National policy, program and activityrelated to sharksLocal Government Code of 1991 (RA 7160)Most of the functions and services of the national government, includingfisheries, are devolved to the Local Government Units (LGUs) with the passageof the Republic Act (RA) 7160 (also known as the Local Government Code)Philippine Fisheries Code of 1998 (RA 8550)The primary mandate for aquatic resources management was further definedby the enactment of Republic Act 8550, also known as the New PhilippineFisheries Codeof 1998. It largely clarified issues pertaining to the extent ofLGU jurisdiction in municipal waters and the operation of commercialvessels. The Code also aims for food security through development,management and conservation of the aquatic resources. Operationally,BFAR takes its general directives from the Department of Agriculture (DA).

National policy, program and activityrelated to sharksBan on the taking or catching, selling, purchasing andpossessing, transporting and exporting of Whale Sharks andManta Rays (FAO 193 s. 1998)The ban was published in the Manila Bulletin & Phil. Star – March 27, 1998,with the effectivity date set on April 12, 1998. Offenders are subject to a fine ofnot less than five hundred (P500.00) pesos to not more than five thousand(P5,000) pesos or imprisonment from six (6) months to four (4) years, or bothsuch fine and imprisonment depending on the discretion of the court. Directorof Fisheries and Aquatic Resources is hereby empowered to impose upon theoffender an administrative fine not more than five thousand (P5,000.00) pesosor to cancel his permit or license or to impose such fine and to cancel hispermit or license at his discretion including the confiscation of the whale sharkand/or manta rays for proper disposition/documentation of the government.
