SEC. 118. Protection of the Right to Self-Organization. - Government<br />
employees shall not be discriminated against by reason of their membership in<br />
employee organizations or participation in the normal and legitimate activities of such<br />
organizations. Employment in the civil service system shall not be subject to the<br />
condition that the individual shall not form or join any employee’s organizations.<br />
Management shall not interfere in the establishment and administration of<br />
government employee organizations.<br />
Chapter 2. Employee Organization<br />
SEC. 119. Registration of Rank-and-File Employee Organization - Rank-<br />
and-file employee Organizations shall register with the Commission in accordance with<br />
the implementing guidelines to be promulgated by the Commission.<br />
SEC. 120. Sole and Exclusive Employee Organizafion. - The duly<br />
registered employee organization in an agency that has the support of the majority of<br />
the total rank-and-file employees, shall be accredited by the Commission as the sole<br />
and exclusive employee representative. In cases when there are two (2) or more<br />
registered employee organizations in an agency, the Commission, upon petition, shall<br />
conduct a certification election and shall certify the employee organization who<br />
garnered the majority vote as the sole and exclusive representative of the rank-and-file<br />
employees in the said agency.<br />
For this purpose, an agency shall refer to an office which has its own budgetary<br />
allocations as provided for in the General Appropriations Act, specifically its Table of<br />
Contents.<br />
SEC. 121. Accredifatioh of Employee Federation in An Agency. -<br />
Registered employee organizations within a given agency may federate and shall be<br />
accredited as the sole and exclusive bargaining representative of the employees;<br />
Provided, its aggregate total membership constitute the majority of the total rank-and-<br />
file employees in the agency.<br />
SEC. 122. Collective Negotiations. - Except those that are fixed by law,<br />
terms and conditions of employment in the government service may be the subject of<br />
collective negotiations between duly accredited employee organizations and the<br />
appropriate government authorities.<br />
Collective negotiations agreement shall be registered with the Commission.<br />
Chapter 3. Settlement of Disputes<br />
SEC 123. Definifion of ferms. - For purposes of this Code, the following<br />
terms shall be defined as follows:<br />
A. Arbitration - refers to the process whereby a third party (individual<br />
arbitrator), a board of arbitrators, or an arbitration court not acting as a<br />
court, is empowered to make a decision which disposes of the dispute.<br />
1. Voluntary - a method of settling disputels where both parties agree to<br />
submit the dispute before an arbitrator or panel of arbitrators chosen<br />
by both parties. The voluntary arbitrators shall render a decision after
