner but also theapplication of those powers are applied consistently in a like manner and in like situationby the States and at the federal level.With the establishment of the Committee, the State Law Revision Units are required tosubmit the drafts of the laws revised to this Division for perusal and comments by asecretariat comprising of officers and legal assistants of the Division’s Law RevisionUnit. The drafts of the revised laws prepared by the state revision units are thenpresented to the Committee comprising of the Commissioner of law Revision asChairman, the Deputy Commissioner (Law Revision Section) and State Legal Adviserfor approval. The meetings, some of which were held at the States and at the Division,were also attended by the state law revision officers and legal assistants.Thus far, the unit has received 46 draft State Enactments out of which the Committeehas considered 4 such Enactments. The Committee has sat, considered and approvedfour Kelantan Enactments. The State Enactments considered and approved were asfollows:5

Towards this end two federal lawshave been revised and gazetted i.e. the University of Malaya Act 1961 [Act 681] andthe Widows and Pension Act 1915 [Act 682]. Both these laws were gazetted on31.11.<strong>2007</strong>.In addition the Emergency (Essential Powers) Act 1964 was also revised. This law hasbeen submitted and examined by the Law Revision Committee as required undersection 8 of the Revision of Laws Act 1968 [Act 1]. This law is expected to be gazettedby year end.Inspections of State Law Revision UnitsInspection visits were conducted on the law revision units of Pahang, Perak, Selangor,Perlis, Pulau Pinang, Terengganu, Melaka and Kedah as follows –6

Amongst the areas given particular attention to were the filing system, staffdiscipline, office management and the work undertaken by the State Law RevisionUnits.The inspections have been successful in ensuring that the State Law Revision Unitsfunction effectively and in line with the practice adopted by the Division. It is throughthese inspections that the Division obtains first hand knowledge of the problems facedby the State Law Revision Units and suggests ways to overcome the problems.7


Reprint UnitState ConstitutionsFor the first time ever, the <strong>Attorney</strong> General’s <strong>Chambers</strong> through this Division undertookthe reprint and compilation of all Constitutions of the States. Previously each State didits own reprint, taking into account its own needs and demand.The exercise was in collaboration with the respective State Legal Advisers and State<strong>Attorney</strong>s General. Each State prepared the first draft which was the raw data in theform of the gazette copy of its Constitution and inserted amendments. The Divisionimproved on the draft and prepared the compilation.The reprint of thirteen State Constitutions was prepared in all available texts; the romanand Jawi scripts of the Bahasa Malaysia text and English. The entire compilationspanned a total of 2,234 pages. The reprint is in two finishing: a 3-volume compilationconsisting of all State Constitutions, and, individual State Constitutions in pocket-sizededitions.8


The reprint incorporates the current amendments with the cut-off date as at 1 January2008 with consistency in terminology and language. It contains a comprehensivelegislative history, list of amendments and list of sections amended. Where required,footnotes have been inserted. Undoubtedly, the reprint will provide appropriatecontemporary reference and be invaluable to all who need to refer to the variousConstitutions.It is scheduled for completion in May 2008.9


Election lawsThe Division responded to a request from the Election Commission on 25 October <strong>2007</strong>to reprint a series of election laws in both Bahasa Malaysia and English. The laws are –(i) Election Offences 1954 [Act 5];(ii) Elections Act 1958 [Act 19];(iii) Elections (Conduct of Elections) Regulations 1981 [P.U(A) 386/1981]; and(iv) Elections (Postal Voting) Regulations 2003 [P.U(A) 185/2003].The request was treated with utmost urgency in view of the 12th General Electionexpected anytime in 2008. It was vital that all involved in the election, in particularreturning officers, had the updated edition of election laws. It was also important thevarious forms required under the law contained the latest amendments.On 7 December <strong>2007</strong> the work was completed and the laws went to print. 25,000copies were reprinted.10


