SEC. 8. Categories offositjon. - Positions in the civil service system shall be<br />

categorized as career and non-career.<br />

SEC. 9. The Career Service. - The career service shall be characterized by (a)<br />

entrance based on merit and fitness to be determined, as far as practicable, by<br />

competitive examinations or on highly technical qualifications; (b) opportunity for<br />

advancement to higher career positions; and (c) security of tenure which is also based<br />

on performance, mechanics of which shall be formulated by the Commission.<br />

SEC. IO. Positions Included in the Career Service. - Positions in the career<br />

service include the following:<br />

(a)<br />

(c)<br />

Open career positions - appointment to which requires qualification in an<br />

appropriate examination or other modes in accordance with law;<br />

Closed career positions - positions that are scientific or highly technical in<br />

nature, which maintain their own merit systems, such as the following:<br />

(1) Faculty and academic staff of state universities and colleges or<br />

scientific and technical positions in scientific or research institutions;<br />

(2) Career Executive Service;<br />

(3) Career officers, Qther than those in the career executive service, who<br />

are appointed by the President, such as the foreign service officers in<br />

the Department of Foreign Affairs, the judges and justices in the<br />

Judiciary and the prosecutors in the prosecution services;<br />

(4) Uniformed and commissioned personnel of the Philippine National<br />

Police;<br />

Permanent laborer, whether skilled, semi-skilled, or unskilled.<br />

SEC. 11. CIasses of Positions in the Career Service. - Positions in the<br />

career service shall be grouped as follows:<br />

(a) First Level - includes clerical, trades, crafts and custodial positions<br />

whether in a non-supervisory or supervisory capacity;<br />

(b)<br />

(c)<br />

Second Level - includes professional, highly technical, scientific or other<br />

highly specialized positions in a supervisory or non-supervisory capacity<br />

requiring at least a baccalaureate degree or its equivalent as determined<br />

by the Commission; and<br />

Third Level - includes the highest-level positions in the career service as<br />

determined in the Position Classification and Compensation System.<br />

Except as otherwise provided in this Code, entrance to the first two levels shall<br />

be through competitive or special examinations to be given by the Commission.<br />

Entrance to the third level shall be based on qualification requirements prescribed by
