appointment cannot be withdrawn or cancelled by the appointing authority and shall<br />

remain in full force and effect unless disapproved by the Commission. However, an<br />

appointment issued through fraudulent means or in violation of law, shall be void from<br />

the beginning.<br />

In the case of temporary appointment, the twelve (12) month period of its<br />

effectivity shall be reckoned from the date of issuance of the appointment and not from<br />

the date the appointee assumes the duties of the position.<br />

No public officer or employee shall allow a person to render service without a<br />

copy of the appointment duly issued by the appointing authority. Those who allow such<br />

service in violation of this Section shall be personally liable for the salaries of the person<br />

concerned. Moreover, the services rendered by the said person shall not be credited as<br />

government service.<br />

If the appointee does not assume office within thirty (30) days from date of<br />

receipt of approved appointment, said appointment shall be deemed automatically<br />

cancel led.<br />

If the appointee is not allowed to assume office by the appointing authority in<br />

spite of the Comission ‘s approval of the appointment, the appointing authority shall be<br />

held liable for contempt of the Commission. This is without prejudice to his liability<br />

under RA 3019 (Anti-Graft and Corrupt Practices Act) and other criminal and<br />

administrative sanctions.<br />

SEC. 70. Appointment Form. - An appointment shall be issued in the form<br />

prescribed by the Commission.<br />

SEC. 71. Submission of Appointments and Oaths of Office. - All<br />

appointments in the civil service system, except those issued by the President and<br />

those of the Armed Forces of the Philippines, shall be submitted to the Commission for<br />

approval not later than thirty (30) days from the date of issuance thereof. Such approval<br />

shall be indicated below the signature of the appointing authority; otherwise, it shall be<br />

made effective thirty (30) days prior to the date of submission to the Commission,<br />

Copies of appointments and oaths of office of those appointed by the President<br />

shall be submitted to the Commission for record purposes.<br />

SEC. 72. Merit Promotion Plan - Each department or agency shall establish<br />

a Merit Promotion Plan, in accordance with standards and guidelines prescribed by the<br />

Commission.<br />

SEC. 73. Appropriate Civil Service €/igibi/ity. - Appropriate civil service<br />

eligibility shall be required for permanent appointment to positions in the career service<br />

in accordance with the standards set by the Commission. Whenever there is a qualified<br />

civil service eligible willing and actually available for appointment, no appointment shall<br />

be issued to a person who is not eligible, even in temporary capacity. However, a<br />

temporary appointment may be issued to eligibles who lack any of the other<br />

requirements for appointment or, to non-eligibles who meet all the other mandatory<br />

requirements for a particular position.<br />

A person with a civil service eligibility acquired by passing an examination shall<br />

be qualified for a position requiring a lower level eligibility if he/she possesses the other<br />

requirements for appointment to such position.
