The Lunchwith the CEO initiative is still active,now a quarterly event, and employeesare reminded that the purpose of suchgatherings is to give direct access toupper management, enhancing internalcommunication and freely conveyingmessages, comments, concerns orsuggestions employees may otherwisebe hesitant to share. Please do take thisopportunity and let your voice be heard.In addition to Lunch with the CEO, we helda management internal communicationsworkshop on February 26, 2013 toenhance our internal communications andfacilitate more effective team cooperationacross the Group. This hands-on eventoffered a chance for all management toopenly share barriers to communication,and was followed by a cooking competitionwhere managers were split into teamsand challenged to prepare the best dishwith limited time and resources. Allmembers left energized and with a deeperunderstanding of how our common goals,values and vision, allow us to work towardsour shared values and grow as a company.Communicating is not just about gettinginformation; it is just as much aboutreceiving it. Listening is an importantcommunication skill; God created us withtwo ears, two eyes and one mouth—andwe should therefore understand thatlistening and observing is more importantthan talking.Effective communication will allow us toperform better as individuals and as agroup, within our own departments andwith our own teams, and between thedifferent companies across the group. It isimportant that our messages are properlydigested and that our team members takeownership over the messages that aredelivered. It is also important to note thatmessages in the workplace must remainpositive and professional; they should notbe taken personally, and we should bedirect and honest in our communication.Miscommunication is often the result ofvague roles and undefined responsibilities.However, it is each and every one of ourresponsibility to understand our positionsin the company and our responsibilities.These are clearly outlined in the company’sbusiness systems, and we are now workingon creating some tools that make it easierfor employees to understand the languageof business systems. Refund of withholding taxIn accordance with DZIT circular, acompany is required to settle withholdingtax based on Saudi Arabian domestic taxlaw and subsequently request refund ofexcess withholding tax settled, based onthe DTT provisions. As such, in a numberof cases, WHT was paid according tothe Saudi Arabian Tax Regulationsand subsequently a refund applicationtogether with the required documentswas filed. The refund cheque was securedin four months.To claim a withholding tax refund basedon DZIT, the Saudi entity is required tosubmit the following documents:• A letter from the resident of the taxtreaty country requesting a refund ofthe taxes paid; and• A valid certificate from tax treatycountry tax authorities confirmingthat the claimant is a resident in thetax treaty country and the amountspaid are subject to tax in treatycountries.The DZIT officials have recently advisedthat to claim the tax treaties’ benefits,the letters issued by the foreign vendorand the letter issued by foreign taxauthorities should also be attested bySaudi Embassies in their respectivecountries and by the ministry of ForeignAffairs in Saudi Arabia.11. Refund of excess WHTinadvertently paidIn accordance with the Tax Regulations,WHT is considered final and notrefundable. The PAC has also upheld theDZIT’s treatment of rejecting the requestfor a refund of excess WHT which wasinadvertently paid.12. WHT obligationAn authorized person acting as abroker/agent under the Capital MarketAuthorities (CMA) to buy and sellsecurities on behalf of non-resident GCCinvestors is required to withhold tax onthe payment of dividend to the nonresidentGCC investors.13. Settlement of own withholdingtaxThe DZIT registered a non-resident entityand allowed it to settle its WHT liabilityon a Government contract by itself.14.
