heads of departments, agencies, and instrumentalities of the National<br />
Government and the disciplining authority of state universities and colleges,<br />
government-owned and-controlled corporations with original charters or<br />
created under special 'laws and local government units, shall be final and<br />
executory, if the penalty imposed is suspension of not more than thirty (30)<br />
working days or a fine of not more than thirty (30) working days pay.<br />
(b) Without prejudice to the power of review by the Commission and its powers<br />
to decide cases on appeal provided for in this Code, the decision of the head<br />
of the bureau or department-wide regional office shall be final and executory,<br />
if the penalty imposed is suspension of not more than thirty (30) working or a<br />
fine of not more than thirty (30) working days' pay.<br />
(c) The decision in a disciplinary case becomes final upon expiration of the<br />
period within which to file a motion for reconsideration and no such motion is<br />
filed.<br />
SEC. 197. Execution of Decision -<br />
(a) The decisions of heads of agencies and other disciplining authorities shall be<br />
immediately executory upon receipt of a copy thereof by the parties<br />
concerned, even pending appeall.<br />
(b) Decisions of the disciplining authority in disciplinary cases shall be<br />
immediately executory unless a motion for reconsideration is seasonably<br />
filed, in which case the execution of the decisions shall he held in abeyance<br />
pending resolution of the motion,<br />
(c) The filing and pendency of petition for cefiorari with the Supreme Court shall<br />
not stop the immediate execution of the decision of the Commission, unless<br />
the Court issues a restraining order or a writ of preliminary injunction. For<br />
this purpose, no other Courts can issue a temporary restraining order or a<br />
writ of preliminary injunction against the Commission.<br />
Chapter 5. Administrative Penalties<br />
SEC. 198. Penalfies That May Be lmposed. - Heads of departments and<br />
agencies and other disciplining authorities may impose the penalty of reprimand or<br />
censure, fine in amount not exceeding six (6) months' salary, suspension without pay<br />
for not more than one (I)<br />
year, demotion in rank or pay, or dismissal from the service.<br />
SEC. 199. Imposition of Penalties -<br />
(a) In meting out punishment, the same politics shall be imposed for similar<br />
offenses and only one (I) penalty shall be imposed in each case. In the<br />
imposition of these penalties, the disciplining authority shall take into<br />
consideration the circumstances which may either exonerate the respondent<br />
from from any liabiilty, mitigate or aggravate the offense.<br />
(b) In the imposition of the proper penalties, the adminstrative offenses or<br />
causes for disciplinary action mentioned in this Code shall be categorized<br />
into light, less grave, and grave.<br />
(c) The Commission shall promulgate rules and regulations on the classification<br />
of administrative offenses into light, less grave and grave and shall prescribe<br />
the corresponding principal and accessory penalties, such as cancellation of