Reprints in Bahasa MalaysiaThe regular work of the Division in preparing reprints of laws in Bahasa Malaysiaproceeded. The laws reprinted were –(i) Akta Kumpulan Wang Simpanan Pekerja 1991 [Akta 452] (EmployeesProvident Fund Act 1991 [Act 452]);(ii) Akta Jualan Langsung 1993 [Akta 500] (Direct Sales Act 1993 [Act 500]);(iii) Akta Membaharui Undang-Undang (Perkahwinan dan Perceraian) 1976 [Akta164] (Law Reform (Marriage and Divorce) Act 1976 [Act 164]);(iv) Akta Bank Islam 1983 [Akta 276] (Islamic Bank Act 1983 [Act 276]);(v) Akta Lembaga Pembangunan Perindustrian Pembinaan Malaysia 1994 [Akta520] (Lembaga Pembangunan Industri Pembinaan Malaysia Act 1994 [Act520]);(vi) Akta Pencetakan Teks Al-Quran 1986 [Akta 326] (Printing of Qur’anic Texts Act1986 [Act 326]); and(vii) Akta Pengurupan Wang 1998 [Akta 577] (Money-Changing Act 1998 [Act 577]).Extension UnitExtension OrdersThe following extension and modification Orders have been completed –(a) Federal Territory of Labuan(i) National land Code [56 of 1965];(ii) Strata Titles Act 1985 [Act 318];(iii) Licensed Land Surveyor Act 1958 [Act 458];(iv) Land Acquisition Act 1960 [Act 486]; and(v) Land Mining Plans and Documents (Photographic Copies) Act 1950 [Act233].11


(b) Sarawak and Federal Territory of Labuan(i) Registration of Pharmacists Act 1951 [Act 371].The Orders have been submitted to the relevant Ministries to be gazetted. Theextension Orders of the Moneylenders Act 1950 [Act 400] to Sabah, Sarawak and theFederal Territory of Labuan were gazetted on 17 December <strong>2007</strong> as P.U.(A) 413/<strong>2007</strong>and P.U.(A) 414/<strong>2007</strong> respectively.Translation of laws into the national languageThe draft translation of the Moneylenders Act 1950 [Act 400] and Immigration Act 1963[Act 155] has been completed.Compilation of dataCurrently there are about 140 federal laws which are yet to be extended and modified tothe States of Sabah, Sarawak and Federal Territory of Labuan. It was felt the Statesand the Federal Territory of Labuan had to be engaged more effectively in the initialexercise of determing the laws to be extended so as to expedite the work process. On18 November <strong>2007</strong>, a meeting with the State <strong>Attorney</strong>s General of Sabah and Sarawak,and the Ministry of Federal Territory was held. The purpose of the meeting was todiscuss the compilation of data on federal laws to be extended and modified to theStates of Sabah, Sarawak and Federal Territory of LabuanArising from the meeting a list of such laws including those proposed to be extendedand modified has been prepared. However, this is subject to the requirements, needsand approval of the States and Territory concerned.12


REFORM SECTIONSince the inception of the <strong>LRRD</strong>, the Law Reform Section has embarked on law reformwork in diverse areas of law. Through the years, projects become more diversereflecting its sync with changing needs of the society.The Reform Section has moved one step ahead in <strong>2007</strong> when it categorized theproduct of its reform work or activities undertaken since its inception (2002) into variouscategories and arranged them in serial numbers.The product of law reform projects or activities are categorized into Issue Paper,Preliminary Issue Paper, Discussion Paper, Consultation Paper, Interim <strong>Report</strong>, Final<strong>Report</strong>, Annual <strong>Report</strong> and Legal Opinion.ISSUE PAPERThe purpose of an issue paper is to announce an area of law to be studied with the aimto introduce reform, to elucidate the aim and extent of the study, to point to possibleoptions available for solving existing problems and to initiate and stimulate debate onidentified issues by way of including specific questions on relevant issues.PRELIMINARY ISSUE PAPERA preliminary issue paper is a summary of the issues paper and contains a preliminaryexamination of the issues and the guiding principles of specific topics. It is consultativein nature and aims to collect feedback from interested parties and stakeholdersregarding specific issues contained in the paper.13


DISCUSSION PAPERA Discussion Paper would contain the deliberations of any Ad Hoc Committee set up todiscuss the issues identified in the Issue Paper. It gives an explanation of the legalproblems to be addressed, a discussion of various options and the tentative proposalsfor reform. In most cases, Discussion Papers also contain draft legislation that giveseffect to the Ad Hoc Committee’s recommendations and proposals.CONSULTATION PAPERA Consultation Paper would contain the recommendations of external experts ororganizations upon further consultation by the <strong>LRRD</strong> on specific issues.INTERIM REPORTAn Interim <strong>Report</strong> is a preliminary report that contains a summary of therecommendations of an Ad Hoc Committee. Several Interim <strong>Report</strong>s may be issuedprior to the publication of the Final <strong>Report</strong>.FINAL REPORTA Final <strong>Report</strong> contains the final recommendations for reform and the reasons behindthem. It may also contain draft legislations for the implementation of therecommendations. These reports are then forwarded to the <strong>Attorney</strong> General forconsideration.14


