As far as practicable, one of them must be a lawyer and the composition of the
Commission must be gender balanced.
SEC 16. Terms of Office - The Chairperson and Commissioners shall be
appointed by the President subject to confirmation by the Cornmission on Appointments
for a term of seven (7) years without reappointment. In no case shall any member be
appointed or designated in a temporary or acting capacity. Appointment to any vacancy
shall be only for the unexpired term of the predecessor.
SEC 17. Compensation - The salaries of the Chairperson and the
Commissioners shall be fixed by law and shall not be decreased during their tenure.
SEC 18. Prohibition. - No Member of the Commission shall, during their
tenure, hold any other office or employment except when expressly provided by law.
Neither shall he/she engage in the practice of any profession or in the active
management or control of any business which in any way be affected by the functions of
hidher office, nor shall he/she be financially interested, directly or indirectly, in any
contract with, or in any franchise or privilege granted by the government, any of its
subdivisions, agencies, or instrumentalities, including government-owned or controlled
corporations.
SEC. 19. Powers and Functions of the Commission. - The Commission
shall have the following powers and functions.
Administer and enforce the constitutional and statutory provisions and
such other mandatory provisions of law on the merit system for all levels
and ranks in the civil service system;
Prescribe, enforce and amend rules and regulations for carrying into effect
the provisions of this Code and other pertinent laws which shall become
effective thirty (30) days from the date of publication in the Official Gazette
or in a national newspaper of general circulation.
Promulgate its own rules concerning pfeadings and practice before it or
any of its offices, which shall not diminish, increase or modify substantive
rights;
Promulgate policies, standards and guidelines for the civil service system
and adopt plans and programs to promote ethical, efficient and effective
personnel administration in the government including innovative systems
and mechanisms to ensure feedback from the public;
Formulate policies and regulations for the administration, maintenance
and implementation of Position Classification and Compensation system;
Render decisions, orders, opinions or rulings on civil service matters
which shall be binding on heads of department and agencies and
immediately executory and notwithstanding any law to the contrary, may
be brought only to the Supreme Court on certiorari;
Discipline CES members for cause after due process;
