Title I - Termination of Employment<br />

Chapter 1. Modes of Termination<br />

SEC. 226. Modes of Termination - The following are modes of terminating<br />

employment in the government;<br />

(a) Resignation - A public officer or employee shhll be considered separated<br />

from service effective on the date of acceptadce of the resignation by the<br />

officer authorized to do so.<br />

(b) Candidacy - An appointive public officer or ployee shall be ipso facto<br />

separated from the service on the date of the certificate of candidacy<br />

for an elective position.<br />

(c) Death - Upon proof of death, the public1 officer or employee shall<br />

automatically be recorded as separated from thd service.<br />

(d) Permanent Disability - In case of permanent digability which shall render the<br />

public officer or employee incapable of performing the official duties, the<br />

department of agency head may terminate such1 public officer or employee.<br />

(e) Expiration of Period of Employment - The s&vices of a public officer or<br />

employee appointed for a fixed period, or fori a specific project or whose<br />

appointment is coterminous with the appointing officer sh,lll be terminated<br />

upon the expiration of the period of employmen(, completion of the project, or<br />

at the end of the term of the appointing offiper, unless otherwise earlier<br />

validly separated.<br />

(f) Dropped from the Service. - A public officer or employee who goes on leave<br />

without proper authority or fails to return to duty after the expiration of the<br />

authorized leave, w'ithout valid reasons, and food other grounds under existing<br />

rules, shall be dropped from the service in ac$ordance with the regulations<br />

promulgated by the Commission.<br />

(9) Conviction - The services of the public<br />

(h) Retirement -Any public officer or employee 1y ho reaches the compulsory<br />

retirement age and meets the service requiremient shall be retired under the<br />

provisions of the Retirement Law, unless hidher services is extended by the<br />

Commission in accordance with its rules and rdgulations. Optional retirement<br />

pursuant to law likewise terminates official relat<br />

(i) Expiration of Temporary Appointment - The<br />

employee with temporary appointment<br />

upon the expiration of the appointment.<br />

(j) Diaspproval of Appointment - The services of a public officer or employee is<br />

considered termination upon tlle final disapproval of the appointment by the<br />

Commission.