ANNUAL REPORTA report published annually to showcase the activities of the <strong>LRRD</strong> for the particularcalendar year.LEGAL OPINIONA Legal Opinion would contain the views and opinions of the <strong>LRRD</strong> on specific legalissues in response to requests from the <strong>Attorney</strong> General, other Divisions of the AGCand other government agencies.Activities/projects undertaken by the Reform Section in <strong>2007</strong> are as follows:AMENDMENT TO THE REVISION OF LAWS ACT 1968 [ACT 1]Work on amendment to Act 1 continued in <strong>2007</strong>. The Bill to amend Act 1 was initiallyprepared primarily for the purpose of changing the composition of Law RevisionCommittee and also to provide the Commissioner of Law Revision and Law Reform withthe powers of reform.However the terms of reference were expanded to review the provisions on revision andreprint. Hence the work is ongoing.REVIEW OF LAW REFORM (MARRIAGE AND DIVORCE) ACT 1976 [ACT 164]In <strong>2007</strong> work on the review of Act 164 continued. The proposed amendments to Act 164on three important issues relating to conversion to Islam, a mother’s right to giveconsent to the marriage of her child under the age of 21 years, the extension of a child’smaintenance beyond 18 years on the ground that the child further his or her educationor training have been finalized.15


The Division has also looked into other issues and the ad hoc Committee has met on17-19 August <strong>2007</strong> to discuss on other proposed amendments to Act 164. Issuesdiscussed during the meeting, among others, were separation of powers under Act 164between Ministry of Women, Family and Community Development and NationalRegistration Department, right of access, maintenance order, mediation, conciliatorybody and psychological assessment.PAROLE SYSTEMThis Section was entasked to address several issues arising from the proposedamendment to the Prison Act 1995 [Act 537]. The concerns include the interplay of thecurrent remission system, power of pardon and parole; and application of the parolesystem to non-citizens.ARBITRATION ACT 2005 [ACT 646]The review of the Arbitration Act 2005 [Act 646] continued to progress. A DiscussionPaper 13/<strong>2007</strong> was prepared to initially deal with the implications arising from thedecision of the Court of Appeal in the case of Sri Lanka Cricket v. World SportNimbus Pte Ltd (2006) 2 CLJ 316. The opportunity was taken to consider furtherissues. Such issues include-• Stay of Court Proceedings: Can a Malaysian court stay a court action if theplace/seat of arbitration is outside Malaysia?• Enforcement of international awards made in Malaysia: Can an award made inan international arbitration in Malaysia be enforceable under the Act in Malaysia?16


• Interim measures: Can a Malaysian court grant interim measures if the seat ofarbitration is outside Malaysia?Meetings and discussions were conducted with the Bar Council, arbitrators and otherrelevant stakeholders. This followed drafting of an Arbitration (Amendment) Bill <strong>2007</strong>proposing amendments to Act 646 to offer solutions to the problem/issues.MEDIATIONTwo draft bills on Mediation were submitted by the Sub-Committee of the RulesCommittee and the Bar Council. In the course of studying the two Bills, the issue ofcompulsory mediation before the filing of cases in court and the implications arisingthere from arose. Work is continuing on the matter.NO-FAULT LIABILITY SCHEMEOn 6 March 2006, the <strong>LRRD</strong> received instructions from the <strong>Attorney</strong> General to conducta study on the possibility of introducing a No-Fault Liability Scheme. Subsequently initialresearch was conducted and the drafting of a Preliminary Issue Paper began. Then, on6 August <strong>2007</strong>, plans for the scheme made national headlines in the New Straits Times.Through an exclusive interview, the <strong>Attorney</strong> General announced that the <strong>Attorney</strong>General <strong>Chambers</strong> was considering the introduction of a No-Fault Liability scheme thatwould provide quick compensation for motor vehicle accident victims.Following from that, the <strong>LRRD</strong> conducted various meetings with stakeholders in order tosolicit their views and opinions. The meetings were held on 29 August <strong>2007</strong>, 4 October<strong>2007</strong>, 1 to 2 November <strong>2007</strong> and from 12 to 16 November <strong>2007</strong>. On 9 November <strong>2007</strong>,the Preliminary Issue Paper on the scheme was finalized and posted on the AGC’swebsite for views and opinions. A questionnaire was also inserted for the public tocomment on the scope and structure of the proposed scheme.17


