As far as practicable, one of them must be a lawyer and the composition of the<br />
Commission must be gender balanced.<br />
SEC 16. Terms of Office - The Chairperson and Commissioners shall be<br />
appointed by the President subject to confirmation by the Cornmission on Appointments<br />
for a term of seven (7) years without reappointment. In no case shall any member be<br />
appointed or designated in a temporary or acting capacity. Appointment to any vacancy<br />
shall be only for the unexpired term of the predecessor.<br />
SEC 17. Compensation - The salaries of the Chairperson and the<br />
Commissioners shall be fixed by law and shall not be decreased during their tenure.<br />
SEC 18. Prohibition. - No Member of the Commission shall, during their<br />
tenure, hold any other office or employment except when expressly provided by law.<br />
Neither shall he/she engage in the practice of any profession or in the active<br />
management or control of any business which in any way be affected by the functions of<br />
hidher office, nor shall he/she be financially interested, directly or indirectly, in any<br />
contract with, or in any franchise or privilege granted by the government, any of its<br />
subdivisions, agencies, or instrumentalities, including government-owned or controlled<br />
corporations.<br />
SEC. 19. Powers and Functions of the Commission. - The Commission<br />
shall have the following powers and functions.<br />
Administer and enforce the constitutional and statutory provisions and<br />
such other mandatory provisions of law on the merit system for all levels<br />
and ranks in the civil service system;<br />
Prescribe, enforce and amend rules and regulations for carrying into effect<br />
the provisions of this Code and other pertinent laws which shall become<br />
effective thirty (30) days from the date of publication in the Official Gazette<br />
or in a national newspaper of general circulation.<br />
Promulgate its own rules concerning pfeadings and practice before it or<br />
any of its offices, which shall not diminish, increase or modify substantive<br />
rights;<br />
Promulgate policies, standards and guidelines for the civil service system<br />
and adopt plans and programs to promote ethical, efficient and effective<br />
personnel administration in the government including innovative systems<br />
and mechanisms to ensure feedback from the public;<br />
Formulate policies and regulations for the administration, maintenance<br />
and implementation of Position Classification and Compensation system;<br />
Render decisions, orders, opinions or rulings on civil service matters<br />
which shall be binding on heads of department and agencies and<br />
immediately executory and notwithstanding any law to the contrary, may<br />
be brought only to the Supreme Court on certiorari;<br />
Discipline CES members for cause after due process;
