All the provisions of the FBIH Decree are pursuant to the obligations assumedunder the contract on the establishment of the Energy Community, and the EU Directive regarding naturalgas. 22 Upon the enactment of the FBIH Law on Gas, the natural gas sector is also governed by the relevantprovisions of the FBIH Law on Concessions, the FBIH Law on Planning and Land Use, the FBIH CorporateLaw, various laws relating to energy, environment protection and all the supporting secondary regulations.The main regulator in this sector is the Ministry of Mining and Energy of the FBIH. Its functions will behanded over to the “FBIH Agency” once this has been established.OilWith regard to oil, a license is compulsory for the following activities in the RS: the production of oil derivatives,oil pipeline transport, the transportation of oil derivatives and the storage of oil/ oil derivatives.For the wholesale and retail trade of oil derivatives, oil/oil derivatives storage for personal use or oil/oilderivatives transportation by other transportation methods a license is not needed. A license is issued bythe RCERS for each activity separately for a period of 5 years and this can be extended.
