proper hearing of the issues. The decision of the arbitrator shall be<br />

fined and binding on the contending parties.<br />

2. Compulsory - a method resorted to when the dispute has become<br />

hardened and irreconcilable and remains unresolved after exhausting<br />

all the available remedies under existing laws and procedures.<br />

B. Conciliation - refers to the process whereby a third party (conciliator)<br />

brings the disputing parties together, encourages them to discuss their<br />

differences and assists them in developing their own proposed solutions.<br />

C. Mediation - refers to the process which by a third party (mediator) is more<br />

active in assisting the disputing parties reach acceptable solutions to the<br />

problem/s and help them develop or come out with an acceptable solution.<br />

The mediator may submit proposaVs for the settlement of dispute.<br />

SEC. 124. Settlement of Disputes Within An Agency. - Disputes within<br />

employee organizations, between and among employee organizations, and between<br />

employee organizations and management shall be settled through conciliation,<br />

mediation and arbitration. The Commission shall be responsible in providing conciliation<br />

and mediation services. In case any dispute remains unresolved, the Commission shall<br />

certify the same to the Public Sector Labor Management Council (PSLMC), which shall<br />

resolve and settle it within the period of sixty (60) day's from receipt thereof.<br />

However, the parties may opt to submit the issue for voluntary arbitration, the<br />

decision of which shall be final and unappealable.<br />

Chapter 4. Public Sector Labor-Management Council<br />

SEC. 125. Public Sector Labor Management Council (PSLMC). - Public<br />

Sector Labor-Management Council (PSLMC) is hereby constituted to be composed of<br />

the following:<br />

(a)<br />

(b)<br />

(c)<br />

(d)<br />

(e)<br />

(f)<br />

Chairperson, Civil Service Commission - Chairperson;<br />

Secretary, Department of Labor and Employment - Vice Chairperson<br />

Secretary, Department of finance - Member;<br />

Secretary of Justice - Member;<br />

Secretary, Department of Budget and Management - Member; and<br />

One (I ) employee representative each from the National Government<br />

Agencies (NGAs), the Government-owned and Controlled Corporations<br />

(GOCCs), the Local Government Units (LGUs), and the State Colleges<br />

and Universities (SUCs), to be chosen by the employee organizations<br />

concerned.<br />

The ex-officio members may designate their permanent alternates who hold<br />

positions not lower than an assistant secretary or its equivalent.<br />

The employee representatives, who may also designate their permanent<br />

alternates, shall serve for a term of two (2) years or until their successors shall have<br />

been appointed or elected. In no case, however, shall anyone of them serve under<br />

holdover capacity for more than one (1) year.<br />

The PSLMC may deputize public officers and employees of the Commission and<br />

of other departments and agencies to investigate and hear cases brought before it for<br />

arbitration. It may likewise deputize any national or local law enforcement agency or<br />

instrumentality of the government which shall act under its direct and immediate