In addition, a public lecture entitled “No Fault Liability in New Zealand: Lessons forMalaysia” was held at the Putrajaya International Convention Center (PICC) on 12November <strong>2007</strong>. The speaker for the public lecture was Mr. David Cochrane, an expertfrom New Zealand.The speaker and his colleague Ms. Siobhan Hale were also involved in the InternationalVisiting Expert Programme (IVEP) organized by the <strong>LRRD</strong> from 12 to 16 November<strong>2007</strong>. The IVEP was a programme designed to facilitate information on the NewZealand scheme and there were also discussions with stakeholders on whether thescheme was suitable for Malaysia.On 5 and 6 December <strong>2007</strong>, the Central Bank and General Insurance Association ofMalaysia conducted a forum on the NFL schemes. Experts from Australia, Japan andThailand were invited to present their respective NFL models.Currently, the <strong>LRRD</strong> is working on a Discussion Paper which is a compilation of viewsand opinions expressed in the meetings, public lecture, forum and discussions duringthe IVEP programme.18

Annual ConferenceThe Division had its annual conference at the Crown Plaza Riverside Hotel, Kuching,Sarawak from 4 to 7 March <strong>2007</strong>. About 50 participants from headquarters, stateunits and the Companies Commission of Malaysia attended the conference.The conference was officiated by YBhg. Tan Sri Abdul Gani Patail, the <strong>Attorney</strong>General. A dialogue session between the <strong>Attorney</strong> General and officers of theDivision was held with the Solicitor General in attendance.Working Papers were presented at the conference. Prof. Dato’ Dr. Shaharil Talibgave a talk entitled “Back to the Future” and Dr. Ranjit Singh Malhi on “Self-Esteemand Peak Performance at Work”. Madam Nurul Husni Abdul Rahman presented apaper on the proposed amendments to the Revision of Laws Act 1968 [Act 1].Madam Norhayati Mohd Noor presented on “Development of Self-Potential” and MrShahrom Idris on the functions of Legal Assistants.As part of its social activity, a bowling competition was held and a visit to the SarawakBiodiversity Centre was also organized. The conference concluded with a dinnerthemed “Denim/Denim Cowboy Nite”.22

Second Annual Event of the <strong>Attorney</strong> General’s <strong>Chambers</strong>The Division took part actively in the organization of the Second Annual Event of the<strong>Attorney</strong> General’s <strong>Chambers</strong> of Brunei Darussalam, Malaysia and Singapore held atNexus Resort, Karambunai, Sabah from 19- 21 April <strong>2007</strong>. The Division together withthe International Affairs Division was the Secretariat to the event. About 180participants comprising legal officers from the <strong>Attorney</strong> General’s <strong>Chambers</strong> of the threecountries participated in the event. The event was officiated by the Honourable DeputyPrime Minister of Malaysia.42


International Visiting Expert ProgrammeAs an extension of the consultation process, a Public Lecture on No-Fault Liabilityproject was organized by the Division on 12 November <strong>2007</strong>. It was one of the activitiesidentified under the International Visiting Expert Programme (IVEP). The title of thePublic Lecture was “No-Fault Liability in New Zealand: Lessons for Malaysia”. Thelecture provides a platform to the wider public with a view to opening up discussion anddebate.The expert for the programme was Mr David Cochrane, a lawyer from Chapman & Trip,a prominent legal firm in New Zealand. He is an expert in the field under study by theDivision i.e a proposal to introduce a compensation scheme to victims of motor vehicleaccidents. The expert spent a week with the officers of the Division providing expertadvice on several aspects identified for the project.43


Internal Audit MS ISO 9001:2000A second Internal Audit was conducted on 2 and 3 October <strong>2007</strong> to fulfill therequirement of the manual quality document MS ISO 9001:2000. The Internal Audit wasconducted by four internal auditors appointed by the Commissioner of Law Revision andReform. Activities covered by the audit process were the manual quality, ManagementRepresentative, work process for revision, reprint, translation, reform andadministration. An audit report was prepared and submitted to the ManagementRepresentative.44
